Da hrvatski suci spadaju u imućne ljude, od početka nitko nije sumnjao. No, kako su se oni sami dugo opirali javnoj objavi svoje imovine, potvrdu te široko uvriježene teze javnost je dobila tek nedavno. Kada su njihove imovinske kartice – kao i imovinske kartice državnih odvjetnika – postale javno dostupne na internetu.
Ono što se, međutim, nije znalo jest da je prilično veliki broj sudaca dio svoje imovine stekao tako što ju im je netko – njima ili njihovim bračnim partnerima – darovao. Tako je, primjerice, predsjednik Općinskog suda u Zadru Mario Pešić u svojoj imovinskoj kartici prijavio 13 nekretnina. Od kojih je tri stekao darivanjem, a ostalih 10 nasljedstvom. Predsjednica Županijskog suda u Dubrovniku Josita Begović zajedno sa suprugom posjeduje ukupno 16 nekretnina. Od čega je šest u potpunosti, a dvije djelomično stečeno darivanjem.
Predsjednica splitskog Općinskog suda, pak, od nekretnina ima tek garažu koju je stekla kupoprodajom. Njezin suprug ima, pak, devet nekretnina. Od čega je sedam stekao darivanjem.
Kontrola prijava
To, dakako, ne znači da je riječ o nečem sumnjivom, budući da su darovnice čest oblik mijenjanja vlasništva unutar članova obitelji. No, slučaj sisačko-moslovačkog župana Ive Žinića, koji je svoju kuću u imovinskoj kartici zaveo kao darovanu, a na koncu se ispostavilo da je riječ o darovnici države na koju on zapravo i nema pravo, otvorilo je i pitanje kontrole onoga što državni dužnosnici, pa i suci, u svojim imovinskim karticama prijave.
Upravo na to upozorava saborska zastupnica stranke Centar i bivša predsjednica Povjerenstva za sukob interesa Dalija Orešković. Ona pozdravlja konačnu objavu imovinskih kartica hrvatskih sudaca i državnih odvjetnika. Ali napominje da je to tek prvi, mali korak u provođenju antikorupcijskih mjera.
– Nažalost, ne postoji prava provjera načina stjecanja imovine i koruptivnih rizika. Velike afere u Hrvatskoj i dalje otkrivaju mediji, provjera imovinskih kartica koje suci podnose Državnom sudbenom vijeću, a državni odvjetnici Državnoodvjetničkom vijeću, samo je puka formalnost – upozorava Dalija Orešković.
Za razliku od zastupnika, čija imovinska kartica zahtijeva nešto detaljnije podatke, iz imovinskih kartica sudaca u nekim se slučajevima ne može puno doznati o imovinskom stanju njihovih bračnih partnera. Nisu, primjerice, precizirani ni podaci o bankama u kojima je sudac podignuo kredit, a nije navedeno ni tko im je te nekretnine darovao.
Obrazac sudačke imovinske kartice te informacije naprosto ni ne traži.
Vrag je u detaljima
Suci godinama nisu željeli pristati na objavu svojih imovinskih kartica, argumentirajući da će se tako urušiti neovisnost pravosuđa. Te da će se oni naći izloženi napadima nezadovoljnih stranaka. Na objavu su na koncu morali pristati, ali ne na onu koja bi otkrila sve.
– Vrag se uvijek krije u detaljima. Imovinska kartica je uglavnom formalne naravi. S tim da je Povjerenstvo za odlučivanje o sukobu interesa u slučaju državnih i lokalnih dužnosnika profesionalizirano tijelo, dok imovinske kartice suci podnose DSV-u i DOV-u, tijelima koja oba imaju po 11 članova, koji taj posao ne obavljaju profesionalno, a u svakom sjede i po dva saborska zastupnika – ističe Dalija Orešković.
Ako hoćemo suvisli sustav, to je prvo što trebamo mijenjati, smatra Orešković. Kontrola imovine trebala bi, slaže se ona, biti posao dobro ustrojene i efikasne porezne uprave.
No kada toga nema, onda neovisna tijela mogu odigrati važnu ulogu u prevenciji korupcije.
– Naš je prvi problem nesposobnost i neznanje, onda i nedostatak političke volje. Predubuka je voda i predubok mulj. Ta tijela mogu biti učinkovita ako se slučajevi poput Žinića događaju kao anomalije. A Žinić, nažalost, nije anomalija – zaključuje Orešković.

