Članovi obitelji triju žrtava ratnog zločina na Ovčari dobili su pravomoćne presude za naknadu štete zbog smrti svojih najmilijih koju im mora isplatiti Republika Srbija. Epilog je to sudskog postupka koji se vodio na Prvom osnovnom sudu u Beogradu odnosno na Apelacionom sudu, koji je u konačnici potvrdio prvostupanjske presude, ali dosuđeni iznosi su zapravo mizerni, iako je, naravno, svima jasno da obiteljima žrtava nijedan novčani iznos ne može nadoknaditi taj gubitak. No, činjenica da su u ove tri presude dosuđeni iznosi u rasponu od 700.000 do 900.000 dinara, odnosno od 44.000 do 57.000 kuna, izazvala je negativne reakcije, kako obitelji žrtava, koje su najavile ustavnu tužbu protiv takvih odluka, tako i humanitarnih organizacija, donosi Jutarnji list. 

Ratni zarobljenici

Tako iz Fonda za humanitarno pravo u Beogradu, koji pomaže postjugoslavenskim društvima da uspostave vladavinu prava i prihvate naslijeđe masovnog kršenja ljudskih prava, kako bi se utvrdila kaznena odgovornost za počinitelje, zadovoljila pravda i onemogućilo ponavljanje zločina, naglašavaju da su zadovoljni brzinom donošenja presude, kao i samom odlukom da se obiteljima žrtava isplati naknada, ali upozoravaju da je riječ o neprimjereno niskim iznosima.

"Apelacioni sud u Beogradu potvrdio je tri presude Prvog osnovnog suda u Beogradu kojima je dosuđena naknada štete članovima obitelji ubijenih na poljoprivrednom dobru Ovčara 1991. godine i obvezao Ministarstvo obrane Republike Srbije da isplati novčane iznose na ime naknade štete zbog smrti bliske osobe. Fond za humanitarno pravo (FHP) smatra da su ovi postupci rijetki primjeri efikasnog suđenja u postupcima za naknadu štete, ali da su dosuđeni iznosi žrtvama neprimjereno niski i da ne odgovaraju standardima koje je uspostavio Europski sud za ljudska prava (ESLJP)", poručili su iz FHP-a.

Inače, temelj za ove tužbe i presude bila je presuda Okružnog suda u Beogradu iz 2009. godine kojom su pripadnici Teritorijalne obrane Vukovara i dobrovoljačke jedinice Leva supoderica (obje u sastavu Jugoslovenske narodne armije) - Miroljub Vujović, Stanko Vujanović, Predrag Milojević, Goran Mugoša, Miroslav Đanković, Ivan Atanasijević, Saša Radak i Nada Kalaba - osuđeni na višegodišnje kazne zatvora za ubojstvo najmanje 200 ratnih zarobljenika na Ovčari, od kojih su identificirana njih 193, koji su po imenu i prezimenu navedeni u ovoj presudi.

Nespremnost sudova

Kada je tu presudu 2017. potvrdio Apelacioni sud, obitelji žrtava Ovčare pokrenule su parnične postupke za naknadu štete zbog smrti bliske osobe protiv Ministarstva obrane Srbije, tražeći naknade od po 2,000.000 dinara. Nacionalni sudovi su u tri dosadašnje parnice dosudili iznose u rasponu od 700.000 do 900.000 dinara za svakog tužioca pojedinačno, smatrajući dosuđene iznose adekvatnim za naknadu nematerijalne štete po toj osnovi.

