Visoki kazneni sud odbio je žalbu osuđenog preprodavača droge koji je tražio obnovu kaznenog postupka temeljem presude Europskog suda za ljudska prava, jer je zahtjev za novo suđenje podnio nakon propisanog roka.

Riječ je o kaznenom postupku u kojem je riječki Županijski sud 2010. zbog zlouporabe droge proglasio krivim osuđenika kojemu je Vrhovni sud potom postrožio kaznu na pet i pol godina zatvora.

Osuđenik je zatim podnio zahtjev Europskom sudu za ljudska prava u Strasbourgu nakon što je iscrpio sva pravna sredstva prema hrvatskom pravu.

Presudom od 18. ožujka 2021. ESLJP je utvrdio da je došlo do povrede prava na pošteno suđenje zajamčenog Konvencijom za zaštitu ljudskih prava i temeljnih sloboda jer osuđenik nije bio na sjednici drugostupanjskog vijeća Vrhovnog suda.

Visoki kazneni sud smatra da je pravilno prvostupanjski utvrdio da zahtjev osuđenika za obnovu kaznenog postupka, na temelju konačne presude ESLJP, nije podnesen u roku od 30 dana od datuma konačnosti te presude.

"Taj rok je prekluzivne naravi, znači da propuštanje roka dovodi do gubitka prava. Osuđenik je zahtjev podnio četiri mjeseca nakon konačnosti presude ESLJP-a pa je pravilno takav zahtjev odbačen", priopćio je sud.

Visoki kazneni sud odbio je žalbu osuđenog preprodavača droge koji je tražio obnovu kaznenog postupka temeljem presude Europskog suda za ljudska prava, jer je zahtjev za novo suđenje podnio nakon propisanog roka.

Riječ je o kaznenom postupku u kojem je riječki Županijski sud 2010. zbog zlouporabe droge proglasio krivim osuđenika kojemu je Vrhovni sud potom postrožio kaznu na pet i pol godina zatvora.

Osuđenik je zatim podnio zahtjev Europskom sudu za ljudska prava u Strasbourgu nakon što je iscrpio sva pravna sredstva prema hrvatskom pravu.

Presudom od 18. ožujka 2021. ESLJP je utvrdio da je došlo do povrede prava na pošteno suđenje zajamčenog Konvencijom za zaštitu ljudskih prava i temeljnih sloboda jer osuđenik nije bio na sjednici drugostupanjskog vijeća Vrhovnog suda.

Visoki kazneni sud smatra da je pravilno prvostupanjski utvrdio da zahtjev osuđenika za obnovu kaznenog postupka, na temelju konačne presude ESLJP, nije podnesen u roku od 30 dana od datuma konačnosti te presude.

"Taj rok je prekluzivne naravi, znači da propuštanje roka dovodi do gubitka prava. Osuđenik je zahtjev podnio četiri mjeseca nakon konačnosti presude ESLJP-a pa je pravilno takav zahtjev odbačen", priopćio je sud.

Visoki kazneni sud odbio žalbu osuđenog dilera jer je zahtjev podnio nakon isteka roka, slučaj je zaključio Europski sud za ljudska prava

Visoki kazneni sud odbio je žalbu osuđenog preprodavača droge koji je tražio obnovu kaznenog postupka temeljem presude Europskog suda za ljudska prava, jer je zahtjev za novo suđenje podnio nakon propisanog roka.

Riječ je o kaznenom postupku u kojem je riječki Županijski sud 2010. zbog zlouporabe droge proglasio krivim osuđenika kojemu je Vrhovni sud potom postrožio kaznu na pet i pol godina zatvora.

Osuđenik je zatim podnio zahtjev Europskom sudu za ljudska prava u Strasbourgu nakon što je iscrpio sva pravna sredstva prema hrvatskom pravu.

Presudom od 18. ožujka 2021. ESLJP je utvrdio da je došlo do povrede prava na pošteno suđenje zajamčenog Konvencijom za zaštitu ljudskih prava i temeljnih sloboda jer osuđenik nije bio na sjednici drugostupanjskog vijeća Vrhovnog suda....
