Žene su sigurne u Europi. Jesu li? U Francuskoj su tijekom 2022. godine više od 100 žena ubili njihovi partneri ili bivši partneri.

U Španjolskoj je samo u prosincu nasilno ubijeno devet žena. Statistika organizacije “Women’s Aid” u Irskoj pokazuje da je 2022. godina bila najgora godina u desetljeću po femicidu, s 11 žena ubijenih u nasilnim okolnostima u proteklih 12 mjeseci.

Čak i jedna žena kao žrtva je previše. Europa to ne može tolerirati.

U svakoj državi članici EU-a javnost zahtijeva djelovanje, a vlade kontinuirano nastavljaju reagirati. Na primjer, 2021. godine, Grčka je uvela novi zakon o “nasilju i uznemiravanju” na radnom mjestu, u skladu s Konvencijom Međunarodne organizacije rada o nasilju i uznemiravanju. Također je prilagodila svoj kazneni zakon u skladu s navedenim, što se tiče silovanja, seksualnog uznemiravanja i maloljetnika.

No dok su odgovori pojedinih zemalja EU-a i na nasilje i na posljedice nasilja hvalevrijedni - Francuska isprobava novi program potpore kako bi pomogla žrtvama da potraže sigurnost i ponovno izgrade svoje živote, a Irska razmatra opsežne reforme sudova za obiteljsko pravo - glavni problem ostaje: nasilje nad ženama ne poštuje granice država članica tako da, zapravo, sigurnost žene ovisi o tome gdje živi.

Za silovanje, na primjer, iako je u osam zemalja EU-a slobodan i iskren pristanak promijenio definiciju silovanja, većina zemalja EU-a i dalje zahtijeva dokaze o nasilju kako bi podigla optužnicu za silovanje. Ukratko, i nevjerojatno, u ovom trenutku silovanje u jednoj europskoj zemlji ne predstavlja silovanje u drugoj.

Izrada zakona

Želimo ispraviti ovu sramotnu anomaliju. Dok će o nacionalnim zakonima i dalje odlučivati nacionalni parlamenti, s nasiljem nad ženama tvrdimo da je vrijeme da EU postavi zajednički minimalni standard, kao što smo učinili u slučaju terorizma.

Zbog toga trenutno radimo na prvom zakonu EU-a ikad, o “borbi protiv nasilja nad ženama”, dugom nazivu za jednostavan i zakašnjeli prijedlog. Nasilje je nasilje, a nasilje nad ženama u jednoj europskoj zemlji treba tretirati kao nasilje nad ženama i kažnjavati na isti način u svim europskim zemljama.

Na temelju opsežnih konzultacija, Direktiva će se sastojati od pet ključnih elemenata: postavljanje jednakih minimalnih standarda za zločine; sigurni postupci prijava i procjene rizika; poštivanje privatnosti žrtava u sudskim postupcima i pravo na naknadu štete; podrška žrtvama putem linija za pomoć i kriznih centara; te bolju koordinaciju i suradnju između država članica u vezi s prekograničnim kriminalom.

Zajednički standardi izricanja kazni također bi pokazali predanost država članica EU-a okončanju onoga što je u biti geografska lutrija sa životima žena kao žetonima za kockanje.

Međunarodni dan žena obilježavamo 8. ožujka.

Ali čak i dok se radujemo postignućima žena diljem svijeta, zavjetujmo se: kada je u pitanju sigurnost žena, nema više geografske lutrije. Dogovorimo se o definicijama nasilja nad ženama koje pokrivaju cijelu Europsku uniju. Pobrinimo se da više ne budu žene te koje se ne osjećaju sigurno, već oni koji vrše nasilje nad ženama.

Ako učinimo ove stvari, onda možemo odgovoriti s povjerenjem - da, žene su sigurne u Europi. Onda ćemo stvarno imati što slaviti, stoji u objavi koju zajedno potpisuju Frances Fitzgerald i Željana Zovko, irska i hrvatska zastupnica u Europskom parlamentu.