"FHP smatra, unatoč tome što su sudovi usvojili tužbene zahtjeve i što su postupci pravomoćno okončani u roku od dvije godine, što su rijetki pozitivni primjeri efikasnog postupanja, da dosuđeni iznosi ne zadovoljavaju standard pravične naknade zbog smrti bliske osobe, odnosno navedeni iznosi su neprimjereno niski i nisu u skladu sa standardima Europskog suda za ljudska prava. Naime, u slučaju Brdar protiv Hrvatske ESLJP je dosudio naknadu veću od 23.000 eura za nestanak člana porodice aplikanta tokom vojne akcije u Hrvatskoj u kolovozu 1995. godine. Iz tog razloga FHP smatra da dosuđeni iznosi pred sudovima Srbije u ovim postupcima ni približno ne odgovaraju sumi koju je ESLJP smatrao pravičnom u istovjetnoj situaciji, zbog čega su se članovi obitelji ubijenih obratili Ustavnom sudu Srbije kako bi ostvarili pun iznos naknade koji im pripada", poručili su iz FHP-a, u kojem smatraju i da ovakve odluke sudova u Srbiji kojima se dosuđuju triput manji iznosi "govore o nespremnosti domaćih sudova da primjenjuju praksu ESLJP-a i time obavežu Srbiju na isplatu naknade štete koja je u skladu s međunarodnim standardima, čime bi osigurali pravične reparacije žrtvama ratnih zločina". Podsjetimo, na Ovčari je u noći sa 20. na 21. studenoga 1991. ubijeno između 255 i 264 vojnika i civila, od kojih su većina bili pacijenti vukovarske bolnice, iz koje su nakon pada grada odvezeni na Ovčaru i tamo pogubljeni. Za više od 60 osoba, za koje se sumnja da su ubijene na Ovčari, još se traga.

Obitelj žrtve: "To je dodatno obezvređivanje svih nas"

Obitelji žrtava Ovčare o ovim presudama ne žele javno govoriti. Mi smo, ipak, razgovarali s jednom osobom koja je na Ovčari izgubila svoga bližnjeg i koja je također podnijela tužbu za naknadu štete, ali presuda u tom slučaju još nije donesena.

- Čekam odluku, a za ove presude i iznose sam evo doznao od vas. Činjenica je da nama nijedan iznos ne može vratiti ono što smo izgubili, ali ako je točno to što mi kažete, a vjerujem da jest, to je stvarno ništa. To je samo dodatno obezvrjeđivanje žrtava i nas, članova njihovih obitelji. Mislim da je to greška i Republike Hrvatske koja se i sama trebala uključiti u te postupke i tražiti odštete, a ne prepuštati nama da se sami borimo sa sustavom – kazao nam je jučer naš sugovornik, ogorčen na presudu.

Epilog je to sudskog postupka koji se vodio na Prvom osnovnom sudu u Beogradu odnosno na Apelacionom sudu, koji je u konačnici potvrdio prvostupanjske presude, ali dosuđeni iznosi su zapravo mizerni, iako je, naravno, svima jasno da obiteljima žrtava nijedan novčani iznos ne može nadoknaditi taj gubitak. No, činjenica da su u ove tri presude dosuđeni iznosi u rasponu od 700.000 do 900.000 dinara, odnosno od 44.000 do 57.000 kuna, izazvala je negativne reakcije, kako obitelji žrtava, koje su najavile ustavnu tužbu protiv takvih odluka, tako i humanitarnih organizacija, donosi Jutarnji list. 

Ratni zarobljenici

Tako iz Fonda za humanitarno pravo u Beogradu, koji pomaže postjugoslavenskim društvima da uspostave vladavinu prava i prihvate naslijeđe masovnog kršenja ljudskih prava, kako bi se utvrdila kaznena odgovornost za počinitelje, zadovoljila pravda i onemogućilo ponavljanje zločina, naglašavaju da su zadovoljni brzinom donošenja presude, kao i samom odlukom da se obiteljima žrtava isplati naknada, ali upozoravaju da je riječ o neprimjereno niskim iznosima.

"Apelacioni sud u Beogradu potvrdio je tri presude Prvog osnovnog suda u Beogradu kojima je dosuđena naknada štete članovima obitelji ubijenih na poljoprivrednom dobru Ovčara 1991. godine i obvezao Ministarstvo obrane Republike Srbije da isplati novčane iznose na ime naknade štete zbog smrti bliske osobe. Fond za humanitarno pravo (FHP) smatra da su ovi postupci rijetki primjeri efikasnog suđenja u postupcima za naknadu štete, ali da su dosuđeni iznosi žrtvama neprimjereno niski i da ne odgovaraju standardima koje je uspostavio Europski sud za ljudska prava (ESLJP)", poručili su iz FHP-a.

