U jedanaest slučajeva dovršenog teškog ubojstva počinjenog na štetu bliske osobe koju je počinitelj ranije zlostavljao, sve žrtve su bile žene i to sadašnje ili bivše bračne ili izvanbračne partnerice počinitelja. Proizlazi to iz istraživanja 23 pravomoćne presude Vrhovnog suda Republike Hrvatske u kojima su počinitelji proglašeni krivima za pokušaj ili dovršeno kazneno djelo teškog ubojstva iz članka 111. toč. 3 Kaznenog zakona u razdoblju od 1. siječnja 2013. do 1. rujna 2022. godine koje je provela dr. sc. Nevena Aljinović s Katedre za pravne znanosti u forenzici, Sveučilišta u Splitu, Sveučilišnog odjela za forenzične znanosti, piše Jutarnji list.

Svi počinitelji su bili muškarci, a od 25 slučajeva dovršenog teškog ubojstva i pokušaja kaznenog djela čak 22 žrtve (88 posto žrtava) bile su sadašnje ili bivše intimne partnerice počinitelja.

S ovim je u neraskidivoj vezi i ranije (dugotrajno) zlostavljanje žrtve i ono je postojalo u svim analiziranim slučajevima. Dijelom je to sud ustanovio postojanjem prijašnje osude u prekršajnom ili kaznenom postupku. "Međutim, kako u pojedinim slučajevima dugogodišnje zlostavljanje NIKADA nije bilo prijavljeno, sud je okolnost ranijeg zlostavljanja ustanovio na temelju drugih dokaza – iskaza svjedoka, temeljem medicinske dokumentacije ili na drugi način. Ono što posebno plijeni pažnju u nekolicini slučajeva jeste da su počinitelji NEGIRALI da su ranije zlostavljali žrtvu jer zlostavljanje nikada nije bilo prijavljeno"; navodi dr sc Nevena Aljinović.

Obzirom da je za žrtve obiteljskog nasilja svojstveno da ga ponekad ne prijavljuju, iznenađuje okolnost da je Vrhovni sud raniju neosuđivanost počinitelja u nekoliko predmeta vrednovao kao olakotnu okolnost, ističe autorica istraživanja. Navodi i kako joj je zanimljiva interpretacija Vrhovnog suda konstatacije da se to što je počinitelj žrtvu i "prije tukao" ne može podvesti pod zakonski opis kaznenog djela teškog ubojstva prema članu obitelji, već da se radi o tzv. "običnom ubojstvu".

Iako su, kako je već navedeno, u istraživanju sve žrtve dovršenog teškog ubojstva bile žene, sadašnje ili bivše bračne ili izvanbračne partnerice počinitelja, koji su redom muškarci, zakonodavac zaobilazi rodnu komponentu. Nedostatak razumijevanja što pojam femicid zapravo obuhvaća, predstavlja snažnu prepreku da se on prenese u kaznenopravni okvir. Unatoč tome što je u posljednjih pet godina, prema podacima MUP-a ubijena 91 žena, što je čak 47 % svih ubojstava, od čega su u 70 % tih ubojstava počinitelji bile bliske osobe, a u više od polovice slučajeva žrtvini partneri. Ili da su žene žrtve u više od 70 % svih evidentiranih prekršaja nasilja u obitelji, dok su u 90 % slučajeva kaznenih djela teškog nasilja u obitelji žrtve također žene, piše Jutarnji list.

Dr. sc. Nevena Aljinović je iz analize kaznenih djela nasilničkog ponašanja u obitelji primijetila da je 2013. i 2014. godine broj drastično pao, a razlog se može potražiti u odluci zakonodavca o premještanju inkriminacije nasilja u nadležnost prekršajnih sudova. Kako je nasilje u obitelji opet vraćeno u Kazneni zakon, od 2015. bilježi se rast prijava, ali prisutan je i trend opadanja prijava za prekršajna djela nasilja u obitelji, što dr. sc. Aljinović pripisuje i naporima policije u prepoznavanju i pravilnom klasificiranju nasilničkih ponašanja kroz kaznenopravnu zaštitu.

