Unatoč našem nezadovoljstvu pojedinim sucima zbog njihova površna odlučivanja u konvertiranim kreditima, sve je više sudaca i sudova koji potvrđuju naša shvaćanja o konverzijama, poručuju iz udruge Franak navodeći kako je Županijski sud u Zagrebu ukinuo 21. listopada 2020. rješenjem Gž-2123/2020 negativnu presudu za konvertirani kredit, koju je 24. kolovoza 2020. donio sudac Damir Čižmek s Općinskog suda u Zlataru, te je vratio predmet na ponovno odlučivanje.

Rješenje je donijelo vijeće Županijskog suda u Zagrebu u sastavu Darija Horvat, Josip Grubišić i Lidija Bošnjaković. Zastupnica tužitelja koja je izvojevala to rješenje jest zagrebačka odvjetnica Ivana Šuti.

Pojašnjavaju kako je najprije 24. kolovoza 2020. sudac iz Zlatara Damir Čižmek odbio tužbu za konvertirani kredit, s tvrdnjom da je konverzijom sve riješeno, i da potrošač nema pravo na punu restituciju. Vrlo brzo nakon toga, već 21. listopada navedeno sudačko vijeće iz Zagreba ukinulo je na temelju žalbe tu negativnu presudu, i vratilo je predmet na ponovno suđenje sa sljedećim obrazloženjima:

1. Žalba je osnovana.

2. Zaključak suda prvoga stupnja da bi konverzijom potrošač izgubio svoja prava na deklaratorne i kondemnatorne tužbene zahtjeve, nije osnovan.

3. Neosnovano sud prvoga stupnja odbija tužbu s pogrešnim zaključkom bi se konverzija provela upravo zbog toga da tužitelj ne bi više imao pravo na potraživanja iz osnovnog ugovora.

4. Uslijed neosnovanosti tvrdnji iz prvostupanjske presude, ista je ukinuta i postupak se mora ponoviti.

- Nakon takve odluke Županijskog suda u Zagrebu, očekujemo da sudac Čižmek prekine postupak do odluke Suda EU po svim takvim predmetima koje vodi, ali očekujemo da to učine i svi drugi suci slični njemu koji su uvjereni kako je konverzijom potrošač izgubio pravo na punu restituciju - ističu u udruzi Franak.

Također naglašavaju kako moraju ponoviti da je Sud EU svojom presudom C-118/17 izrekao dvije temeljne tvrdnje:

Ugovori s ništetnom valutnom klauzulom ništetni su, osim ako bi to bilo na štetu potrošača.

Unatoč zakonskoj intervenciji, nacionalni sud mora provjeriti je li tom intervencijom izvršena puna restitucija.

- Drugim riječima, bez obzira na konverziju uslijed ništetnosti valutne klauzule CHF (predmeta ugovora) iz temeljnog ugovora, ali i uslijed ništetnosti kamatne stope (cijene kredita), temeljni ugovori trebali bi biti suđeni ništetnima, a ukoliko je ništetan temeljni ugovor, ništetni su i svi pravni poslovi koji se na tome ugovoru temelje, pa je tako ništetna i konverzija kredita - napominju.

- U najmanju ruku, ako i ne bi bio ništetan ugovor, nacionalni sud mora provjeriti je li izvršena puna restitucija, a to nije moguće učiniti drugačije nego financijskim vještačenjem. Pritom moraju biti izjednačeni potrošači s CHF kreditima koji su konvertirali kredit s onim potrošačima koji nisu konvertirali CHF kredit u svim njihovim pravima, i konačno te dvije varijante potrošača moraju biti u potpunosti izjednačene u davanjima prema banci na kraju otplate kredita - kažu nadalje u udruzi Franak.

- Sudac Čižmek iz Zlatara pao je na ispitu kod viših sudaca, pa se nadamo da će se isto to dogoditi i notornome nižestupanjskom sucu Radoloviću s pazinskoga suda, koji je krivac za ogledni postupak kojim smo svi unazađeni za dvije godine sudske bitke. Vraćeni smo oglednim postupkom na početak, nakon što je sve već postalo jasno većini sudaca. Zbog toga moramo čekati na odluku Suda EU o našim pravima, koju ne očekujemo prije kraja 2021. godine - zaključuju u objavi za medije iz udruge Franak.

Unatoč našem nezadovoljstvu pojedinim sucima zbog njihova površna odlučivanja u konvertiranim kreditima, sve je više sudaca i sudova koji potvrđuju naša shvaćanja o konverzijama, poručuju iz udruge Franak navodeći kako je Županijski sud u Zagrebu ukinuo 21. listopada 2020. rješenjem Gž-2123/2020 negativnu presudu za konvertirani kredit, koju je 24. kolovoza 2020. donio sudac Damir Čižmek s Općinskog suda u Zlataru, te je vratio predmet na ponovno odlučivanje.

