Takvo mišljenje Opće sjednice, na kojoj prvi put u povijesti izbora za predsjednika jednog suda ni jedan kandidat nije dobio natpolovičnu većinu potrebnog broja glasova sudaca Vrhovnog suda, bit će upućeno u Ministarstvo pravosuđa, no nepoznato je i pravno nejasno što će se dalje događati.
Zakon o sudovima, naime, ne predviđa mogućnost da se natječaj za predsjednika suda raspisuje treći put. Na Općoj sjednici održanoj u ponedjeljak Marica Šćepanović dobila je 17 glasova, Damir Primorac 13, a Amara Trgo deset glasova.
Sjednici je, kako nam je potvrdio sudac Dražen Tripalo, nazočilo 37 sudaca, što znači da je za natpolovičnu većinu, odnosno za dobivanje pozitivnog mišljenja bilo potrebno 19 glasova.
Radi se o ponovljenom natječaju za predsjednika splitskog Županijskoga suda nakon što je ministrica Ana Lovrin prošle godine iskoristila svoje zakonsko pravo te ni jednog od kandidata nije imenovala na čelo suda.
Prošli mjesec Sudačko vijeće u Splitu, u kojem je uz šest sudaca splitskog Županijskoga suda bilo još šest sudaca s područnih sudova, kao svog kandidata predložilo je Damira Primorca koji je dobio devet glasova, dok je Marica Šćepanović dobila tri.
No, bez obzira na to što Amara Trgo nije osvojila ni jedan od glasova, i njezin je rad tada ocijenjen pozitivnim. Prema Zakonu o sudovima, ako mišljenje Opće sjednice VSRH bude pozitivno za jednog ili više kandidata, ministrica pravosuđa dužna je između pozitivno ocijenjenih kandidata koje je predložilo sudačko vijeće imenovati predsjednika suda.
Sad sve pada u vodu jer Zakon o sudovima ne predviđa mogućnost koja se dogodila na Općoj sjednici Vrhovnog suda.

Takvo mišljenje Opće sjednice, na kojoj prvi put u povijesti izbora za predsjednika jednog suda ni jedan kandidat nije dobio natpolovičnu većinu potrebnog broja glasova sudaca Vrhovnog suda, bit će upućeno u Ministarstvo pravosuđa, no nepoznato je i pravno nejasno što će se dalje događati.
Zakon o sudovima, naime, ne predviđa mogućnost da se natječaj za predsjednika suda raspisuje treći put. Na Općoj sjednici održanoj u ponedjeljak Marica Šćepanović dobila je 17 glasova, Damir Primorac 13, a Amara Trgo deset glasova.
Sjednici je, kako nam je potvrdio sudac Dražen Tripalo, nazočilo 37 sudaca, što znači da je za natpolovičnu većinu, odnosno za dobivanje pozitivnog mišljenja bilo potrebno 19 glasova.
Radi se o ponovljenom natječaju za predsjednika splitskog Županijskoga suda nakon što je ministrica Ana Lovrin prošle godine iskoristila svoje zakonsko pravo te ni jednog od kandidata nije imenovala na čelo suda.
Prošli mjesec Sudačko vijeće u Splitu, u kojem je uz šest sudaca splitskog Županijskoga suda bilo još šest sudaca s područnih sudova, kao svog kandidata predložilo je Damira Primorca koji je dobio devet glasova, dok je Marica Šćepanović dobila tri.
No, bez obzira na to što Amara Trgo nije osvojila ni jedan od glasova, i njezin je rad tada ocijenjen pozitivnim. Prema Zakonu o sudovima, ako mišljenje Opće sjednice VSRH bude pozitivno za jednog ili više kandidata, ministrica pravosuđa dužna je između pozitivno ocijenjenih kandidata koje je predložilo sudačko vijeće imenovati predsjednika suda.
Sad sve pada u vodu jer Zakon o sudovima ne predviđa mogućnost koja se dogodila na Općoj sjednici Vrhovnog suda.
