Hrvatski stručnjaci zagovaraju promjenu modela regulacije prostitucije i ističu da treba donijeti politike koje bi bile usmjerene prema lakšem izlasku iz prostitucije, a predstavnici civilnog društva se češće opredjeljuju za liberalne modele reguliranja prostitucije.

Navedeni stavovi rezultat su istraživanja provedenog među 15 stručnjaka u Hrvatskoj koji se  bave regulacijom prostitucije ili s njim povezanim problemima u okviru ministarstava, vladinih ureda, neovisnih državnih tijela, saborskih odbora i civilnih udruga, a objavljeni su u Političkoj misli.

Autorice Rašeljka Krnić i Ivana Radačić s Instituta društvenih znanosti Ivo Pilar te Mirjana Adamović s Instituta za društvena istraživanja ističu da različite ideološke pozicije stručnjaka određuju modele, odnosno politike usmjerene prema reguliranju prostitucije, ali svi prostituciju najčešće smještaju ili u odnose nasilja i eksploatacije ili u odnose seksualnog rada.

Većina stručnjaka zagovara promjenu modela regulacije prostitucije. Među najčešće spominjanim europskim modelima na koje bi se hrvatski model mogao ugledati vide švedski model kriminalizacije klijenata, dekriminalizacijski model i model legalizacije, kaže se.

Stručnjaci iz civilnog društva, dodaju, češće se opredjeljuju za liberalne modele reguliranja prostitucije.

Klasifikacije i modeli regulacije u EU

 

Prostitucija i njezina regulacija još uvijek su tabu teme u hrvatskom društvu, a zakonska rješenja kojima je regulirana potječu još iz doba kad je Hrvatska bila dio Jugoslavije.

Odredbe o prostituciji nalaze se u zakonu koji određuje prekršaje protiv javnog reda i mira, koji je prostituciju definirao kao društveno zlo, a osobe koje se bave prostitucijom kao delinkventice.

Unatoč zastarjelosti takvog rješenja i nekompatibilnosti s načelom ravnopravnosti spolova i standardima zaštite ljudskih prava, u Hrvatskoj nije bilo većih rasprava o modelima regulacije prostitucije, ističe se.

Također, malo je znanstvenih istraživanja u tom području, a ne postoje ni organizacije za zaštitu prava osoba koje se bave prostitucijom, odnosno pravima „seksualnih radnica/ka“.

Takvo je stanje u suprotnosti s kretanjima u zemljama Europske unije, koje u posljednjih dvadesetak godina karakteriziraju promjene politika i zakonodavstva.

Danas je uobičajena klasifikacija prostitucije na modele kriminalizacije, legalizacije i dekriminalizacije, s time da se ovisno o modelima kriminalizacije kažnjavaju sve strane, samo treće strane ili organizatori, osobe koje prodaju seksualne usluge ili klijenti.

Svim je modelima zajedničko da utječu na ljudska prava osoba koje prodaju seksualne usluge, ističu autorice.

Jedan od dominantnih modela u Europskoj uniji jest model kažnjavanja klijenata, koji se često naziva i švedski model, jer ga je Švedska prva uvela 1999. godine. Taj model preferira i EU parlament, koji je 2014. donio rezoluciju prema kojoj se pitanje prostitucije, kao globalnog fenomena, treba promatrati u okviru politika rodne ravnopravnosti.

Model počiva na tri glavne pretpostavke: kriminalizaciji kupaca seksualnih usluga, dekriminalizaciji osoba koje se bave prostitucijom i državnim politikama koje podržavaju lakši izlazak iz prostitucije, ističe se.

Drugi model dominantan u Europi, koji se primjenjuje u Njemačkoj i Nizozemskoj, jest legalizacija prostitucije. Počiva na pretpostavci poštivanja individualne slobode, slobode izbora te neutralnosti države u pogledu osobnog morala.

Pojedine države u kojima se primjenjuje taj model postavljaju uvjete kao što su obavezna registracija osoba koje se bave prostitucijom te obavezni zdravstveni pregledi ili testiranja na HIV.


Prestati s kriminalizacijom osoba koje pružaju seksualne usluge

Hrvatsko Ministarstvo unutarnjih poslova uputilo je prijedlog 2012. kojim se kriminaliziraju klijenti u svim slučajevima, ali kojim bi se nastavilo prekršajno goniti i osobe koje prodaju usluge.

Prijedlog na kraju nije stavljen na javnu raspravu jer mu se protivio tadašnji premijer, pa je ponovljen 2016., ali nije raspravljan u Saboru, iako je prošao javnu raspravu, jer je u međuvremenu pala Vlada, podsjeća se u tekstu.

Stručnjaci iz svih domena u Hrvatskoj složili su se da je aktualni zakon neadekvatan i zastario te da bi ga trebalo mijenjati.
Njihove primjedbe na zakon reflektiraju različite pozicije iz kojih kritički sagledavaju trenutno zakonsko rješenje.

Međutim, gotovo svi su se složili kako je kriminalizacija osoba koje pružaju seksualne usluge neprihvatljiva iz niza razloga, a prije svega jer dodatno otežava ionako tešku poziciju tih osoba koje su stigmatizirane i društveno marginalizirane, kaže se u tekstu.

Nalazi istraživanja ukazuju na potrebu da se u Hrvatskoj prostitucija što prije počne redefinirati kroz široku javnu raspravu koja bi, prema stavovima ispitanih stručnjaka, trebala obuhvatiti što je moguće više aktera, uključujući i osobe koje prodaju seksualne usluge.