Da hrvatski suci spadaju u imućne ljude, od početka nitko nije sumnjao. No, kako su se oni sami dugo opirali javnoj objavi svoje imovine, potvrdu te široko uvriježene teze javnost je dobila tek nedavno. Kada su njihove imovinske kartice – kao i imovinske kartice državnih odvjetnika – postale javno dostupne na internetu.
Ono što se, međutim, nije znalo jest da je prilično veliki broj sudaca dio svoje imovine stekao tako što ju im je netko – njima ili njihovim bračnim partnerima – darovao. Tako je, primjerice, predsjednik Općinskog suda u Zadru Mario Pešić u svojoj imovinskoj kartici prijavio 13 nekretnina. Od kojih je tri stekao darivanjem, a ostalih 10 nasljedstvom. Predsjednica Županijskog suda u Dubrovniku Josita Begović zajedno sa suprugom posjeduje ukupno 16 nekretnina. Od čega je šest u potpunosti, a dvije djelomično stečeno darivanjem.
Predsjednica splitskog Općinskog suda, pak, od nekretnina ima tek garažu koju je stekla kupoprodajom. Njezin suprug ima, pak, devet nekretnina. Od čega je sedam stekao darivanjem.
Kontrola prijava
To, dakako, ne znači da je riječ o nečem sumnjivom, budući da su darovnice čest oblik mijenjanja vlasništva unutar članova obitelji. No, slučaj sisačko-moslovačkog župana Ive Žinića, koji je svoju kuću u imovinskoj kartici zaveo kao darovanu, a na koncu se ispostavilo da je riječ o darovnici države na koju on zapravo i nema pravo, otvorilo je i pitanje kontrole onoga što državni dužnosnici, pa i suci, u svojim imovinskim karticama prijave.
Upravo na to upozorava saborska zastupnica stranke Centar i bivša predsjednica Povjerenstva za sukob interesa Dalija Orešković. Ona pozdravlja konačnu objavu imovinskih kartica hrvatskih sudaca i državnih odvjetnika. Ali napominje da je to tek prvi, mali korak u provođenju antikorupcijskih mjera.
– Nažalost, ne postoji prava provjera načina stjecanja imovine i koruptivnih rizika. Velike afere u Hrvatskoj i dalje otkrivaju mediji, provjera imovinskih kartica koje suci podnose Državnom sudbenom vijeću, a državni odvjetnici Državnoodvjetničkom vijeću, samo je puka formalnost – upozorava Dalija Orešković.
Za razliku od zastupnika, čija imovinska kartica zahtijeva nešto detaljnije podatke, iz imovinskih kartica sudaca u nekim se slučajevima ne može puno doznati o imovinskom stanju njihovih bračnih partnera. Nisu, primjerice, precizirani ni podaci o bankama u kojima je sudac podignuo kredit, a nije navedeno ni tko im je te nekretnine darovao.
Obrazac sudačke imovinske kartice te informacije naprosto ni ne traži.
Vrag je u detaljima
Suci godinama nisu željeli pristati na objavu svojih imovinskih kartica, argumentirajući da će se tako urušiti neovisnost pravosuđa. Te da će se oni naći izloženi napadima nezadovoljnih stranaka. Na objavu su na koncu morali pristati, ali ne na onu koja bi otkrila sve.
– Vrag se uvijek krije u detaljima. Imovinska kartica je uglavnom formalne naravi. S tim da je Povjerenstvo za odlučivanje o sukobu interesa u slučaju državnih i lokalnih dužnosnika profesionalizirano tijelo, dok imovinske kartice suci podnose DSV-u i DOV-u, tijelima koja oba imaju po 11 članova, koji taj posao ne obavljaju profesionalno, a u svakom sjede i po dva saborska zastupnika – ističe Dalija Orešković.
Ako hoćemo suvisli sustav, to je prvo što trebamo mijenjati, smatra Orešković. Kontrola imovine trebala bi, slaže se ona, biti posao dobro ustrojene i efikasne porezne uprave.
No kada toga nema, onda neovisna tijela mogu odigrati važnu ulogu u prevenciji korupcije.
– Naš je prvi problem nesposobnost i neznanje, onda i nedostatak političke volje. Predubuka je voda i predubok mulj. Ta tijela mogu biti učinkovita ako se slučajevi poput Žinića događaju kao anomalije. A Žinić, nažalost, nije anomalija – zaključuje Orešković.
