| Sudac Primorac tvrdi da propuste treba tražiti kod tužitelja |
Kao sudac koji je vodio i riješio predmet, Damir Primorac, sada odvjetnik, ističe da je nemoguće da Županijsko državno odvjetništvo u Splitu nije obaviješteno o obustavi postupka.
- Kao sudac, nisam bio osobno zadužen za otpremu pismena, ali ponavljam da rješenje o obustavi postupka ne bi postalo pravomoćno da ga nisu zaprimile sve stranke u postupku, pa tako i ŽDO. U spisu koji je arhiviran sigurno postoji i dostavnica koju su morali potpisati. Ako u njihovoj evidenciji zaista nije zabilježeno da je predmet okončan zbog smrti optuženoga, do propusta je moralo doći kod njih. Namučio sam se da provedem sve potrebno za obustavu postupka, pa ne bih želio da se na kraju moje ime veže za eventualne propuste, kazao je odvjetnik Primorac.
Borivoje Brkić, pilot JNA, optužen je 1992. godine da je nekoliko mjeseci ranije, u rujnu 1991., podmetnuo bombu na vrata svog stana u Splitu, od čega je poginula jedna osoba, a druga je ranjena. Poginuo je nekoliko dana kasnije u helikopteru iznad Knina tijekom vojne operacije.
Tek 2007. godine, dakle 15 godina nakon tih zbivanja, na Županijskom sudu u Splitu zakazano je prvo ročište po optužnici koja je podignuta kada je optuženi već bio mrtav. Spis se 15 godina “gubio” po sudu, prvo po Vojnom sudu, a kada je on ukinut, po Županijskom sudu.
Na kraju, kada je započelo suđenje, dokazano je da je optuženi Brkić mrtav i obustavljen je postupak. ŽDO do prošlog tjedna nije imao evidentiran taj podatak. Gdje se izgubilo rješenje o obustavi tijekom dostave sa suda u ŽDO, nije jasno. Obje institucije su u istoj zgradi, dijeli ih tek jedan kat.

1991. Borivoje Brkić, pilot JRZ-a, bježi u Knin, a stan u Splitu minira. Jedna je osoba poginula, a druga je ranjena. 1992. Podignuta optužnica, iako je Brkić poginuo pokraj Knina u rujnu 1991. 2009. Državno odvjetništvo, dvije godine nakon suda, napokon zatvara spis. |

Kao sudac koji je vodio i riješio predmet, Damir Primorac, sada odvjetnik, ističe da je nemoguće da Županijsko državno odvjetništvo u Splitu nije obaviješteno o obustavi postupka.
- Kao sudac, nisam bio osobno zadužen za otpremu pismena, ali ponavljam da rješenje o obustavi postupka ne bi postalo pravomoćno da ga nisu zaprimile sve stranke u postupku, pa tako i ŽDO. U spisu koji je arhiviran sigurno postoji i dostavnica koju su morali potpisati. Ako u njihovoj evidenciji zaista nije zabilježeno da je predmet okončan zbog smrti optuženoga, do propusta je moralo doći kod njih. Namučio sam se da provedem sve potrebno za obustavu postupka, pa ne bih želio da se na kraju moje ime veže za eventualne propuste, kazao je odvjetnik Primorac.
Borivoje Brkić, pilot JNA, optužen je 1992. godine da je nekoliko mjeseci ranije, u rujnu 1991., podmetnuo bombu na vrata svog stana u Splitu, od čega je poginula jedna osoba, a druga je ranjena. Poginuo je nekoliko dana kasnije u helikopteru iznad Knina tijekom vojne operacije.
Tek 2007. godine, dakle 15 godina nakon tih zbivanja, na Županijskom sudu u Splitu zakazano je prvo ročište po optužnici koja je podignuta kada je optuženi već bio mrtav. Spis se 15 godina “gubio” po sudu, prvo po Vojnom sudu, a kada je on ukinut, po Županijskom sudu.
Na kraju, kada je započelo suđenje, dokazano je da je optuženi Brkić mrtav i obustavljen je postupak. ŽDO do prošlog tjedna nije imao evidentiran taj podatak. Gdje se izgubilo rješenje o obustavi tijekom dostave sa suda u ŽDO, nije jasno. Obje institucije su u istoj zgradi, dijeli ih tek jedan kat.