Hrvatski stručnjaci zagovaraju promjenu modela regulacije prostitucije i ističu da treba donijeti politike koje bi bile usmjerene prema lakšem izlasku iz prostitucije, a predstavnici civilnog društva se češće opredjeljuju za liberalne modele reguliranja prostitucije.

Navedeni stavovi rezultat su istraživanja provedenog među 15 stručnjaka u Hrvatskoj koji se  bave regulacijom prostitucije ili s njim povezanim problemima u okviru ministarstava, vladinih ureda, neovisnih državnih tijela, saborskih odbora i civilnih udruga, a objavljeni su u Političkoj misli.

Autorice Rašeljka Krnić i Ivana Radačić s Instituta društvenih znanosti Ivo Pilar te Mirjana Adamović s Instituta za društvena istraživanja ističu da različite ideološke pozicije stručnjaka određuju modele, odnosno politike usmjerene prema reguliranju prostitucije, ali svi prostituciju najčešće smještaju ili u odnose nasilja i eksploatacije ili u odnose seksualnog rada.

Većina stručnjaka zagovara promjenu modela regulacije prostitucije. Među najčešće spominjanim europskim modelima na koje bi se hrvatski model mogao ugledati vide švedski model kriminalizacije klijenata, dekriminalizacijski model i model legalizacije, kaže se.

Stručnjaci iz civilnog društva, dodaju, češće se opredjeljuju za liberalne modele reguliranja prostitucije.

Klasifikacije i modeli regulacije u EU

 

Prostitucija i njezina regulacija još uvijek su tabu teme u hrvatskom društvu, a zakonska rješenja kojima je regulirana potječu još iz doba kad je Hrvatska bila dio Jugoslavije.

Odredbe o prostituciji nalaze se u zakonu koji određuje prekršaje protiv javnog reda i mira, koji je prostituciju definirao kao društveno zlo, a osobe koje se bave prostitucijom kao delinkventice.

Unatoč zastarjelosti takvog rješenja i nekompatibilnosti s načelom ravnopravnosti spolova i standardima zaštite ljudskih prava, u Hrvatskoj nije bilo većih rasprava o modelima regulacije prostitucije, ističe se.

Također, malo je znanstvenih istraživanja u tom području, a ne postoje ni organizacije za zaštitu prava osoba koje se bave prostitucijom, odnosno pravima „seksualnih radnica/ka“.

Takvo je stanje u suprotnosti s kretanjima u zemljama Europske unije, koje u posljednjih dvadesetak godina karakteriziraju promjene politika i zakonodavstva.

Danas je uobičajena klasifikacija prostitucije na modele kriminalizacije, legalizacije i dekriminalizacije, s time da se ovisno o modelima kriminalizacije kažnjavaju sve strane, samo treće strane ili organizatori, osobe koje prodaju seksualne usluge ili klijenti.

Svim je modelima zajedničko da utječu na ljudska prava osoba koje prodaju seksualne usluge, ističu autorice.

Jedan od dominantnih modela u Europskoj uniji jest model kažnjavanja klijenata, koji se često naziva i švedski model, jer ga je Švedska prva uvela 1999. godine. Taj model preferira i EU parlament, koji je 2014. donio rezoluciju prema kojoj se pitanje prostitucije, kao globalnog fenomena, treba promatrati u okviru politika rodne ravnopravnosti.

Model počiva na tri glavne pretpostavke: kriminalizaciji kupaca seksualnih usluga, dekriminalizaciji osoba koje se bave prostitucijom i državnim politikama koje podržavaju lakši izlazak iz prostitucije, ističe se.

Drugi model dominantan u Europi, koji se primjenjuje u Njemačkoj i Nizozemskoj, jest legalizacija prostitucije. Počiva na pretpostavci poštivanja individualne slobode, slobode izbora te neutralnosti države u pogledu osobnog morala.

Pojedine države u kojima se primjenjuje taj model postavljaju uvjete kao što su obavezna registracija osoba koje se bave prostitucijom te obavezni zdravstveni pregledi ili testiranja na HIV.


Prestati s kriminalizacijom osoba koje pružaju seksualne usluge

Hrvatsko Ministarstvo unutarnjih poslova uputilo je prijedlog 2012. kojim se kriminaliziraju klijenti u svim slučajevima, ali kojim bi se nastavilo prekršajno goniti i osobe koje prodaju usluge.

Prijedlog na kraju nije stavljen na javnu raspravu jer mu se protivio tadašnji premijer, pa je ponovljen 2016., ali nije raspravljan u Saboru, iako je prošao javnu raspravu, jer je u međuvremenu pala Vlada, podsjeća se u tekstu.

Stručnjaci iz svih domena u Hrvatskoj složili su se da je aktualni zakon neadekvatan i zastario te da bi ga trebalo mijenjati.
Njihove primjedbe na zakon reflektiraju različite pozicije iz kojih kritički sagledavaju trenutno zakonsko rješenje.

Međutim, gotovo svi su se složili kako je kriminalizacija osoba koje pružaju seksualne usluge neprihvatljiva iz niza razloga, a prije svega jer dodatno otežava ionako tešku poziciju tih osoba koje su stigmatizirane i društveno marginalizirane, kaže se u tekstu.

Nalazi istraživanja ukazuju na potrebu da se u Hrvatskoj prostitucija što prije počne redefinirati kroz široku javnu raspravu koja bi, prema stavovima ispitanih stručnjaka, trebala obuhvatiti što je moguće više aktera, uključujući i osobe koje prodaju seksualne usluge.
