Srđan Mladinić, osnivač i član Uprave SMS-a, jedne od nekad najuspješnijih splitskih tvrtki, napokon je dočekao pravomoćnu oslobađajuću presudu Vrhovnog suda za optužbe u vezi sa zlouporabom na štetu tvrtke SMS u iznosu od 3,5 milijuna kuna.

Naime, Mladinića je sredinom rujna 2018. godine sutkinja Županijskog suda u Splitu Ivona Rupić oslobodila krivnje da je u više navrata od 2004. do 2009. godine, kao osnivač i vlasnik tvrtke SMS, zatražio isplate s računa društva u iznosu od 4,75 milijuna kuna, prikazujući u knjigovodstvu taj iznos kao pozajmice.

Županijsko državno odvjetništvo teretilo ga je da je uzimao novac, a njegova tvrtka je ostvarila tek 1,18 milijuna kuna dobiti koja nije mogla opravdati tolike isplate. Takvim postupanjem oštetio je SMS za 3,56 milijuna kuna.

Posao u Omanu

Mladinić je u listopadu 2014. godine bio prvi put osuđen na uvjetnu kaznu zatvora od godine dana uz rok kušnje od pet godina, da bi četiri godine nakon toga, sredinom rujna 2018. godine, drugi put bio oslobođen krivnje. Sad je to postalo i pravomoćno.

Tijekom drugog suđenja Mladinić je kazao u svojoj obrani da je uzimao novac, ali i da ga je vraćao te da bi vratio sve što je uzeo da nije bio završio u zatvoru. Posebice zato jer je posao u Omanu na Bliskom istoku, a zbog kojeg je i posudio novac kako bi tamo osnovao tvrtku koja bi distribuirala proizvode SMS-a na arapskom tržištu, krenuo uzlaznom putanjom.

Njegov branitelj, odvjetnik Boris Milošević, od početka je tvrdio da je u ovom slučaju moguća jedino oslobađajuća presuda te je i ustrajao na svojim žalbama sve dok oslobađanje svog klijenta nije uspio i pravomoćno ishoditi.

Mladinićeva situacija kod mnogih je njegovih bivših djelatnika izazivala ogorčenje jer je - a autor ovog članka je to čuo od najmanje desetak njegovih bivših zaposlenika - bivši vlasnik SMS-a, kojem je ta tvrtka bila sve što je imao, bio jedan od vlasnika kakve radnik samo poželjeti može. Kad je 2009. godine izbila afera oko Podravke, nakon gotovo 20 godina urušila se Mladinićeva tada vrlo uspješna tvrtka, a on se suočio s USKOK-ovim optužbama i sudskim procesom.

Uništen život

Četiri mjeseca proveo je u istražnom zatvoru u Remetincu, posao mu je propao, SMS je završio u stečaju, a Srđan Mladinić ostao je bez prihoda, izgubio je stan i doživio je tragediju u obitelji.

Nekad vrlo uspješnom poslovnom čovjeku život je uništen na sve moguće načine.

Iz obrane optuženog proizlazi da je sve pozajmice koje je dobio od SMS-a, u razdoblju od 15 godina prije inkriminiranog, vratio. Jednako tako, da je namjeravao vratiti i ove za koje ga se tereti, no da je u međuvremenu bio uhićen i lišen slobode u drugom kaznenom postupku (afera Spice - op.a.). Kada je izišao iz zatvora, tvrtka SMS je već bila u stečaju po sili zakona i bio je onemogućen u svim daljnjim radnjama pa tako i vraćanju pozajmica - utvrdio je, među ostalim, Vrhovni sud.

Mladinić još uvijek ne želi izlaziti u javnost s komentarima na sve ovo što mu se događalo iako bi čovjek mogao napisati vrhunski triler o svom poslovnom uspjehu i padu. Još uvijek čeka pravomoćnu odluku u slučaju afere “Spice”, u kojoj mu se zajedno s Damirom Polančecom, bivšim potpredsjednikom Vlade te bivšim čelnicima Podravke Darkom Marincem, Zdravkom Šestakom, Josipom Pavlovićem i Sašom Romcem, kao i suvlasnikom varaždinske “Fima Grupe” Milanom Horvatom i odvjetnikom Zoranom Markovićem sudilo pod optužbom da su novcem Podravke pokušali preuzeti vlasništvo nad tom tvrtkom, oštetivši je za oko 400 milijuna kuna. No, Marinac, Šestak, Pavlović i Mladinić su proglašeni krivima da su oštetili Podravku dajući 65 milijuna kuna zajma splitskoj tvrtki SMS. Mladinić je u ovom slučaju nepravomoćno za sada osuđen na pola godine zatvora, uvjetno na dvije godine.

Srđan Mladinić, osnivač i član Uprave SMS-a, jedne od nekad najuspješnijih splitskih tvrtki, napokon je dočekao pravomoćnu oslobađajuću presudu Vrhovnog suda za optužbe u vezi sa zlouporabom na štetu tvrtke SMS u iznosu od 3,5 milijuna kuna.