U Španjolskoj je samo u prosincu nasilno ubijeno devet žena. Statistika organizacije “Women’s Aid” u Irskoj pokazuje da je 2022. godina bila najgora godina u desetljeću po femicidu, s 11 žena ubijenih u nasilnim okolnostima u proteklih 12 mjeseci.

Čak i jedna žena kao žrtva je previše. Europa to ne može tolerirati.

U svakoj državi članici EU-a javnost zahtijeva djelovanje, a vlade kontinuirano nastavljaju reagirati. Na primjer, 2021. godine, Grčka je uvela novi zakon o “nasilju i uznemiravanju” na radnom mjestu, u skladu s Konvencijom Međunarodne organizacije rada o nasilju i uznemiravanju. Također je prilagodila svoj kazneni zakon u skladu s navedenim, što se tiče silovanja, seksualnog uznemiravanja i maloljetnika.

No dok su odgovori pojedinih zemalja EU-a i na nasilje i na posljedice nasilja hvalevrijedni - Francuska isprobava novi program potpore kako bi pomogla žrtvama da potraže sigurnost i ponovno izgrade svoje živote, a Irska razmatra opsežne reforme sudova za obiteljsko pravo - glavni problem ostaje: nasilje nad ženama ne poštuje granice država članica tako da, zapravo, sigurnost žene ovisi o tome gdje živi.

Za silovanje, na primjer, iako je u osam zemalja EU-a slobodan i iskren pristanak promijenio definiciju silovanja, većina zemalja EU-a i dalje zahtijeva dokaze o nasilju kako bi podigla optužnicu za silovanje. Ukratko, i nevjerojatno, u ovom trenutku silovanje u jednoj europskoj zemlji ne predstavlja silovanje u drugoj.

Izrada zakona

Želimo ispraviti ovu sramotnu anomaliju. Dok će o nacionalnim zakonima i dalje odlučivati nacionalni parlamenti, s nasiljem nad ženama tvrdimo da je vrijeme da EU postavi zajednički minimalni standard, kao što smo učinili u slučaju terorizma.

Zbog toga trenutno radimo na prvom zakonu EU-a ikad, o “borbi protiv nasilja nad ženama”, dugom nazivu za jednostavan i zakašnjeli prijedlog. Nasilje je nasilje, a nasilje nad ženama u jednoj europskoj zemlji treba tretirati kao nasilje nad ženama i kažnjavati na isti način u svim europskim zemljama.

Na temelju opsežnih konzultacija, Direktiva će se sastojati od pet ključnih elemenata: postavljanje jednakih minimalnih standarda za zločine; sigurni postupci prijava i procjene rizika; poštivanje privatnosti žrtava u sudskim postupcima i pravo na naknadu štete; podrška žrtvama putem linija za pomoć i kriznih centara; te bolju koordinaciju i suradnju između država članica u vezi s prekograničnim kriminalom.

Zajednički standardi izricanja kazni također bi pokazali predanost država članica EU-a okončanju onoga što je u biti geografska lutrija sa životima žena kao žetonima za kockanje.

Međunarodni dan žena obilježavamo 8. ožujka.

Ali čak i dok se radujemo postignućima žena diljem svijeta, zavjetujmo se: kada je u pitanju sigurnost žena, nema više geografske lutrije. Dogovorimo se o definicijama nasilja nad ženama koje pokrivaju cijelu Europsku uniju. Pobrinimo se da više ne budu žene te koje se ne osjećaju sigurno, već oni koji vrše nasilje nad ženama.

Ako učinimo ove stvari, onda možemo odgovoriti s povjerenjem - da, žene su sigurne u Europi. Onda ćemo stvarno imati što slaviti, stoji u objavi koju zajedno potpisuju Frances Fitzgerald i Željana Zovko, irska i hrvatska zastupnica u Europskom parlamentu.