Inače, temelj za ove tužbe i presude bila je presuda Okružnog suda u Beogradu iz 2009. godine kojom su pripadnici Teritorijalne obrane Vukovara i dobrovoljačke jedinice Leva supoderica (obje u sastavu Jugoslovenske narodne armije) - Miroljub Vujović, Stanko Vujanović, Predrag Milojević, Goran Mugoša, Miroslav Đanković, Ivan Atanasijević, Saša Radak i Nada Kalaba - osuđeni na višegodišnje kazne zatvora za ubojstvo najmanje 200 ratnih zarobljenika na Ovčari, od kojih su identificirana njih 193, koji su po imenu i prezimenu navedeni u ovoj presudi.

Nespremnost sudova

Kada je tu presudu 2017. potvrdio Apelacioni sud, obitelji žrtava Ovčare pokrenule su parnične postupke za naknadu štete zbog smrti bliske osobe protiv Ministarstva obrane Srbije, tražeći naknade od po 2,000.000 dinara. Nacionalni sudovi su u tri dosadašnje parnice dosudili iznose u rasponu od 700.000 do 900.000 dinara za svakog tužioca pojedinačno, smatrajući dosuđene iznose adekvatnim za naknadu nematerijalne štete po toj osnovi.

"FHP smatra, unatoč tome što su sudovi usvojili tužbene zahtjeve i što su postupci pravomoćno okončani u roku od dvije godine, što su rijetki pozitivni primjeri efikasnog postupanja, da dosuđeni iznosi ne zadovoljavaju standard pravične naknade zbog smrti bliske osobe, odnosno navedeni iznosi su neprimjereno niski i nisu u skladu sa standardima Europskog suda za ljudska prava. Naime, u slučaju Brdar protiv Hrvatske ESLJP je dosudio naknadu veću od 23.000 eura za nestanak člana porodice aplikanta tokom vojne akcije u Hrvatskoj u kolovozu 1995. godine. Iz tog razloga FHP smatra da dosuđeni iznosi pred sudovima Srbije u ovim postupcima ni približno ne odgovaraju sumi koju je ESLJP smatrao pravičnom u istovjetnoj situaciji, zbog čega su se članovi obitelji ubijenih obratili Ustavnom sudu Srbije kako bi ostvarili pun iznos naknade koji im pripada", poručili su iz FHP-a, u kojem smatraju i da ovakve odluke sudova u Srbiji kojima se dosuđuju triput manji iznosi "govore o nespremnosti domaćih sudova da primjenjuju praksu ESLJP-a i time obavežu Srbiju na isplatu naknade štete koja je u skladu s međunarodnim standardima, čime bi osigurali pravične reparacije žrtvama ratnih zločina". Podsjetimo, na Ovčari je u noći sa 20. na 21. studenoga 1991. ubijeno između 255 i 264 vojnika i civila, od kojih su većina bili pacijenti vukovarske bolnice, iz koje su nakon pada grada odvezeni na Ovčaru i tamo pogubljeni. Za više od 60 osoba, za koje se sumnja da su ubijene na Ovčari, još se traga.

Obitelj žrtve: "To je dodatno obezvređivanje svih nas"

Obitelji žrtava Ovčare o ovim presudama ne žele javno govoriti. Mi smo, ipak, razgovarali s jednom osobom koja je na Ovčari izgubila svoga bližnjeg i koja je također podnijela tužbu za naknadu štete, ali presuda u tom slučaju još nije donesena.

- Čekam odluku, a za ove presude i iznose sam evo doznao od vas. Činjenica je da nama nijedan iznos ne može vratiti ono što smo izgubili, ali ako je točno to što mi kažete, a vjerujem da jest, to je stvarno ništa. To je samo dodatno obezvrjeđivanje žrtava i nas, članova njihovih obitelji. Mislim da je to greška i Republike Hrvatske koja se i sama trebala uključiti u te postupke i tražiti odštete, a ne prepuštati nama da se sami borimo sa sustavom – kazao nam je jučer naš sugovornik, ogorčen na presudu.
