Neki hrvatski vozači, naviknuti na sustav cestarina u Republici Hrvatskoj, kada odu u inozemstvu, ne uspiju se brzo i kvalitetno 'prešaltati' na sustav koji vrijedi u Europskoj uniji. Točnije, ne kupe vinjetu na vrijeme, stave je na krivo mjesto ili kupe onu koja ne pokriva njihovo kretanje.

U tom slučaju često slijedi kazna, koja zna doći na kućnu adresu, kada se hrvatski putnik već vratio s europskih autocesta, kojima pripadamo, ali još uvijek nismo rabopravno ušli u schengenski prostor. I tada se javlja hrvatsko pitanje: trebam li uopće platiti kaznu iz druge države, mogu li uložiti prigovor kojim ću dokazati da sam u pravu, mogu li kaznu ikako razvući ili je zamijenti društveno korisnim radom, pa i zatvorom. Hrvatski vozači često ne znaju kako se postaviti prema kazni pristigloj iz inizemstva.

Republika Hrvatska još uvijek nije dio Schengena, ali kad je riječ o kaznama za prometne prekršaje počinjene u inozemstvu u Europskoj uniji, tu zastoja ni problema nema. Zakon o pravosudnoj suradnji u kaznenim stvarima s državama članicama EU-a postoji i revno se primjenjuje. Većina vozača s pojmom vinjete susrela se prvi put baš u Republici Sloveniji. Cestarinu treba platiti, tko ne plati, a uhvate ga, bit će kažnjen. Kazna zbog neplaćanja cestarine, odnosno neimanja vinjete je novčana. Dobro je znati da će sud odbiti priznanje i izvršenje odluke o novčanoj kazni ako ona ne premašuje vrijednost od 70 eura prema tečaju na dan donošenja odluke o novčanoj kazni, piše Tatjana Potkonjak za HAK reviju.

Prema Presudi Općinskog prekršajnog suda u Zagrebu od 26. prosinca 2019. proizlazi kako je priznata pravomoćna sudska odluka Republike Slovenije kojom je u pogledu vozača vozila, na odmorištu, utvrđeno da je na cesti s obaveznim plaćanjem cestarine vozio bez valjane vinjete te mu je izrečena novčana kazna u iznosu od tisuću eura.

Presuda će se izvršiti u Republici Hrvatskoj i to tako da se utvrđuje kako je osuđenik dužan platiti novčanu kaznu u kunskoj protuvrijednosti s tim da će se njeno izvršenje prisilno naplatiti u korist proračuna RH odmah po pravomoćnosti presude. Republika Slovenija dostavila je Republici Hrvatskoj zahtjev za priznanje i izvršenje odluke DARS-a zbog prekršaja iz Zakona o naplati cestarine, a kako Slovenija nije označila da dopušta zamjenu novčane kazne radom za opće dobro na slobodi, odnosno kaznom zatvora, nije moguće primijeniti te odredbe na predmetnu odluku. Usporedi li se iznos koji je potrebno platiti za cestarinu i onaj koji inozemni propisi predviđaju kao kaznu za izbjegavanje plaćanja, računica je jasna. Višestruko! Ne isplati se!", piše Tatjana Potkonjak u HAK reviji.

Zaista, ne treba biti veliki matematičar da se izračunaju omjeri cijene vinjete i kazne pa se dobro prije putovanja informirati o sustavu vinjeta i reagirati na vrijeme. Prethodna pamet uvijek je bolja od naknadne.

Neki hrvatski vozači, naviknuti na sustav cestarina u Republici Hrvatskoj, kada odu u inozemstvu, ne uspiju se brzo i kvalitetno 'prešaltati' na sustav koji vrijedi u Europskoj uniji. Točnije, ne kupe vinjetu na vrijeme, stave je na krivo mjesto ili kupe onu koja ne pokriva njihovo kretanje.

U tom slučaju često slijedi kazna, koja zna doći na kućnu adresu, kada se hrvatski putnik već vratio s europskih autocesta, kojima pripadamo, ali još uvijek nismo rabopravno ušli u schengenski prostor. I tada se javlja hrvatsko pitanje: trebam li uopće platiti kaznu iz druge države, mogu li uložiti prigovor kojim ću dokazati da sam u pravu, mogu li kaznu ikako razvući ili je zamijenti društveno korisnim radom, pa i zatvorom. Hrvatski vozači često ne znaju kako se postaviti prema kazni pristigloj iz inizemstva.

Republika Hrvatska još uvijek nije dio Schengena, ali kad je riječ o kaznama za prometne prekršaje počinjene u inozemstvu u Europskoj uniji, tu zastoja ni problema nema. Zakon o pravosudnoj suradnji u kaznenim stvarima s državama članicama EU-a postoji i revno se primjenjuje. Većina vozača s pojmom vinjete susrela se prvi put baš u Republici Sloveniji. Cestarinu treba platiti, tko ne plati, a uhvate ga, bit će kažnjen. Kazna zbog neplaćanja cestarine, odnosno neimanja vinjete je novčana. Dobro je znati da će sud odbiti priznanje i izvršenje odluke o novčanoj kazni ako ona ne premašuje vrijednost od 70 eura prema tečaju na dan donošenja odluke o novčanoj kazni, piše Tatjana Potkonjak za HAK reviju.

Prema Presudi Općinskog prekršajnog suda u Zagrebu od 26. prosinca 2019. proizlazi kako je priznata pravomoćna sudska odluka Republike Slovenije kojom je u pogledu vozača vozila, na odmorištu, utvrđeno da je na cesti s obaveznim plaćanjem cestarine vozio bez valjane vinjete te mu je izrečena novčana kazna u iznosu od tisuću eura.

Presuda će se izvršiti u Republici Hrvatskoj i to tako da se utvrđuje kako je osuđenik dužan platiti novčanu kaznu u kunskoj protuvrijednosti s tim da će se njeno izvršenje prisilno naplatiti u korist proračuna RH odmah po pravomoćnosti presude. Republika Slovenija dostavila je Republici Hrvatskoj zahtjev za priznanje i izvršenje odluke DARS-a zbog prekršaja iz Zakona o naplati cestarine, a kako Slovenija nije označila da dopušta zamjenu novčane kazne radom za opće dobro na slobodi, odnosno kaznom zatvora, nije moguće primijeniti te odredbe na predmetnu odluku. Usporedi li se iznos koji je potrebno platiti za cestarinu i onaj koji inozemni propisi predviđaju kao kaznu za izbjegavanje plaćanja, računica je jasna. Višestruko! Ne isplati se!", piše Tatjana Potkonjak u HAK reviji.

Zaista, ne treba biti veliki matematičar da se izračunaju omjeri cijene vinjete i kazne pa se dobro prije putovanja informirati o sustavu vinjeta i reagirati na vrijeme. Prethodna pamet uvijek je bolja od naknadne.
