"U Narodnim novinama broj 107/22 objavljena je nova odluka Vlade RH o ovlaštenim pravnim osobama i tijelima za pokretanje kolektivnih sudskih postupaka iz područja zaštite potrošača. Nakon višegodišnjeg institucionalnog nastojanja da i Franak uđe među ovlaštenike, nakon što je našu delegaciju po tom pitanju primio prošle godine u rujnu i bivši ministar Ćorić s obećanjem da ćemo biti razmotreni kao kandidati, konačno je po donošenju novoga Zakona o zaštiti potrošača i Franak uvršten među ovlaštene tužitelje", izvijestili su iz Udruge Franak.

Informirajući javnost što to znači, ističu kako ponajprije moraju reći da ta odluka nema utjecaj na već završeni sudski kolektivni postupak u slučaju franak, u kojemu je njihove interese zastupao tada ovlašteni tužitelj udruga Potrošač.

-Taj postupak je završen, i svi potrošači s CHF kreditima ugovorenim u osam osuđenih banaka, kojih ima 125.000, moraju, ako još uvijek nisu, u privatnim sudskim postupcima zatražiti svoj novac od banaka koje su poslovale na nezakonit način. Pritom napominjemo da je krajnji rok za njihove tužbe 13. lipnja 2023. te da se na Vrhovnom sudu još mora odlučiti o dvama važnim pitanjima, a to je pitanje prava na obeštećenje nakon konverzije CHF u EURO te o pravu potrošača na utvrđenje apsolutne ništetnosti cijelih ugovora s valutnom klauzulom CHF. Predsjednik VSRH Radovan Dobronić najavio je da će to biti riješeno do kraja godine, a predsjednik Građanskog odjela Vrhovnog suda RH obećao je da će u tome smislu sačiniti hodogram radnji koje moraju provesti vijeća Vrhovnog suda RH do kraja godine. Vjerujemo da je taj hodogram sačinjen, ali o njemu mi nemamo saznanja jer se radi o internom dokumentu Vrhovnog suda – navode u priopćenju.

Kako nadalje pojašnjavaju, u skladu s Odlukom o određivanju tijela i osoba ovlaštenih za pokretanje postupka za zaštitu kolektivnih interesa i prava potrošača (NN 107/22), od 24. rujna 2022. Franak kao ovlaštenik može učiniti sljedeće:

1. Može kolektivno tužiti sve leasing kuće koje su s potrošačima ugovarale leasing u francima.

2. Može kolektivno tužiti sve leasing kuće koje su s potrošačima ugovarale kamatnu stopu koja se mijenja odlukom leasing kuće.

3. Može kolektivno tužiti sve banke koje su ugovarale CHF kredite s potrošačima, a koji nisu obuhvaćeni kolektivnom presudom u slučaju franak.

4. Može kolektivno tužiti sve banke koje su u kunskim kreditima ugovarale kamatnu stopu koja se mijenja odlukom banke.

5. Može kolektivno tužiti sve banke koje su u euro kreditima ugovarale kamatnu stopu koja se mijenja odlukom banke.

-To je pet temeljnih prijestupa koje su leasing kuće i banke činile protiv interesa i prava potrošača. Mi ćemo u sljedećem periodu istražiti postoje li zainteresirani potrošači koji su oštećeni nezakonitim postupanjima banaka i leasing kuća izvan presuđenog kolektivnog slučaja franak, a znamo da takvih ugovora ima možda i 500.000, te ćemo poduzeti sve potrebne korake kako bismo samostalno podigli potrebne kolektivne tužbe. Nakon istraživanja i planiranja potrebnih radnji, pozvat ćemo potencijalne svjedoke da nam se jave kako bismo tužbe podigli. Prije podizanja kolektivnih tužbi pozvat ćemo potencijalne tuženike da obeštete potrošače, ako ne žele završiti s nama na sudu - poručuju iz Udruge Franak.

Nadalje navode kako će prema Zakonu o zaštiti potrošača tužbenim zahtjevima tražiti sljedeće:

1. da se utvrdi nepoštenost i ništetnost određenih ugovornih odredaba (kamatne stope za kredite i leasing ugovore, leasing CHF, CHF za banke izvan kolektivne presude)

2. da se naredi tuženicima da prekinu s nezakonitim postupanjima

3. da se odrede mjere koje su potrebne za uklanjanje štetnih posljedica zbog primjene nepoštenih ugovornih odredaba, a to znači da se naloži obeštećenje svih potrošača na koje se kolektivna presuda odnosi

4. da se zabrani tuženim bankama i leasing kućama takvo ili slično ponašanje ubuduće.