Rješenje je donijelo vijeće Županijskog suda u Zagrebu u sastavu Darija Horvat, Josip Grubišić i Lidija Bošnjaković. Zastupnica tužitelja koja je izvojevala to rješenje jest zagrebačka odvjetnica Ivana Šuti.

Pojašnjavaju kako je najprije 24. kolovoza 2020. sudac iz Zlatara Damir Čižmek odbio tužbu za konvertirani kredit, s tvrdnjom da je konverzijom sve riješeno, i da potrošač nema pravo na punu restituciju. Vrlo brzo nakon toga, već 21. listopada navedeno sudačko vijeće iz Zagreba ukinulo je na temelju žalbe tu negativnu presudu, i vratilo je predmet na ponovno suđenje sa sljedećim obrazloženjima:

1. Žalba je osnovana.

2. Zaključak suda prvoga stupnja da bi konverzijom potrošač izgubio svoja prava na deklaratorne i kondemnatorne tužbene zahtjeve, nije osnovan.

3. Neosnovano sud prvoga stupnja odbija tužbu s pogrešnim zaključkom bi se konverzija provela upravo zbog toga da tužitelj ne bi više imao pravo na potraživanja iz osnovnog ugovora.

4. Uslijed neosnovanosti tvrdnji iz prvostupanjske presude, ista je ukinuta i postupak se mora ponoviti.

- Nakon takve odluke Županijskog suda u Zagrebu, očekujemo da sudac Čižmek prekine postupak do odluke Suda EU po svim takvim predmetima koje vodi, ali očekujemo da to učine i svi drugi suci slični njemu koji su uvjereni kako je konverzijom potrošač izgubio pravo na punu restituciju - ističu u udruzi Franak.

Također naglašavaju kako moraju ponoviti da je Sud EU svojom presudom C-118/17 izrekao dvije temeljne tvrdnje:

Ugovori s ništetnom valutnom klauzulom ništetni su, osim ako bi to bilo na štetu potrošača.

Unatoč zakonskoj intervenciji, nacionalni sud mora provjeriti je li tom intervencijom izvršena puna restitucija.

- Drugim riječima, bez obzira na konverziju uslijed ništetnosti valutne klauzule CHF (predmeta ugovora) iz temeljnog ugovora, ali i uslijed ništetnosti kamatne stope (cijene kredita), temeljni ugovori trebali bi biti suđeni ništetnima, a ukoliko je ništetan temeljni ugovor, ništetni su i svi pravni poslovi koji se na tome ugovoru temelje, pa je tako ništetna i konverzija kredita - napominju.

- U najmanju ruku, ako i ne bi bio ništetan ugovor, nacionalni sud mora provjeriti je li izvršena puna restitucija, a to nije moguće učiniti drugačije nego financijskim vještačenjem. Pritom moraju biti izjednačeni potrošači s CHF kreditima koji su konvertirali kredit s onim potrošačima koji nisu konvertirali CHF kredit u svim njihovim pravima, i konačno te dvije varijante potrošača moraju biti u potpunosti izjednačene u davanjima prema banci na kraju otplate kredita - kažu nadalje u udruzi Franak.

- Sudac Čižmek iz Zlatara pao je na ispitu kod viših sudaca, pa se nadamo da će se isto to dogoditi i notornome nižestupanjskom sucu Radoloviću s pazinskoga suda, koji je krivac za ogledni postupak kojim smo svi unazađeni za dvije godine sudske bitke. Vraćeni smo oglednim postupkom na početak, nakon što je sve već postalo jasno većini sudaca. Zbog toga moramo čekati na odluku Suda EU o našim pravima, koju ne očekujemo prije kraja 2021. godine - zaključuju u objavi za medije iz udruge Franak.

Udruga Franak: Županijski sud u Zagrebu ukida negativne presude za konvertirane kredite, sudac sa Suda u Zlataru pao je na ispitu

Unatoč našem nezadovoljstvu pojedinim sucima zbog njihova površna odlučivanja u konvertiranim kreditima, sve je više sudaca i sudova koji potvrđuju naša shvaćanja o konverzijama, poručuju iz udruge Franak navodeći kako je Županijski sud u Zagrebu ukinuo 21. listopada 2020. rješenjem Gž-2123/2020 negativnu presudu za konvertirani kredit, koju je 24. kolovoza 2020. donio sudac Damir Čižmek s Općinskog suda u Zlataru, te je vratio predmet na ponovno odlučivanje.

Rješenje je donijelo vijeće Županijskog suda u Zagrebu u sastavu Darija Horvat, Josip Grubišić i Lidija Bošnjaković. Zastupnica tužitelja koja je izvojevala to rješenje jest zagrebačka odvjetnica Ivana Šuti.