Naime, Mladinića je sredinom rujna 2018. godine sutkinja Županijskog suda u Splitu Ivona Rupić oslobodila krivnje da je u više navrata od 2004. do 2009. godine, kao osnivač i vlasnik tvrtke SMS, zatražio isplate s računa društva u iznosu od 4,75 milijuna kuna, prikazujući u knjigovodstvu taj iznos kao pozajmice.

Županijsko državno odvjetništvo teretilo ga je da je uzimao novac, a njegova tvrtka je ostvarila tek 1,18 milijuna kuna dobiti koja nije mogla opravdati tolike isplate. Takvim postupanjem oštetio je SMS za 3,56 milijuna kuna.

Posao u Omanu

Mladinić je u listopadu 2014. godine bio prvi put osuđen na uvjetnu kaznu zatvora od godine dana uz rok kušnje od pet godina, da bi četiri godine nakon toga, sredinom rujna 2018. godine, drugi put bio oslobođen krivnje. Sad je to postalo i pravomoćno.

Tijekom drugog suđenja Mladinić je kazao u svojoj obrani da je uzimao novac, ali i da ga je vraćao te da bi vratio sve što je uzeo da nije bio završio u zatvoru. Posebice zato jer je posao u Omanu na Bliskom istoku, a zbog kojeg je i posudio novac kako bi tamo osnovao tvrtku koja bi distribuirala proizvode SMS-a na arapskom tržištu, krenuo uzlaznom putanjom.

Njegov branitelj, odvjetnik Boris Milošević, od početka je tvrdio da je u ovom slučaju moguća jedino oslobađajuća presuda te je i ustrajao na svojim žalbama sve dok oslobađanje svog klijenta nije uspio i pravomoćno ishoditi.

Mladinićeva situacija kod mnogih je njegovih bivših djelatnika izazivala ogorčenje jer je - a autor ovog članka je to čuo od najmanje desetak njegovih bivših zaposlenika - bivši vlasnik SMS-a, kojem je ta tvrtka bila sve što je imao, bio jedan od vlasnika kakve radnik samo poželjeti može. Kad je 2009. godine izbila afera oko Podravke, nakon gotovo 20 godina urušila se Mladinićeva tada vrlo uspješna tvrtka, a on se suočio s USKOK-ovim optužbama i sudskim procesom.

Uništen život

Četiri mjeseca proveo je u istražnom zatvoru u Remetincu, posao mu je propao, SMS je završio u stečaju, a Srđan Mladinić ostao je bez prihoda, izgubio je stan i doživio je tragediju u obitelji.

Nekad vrlo uspješnom poslovnom čovjeku život je uništen na sve moguće načine.

Iz obrane optuženog proizlazi da je sve pozajmice koje je dobio od SMS-a, u razdoblju od 15 godina prije inkriminiranog, vratio. Jednako tako, da je namjeravao vratiti i ove za koje ga se tereti, no da je u međuvremenu bio uhićen i lišen slobode u drugom kaznenom postupku (afera Spice - op.a.). Kada je izišao iz zatvora, tvrtka SMS je već bila u stečaju po sili zakona i bio je onemogućen u svim daljnjim radnjama pa tako i vraćanju pozajmica - utvrdio je, među ostalim, Vrhovni sud.

Mladinić još uvijek ne želi izlaziti u javnost s komentarima na sve ovo što mu se događalo iako bi čovjek mogao napisati vrhunski triler o svom poslovnom uspjehu i padu. Još uvijek čeka pravomoćnu odluku u slučaju afere “Spice”, u kojoj mu se zajedno s Damirom Polančecom, bivšim potpredsjednikom Vlade te bivšim čelnicima Podravke Darkom Marincem, Zdravkom Šestakom, Josipom Pavlovićem i Sašom Romcem, kao i suvlasnikom varaždinske “Fima Grupe” Milanom Horvatom i odvjetnikom Zoranom Markovićem sudilo pod optužbom da su novcem Podravke pokušali preuzeti vlasništvo nad tom tvrtkom, oštetivši je za oko 400 milijuna kuna. No, Marinac, Šestak, Pavlović i Mladinić su proglašeni krivima da su oštetili Podravku dajući 65 milijuna kuna zajma splitskoj tvrtki SMS. Mladinić je u ovom slučaju nepravomoćno za sada osuđen na pola godine zatvora, uvjetno na dvije godine.

Srđan Mladinić, osnivač i član Uprave SMS-a, jedne od nekad najuspješnijih splitskih tvrtki, napokon je dočekao pravomoćnu oslobađajuću presudu Vrhovnog suda za optužbe u vezi sa zlouporabom na štetu tvrtke SMS u iznosu od 3,5 milijuna kuna.

Naime, Mladinića je sredinom rujna 2018. godine sutkinja Županijskog suda u Splitu Ivona Rupić oslobodila krivnje da je u više navrata od 2004. do 2009. godine, kao osnivač i vlasnik tvrtke SMS, zatražio isplate s računa društva u iznosu od 4,75 milijuna kuna, prikazujući u knjigovodstvu taj iznos kao pozajmice.

Županijsko državno odvjetništvo teretilo ga je da je uzimao novac, a njegova tvrtka je ostvarila tek 1,18 milijuna kuna dobiti koja nije mogla opravdati tolike isplate. Takvim postupanjem oštetio je SMS za 3,56 milijuna kun...