-U skladu s kolektivnim utvrđenjem svaki potrošač na kojeg se odnosi neka buduća kolektivna presuda imat će pravo na obeštećenje zajedno sa zateznim kamatama od dana kada je odnosni potrošač uplatio tuženiku (banci ili leasing kući) svaki pojedinačni neosnovano naplaćeni iznos iz kredita ili leasinga. Molimo za strpljenje, jer se sve mora pomno istražiti i isplanirati, a zastare potraživanja nema, pa onda nema niti kašnjenja s kolektivnim tužbama! "U Narodnim novinama broj 107/22 objavljena je nova odluka Vlade RH o ovlaštenim pravnim osobama i tijelima za pokretanje kolektivnih sudskih postupaka iz područja zaštite potrošača. Nakon višegodišnjeg institucionalnog nastojanja da i Franak uđe među ovlaštenike, nakon što je našu delegaciju po tom pitanju primio prošle godine u rujnu i bivši ministar Ćorić s obećanjem da ćemo biti razmotreni kao kandidati, konačno je po donošenju novoga Zakona o zaštiti potrošača i Franak uvršten među ovlaštene tužitelje", izvijestili su iz Udruge Franak.

Informirajući javnost što to znači, ističu kako ponajprije moraju reći da ta odluka nema utjecaj na već završeni sudski kolektivni postupak u slučaju franak, u kojemu je njihove interese zastupao tada ovlašteni tužitelj udruga Potrošač.

-Taj postupak je završen, i svi potrošači s CHF kreditima ugovorenim u osam osuđenih banaka, kojih ima 125.000, moraju, ako još uvijek nisu, u privatnim sudskim postupcima zatražiti svoj novac od banaka koje su poslovale na nezakonit način. Pritom napominjemo da je krajnji rok za njihove tužbe 13. lipnja 2023. te da se na Vrhovnom sudu još mora odlučiti o dvama važnim pitanjima, a to je pitanje prava na obeštećenje nakon konverzije CHF u EURO te o pravu potrošača na utvrđenje apsolutne ništetnosti cijelih ugovora s valutnom klauzulom CHF. Predsjednik VSRH Radovan Dobronić najavio je da će to biti riješeno do kraja godine, a predsjednik Građanskog odjela Vrhovnog suda RH obećao je da će u tome smislu sačiniti hodogram radnji koje moraju provesti vijeća Vrhovnog suda RH do kraja godine. Vjerujemo da je taj hodogram sačinjen, ali o njemu mi nemamo saznanja jer se radi o internom dokumentu Vrhovnog suda – navode u priopćenju.

Kako nadalje pojašnjavaju, u skladu s Odlukom o određivanju tijela i osoba ovlaštenih za pokretanje postupka za zaštitu kolektivnih interesa i prava potrošača (NN 107/22), od 24. rujna 2022. Franak kao ovlaštenik može učiniti sljedeće:

1. Može kolektivno tužiti sve leasing kuće koje su s potrošačima ugovarale leasing u francima.

2. Može kolektivno tužiti sve leasing kuće koje su s potrošačima ugovarale kamatnu stopu koja se mijenja odlukom leasing kuće.

3. Može kolektivno tužiti sve banke koje su ugovarale CHF kredite s potrošačima, a koji nisu obuhvaćeni kolektivnom presudom u slučaju franak.

4. Može kolektivno tužiti sve banke koje su u kunskim kreditima ugovarale kamatnu stopu koja se mijenja odlukom banke.

5. Može kolektivno tužiti sve banke koje su u euro kreditima ugovarale kamatnu stopu koja se mijenja odlukom banke.

-To je pet temeljnih prijestupa koje su leasing kuće i banke činile protiv interesa i prava potrošača. Mi ćemo u sljedećem periodu istražiti postoje li zainteresirani potrošači koji su oštećeni nezakonitim postupanjima banaka i leasing kuća izvan presuđenog kolektivnog slučaja franak, a znamo da takvih ugovora ima možda i 500.000, te ćemo poduzeti sve potrebne korake kako bismo samostalno podigli potrebne kolektivne tužbe. Nakon istraživanja i planiranja potrebnih radnji, pozvat ćemo potencijalne svjedoke da nam se jave kako bismo tužbe podigli. Prije podizanja kolektivnih tužbi pozvat ćemo potencijalne tuženike da obeštete potrošače, ako ne žele završiti s nama na sudu - poručuju iz Udruge Franak.

Nadalje navode kako će prema Zakonu o zaštiti potrošača tužbenim zahtjevima tražiti sljedeće:

1. da se utvrdi nepoštenost i ništetnost određenih ugovornih odredaba (kamatne stope za kredite i leasing ugovore, leasing CHF, CHF za banke izvan kolektivne presude)

2. da se naredi tuženicima da prekinu s nezakonitim postupanjima

3. da se odrede mjere koje su potrebne za uklanjanje štetnih posljedica zbog primjene nepoštenih ugovornih odredaba, a to znači da se naloži obeštećenje svih potrošača na koje se kolektivna presuda odnosi

4. da se zabrani tuženim bankama i leasing kućama takvo ili slično ponašanje ubuduće.

-U skladu s kolektivnim utvrđenjem svaki potrošač na kojeg se odnosi neka buduća kolektivna presuda imat će pravo na obeštećenje zajedno sa zateznim kamatama od dana kada je odnosni potrošač uplatio tuženiku (banci ili leasing kući) svaki pojedinačni neosnovano naplaćeni iznos iz kredita ili leasinga. Molimo za strpljenje, jer se sve mora pomno istražiti i isplanirati, a zastare potraživanja nema, pa onda nema niti kašnjenja s kolektivnim tužbama! Mi krećemo s pripremama odmah! - poručuju iz Udruge Franak.