Ali, činjenica da je prisutan trend porasta kaznenih djela, uz opadanje prekršaja, govori u prilog tvrdnji da postojeći sustav prevencije dugoročno odvraća žrtve nasilja od prijavljivanja lakših oblika nasilja u obitelji. Kad nasilje nad žrtvom eskalira obično svjedočimo zločinu i na vidjelo izlazi neefikasnost i pasivnost sustava koji bi trebao spriječiti najteža kaznena djela.

U jedanaest slučajeva dovršenog teškog ubojstva počinjenog na štetu bliske osobe koju je počinitelj ranije zlostavljao, sve žrtve su bile žene i to sadašnje ili bivše bračne ili izvanbračne partnerice počinitelja. Proizlazi to iz istraživanja 23 pravomoćne presude Vrhovnog suda Republike Hrvatske u kojima su počinitelji proglašeni krivima za pokušaj ili dovršeno kazneno djelo teškog ubojstva iz članka 111. toč. 3 Kaznenog zakona u razdoblju od 1. siječnja 2013. do 1. rujna 2022. godine koje je provela dr. sc. Nevena Aljinović s Katedre za pravne znanosti u forenzici, Sveučilišta u Splitu, Sveučilišnog odjela za forenzične znanosti, piše Jutarnji list.

Svi počinitelji su bili muškarci, a od 25 slučajeva dovršenog teškog ubojstva i pokušaja kaznenog djela čak 22 žrtve (88 posto žrtava) bile su sadašnje ili bivše intimne partnerice počinitelja.

S ovim je u neraskidivoj vezi i ranije (dugotrajno) zlostavljanje žrtve i ono je postojalo u svim analiziranim slučajevima. Dijelom je to sud ustanovio postojanjem prijašnje osude u prekršajnom ili kaznenom postupku. "Međutim, kako u pojedinim slučajevima dugogodišnje zlostavljanje NIKADA nije bilo prijavljeno, sud je okolnost ranijeg zlostavljanja ustanovio na temelju drugih dokaza – iskaza svjedoka, temeljem medicinske dokumentacije ili na drugi način. Ono što posebno plijeni pažnju u nekolicini slučajeva jeste da su počinitelji NEGIRALI da su ranije zlostavljali žrtvu jer zlostavljanje nikada nije bilo prijavljeno"; navodi dr sc Nevena Aljinović.

Obzirom da je za žrtve obiteljskog nasilja svojstveno da ga ponekad ne prijavljuju, iznenađuje okolnost da je Vrhovni sud raniju neosuđivanost počinitelja u nekoliko predmeta vrednovao kao olakotnu okolnost, ističe autorica istraživanja. Navodi i kako joj je zanimljiva interpretacija Vrhovnog suda konstatacije da se to što je počinitelj žrtvu i "prije tukao" ne može podvesti pod zakonski opis kaznenog djela teškog ubojstva prema članu obitelji, već da se radi o tzv. "običnom ubojstvu".

Iako su, kako je već navedeno, u istraživanju sve žrtve dovršenog teškog ubojstva bile žene, sadašnje ili bivše bračne ili izvanbračne partnerice počinitelja, koji su redom muškarci, zakonodavac zaobilazi rodnu komponentu. Nedostatak razumijevanja što pojam femicid zapravo obuhvaća, predstavlja snažnu prepreku da se on prenese u kaznenopravni okvir. Unatoč tome što je u posljednjih pet godina, prema podacima MUP-a ubijena 91 žena, što je čak 47 % svih ubojstava, od čega su u 70 % tih ubojstava počinitelji bile bliske osobe, a u više od polovice slučajeva žrtvini partneri. Ili da su žene žrtve u više od 70 % svih evidentiranih prekršaja nasilja u obitelji, dok su u 90 % slučajeva kaznenih djela teškog nasilja u obitelji žrtve također žene, piše Jutarnji list.

Dr. sc. Nevena Aljinović je iz analize kaznenih djela nasilničkog ponašanja u obitelji primijetila da je 2013. i 2014. godine broj drastično pao, a razlog se može potražiti u odluci zakonodavca o premještanju inkriminacije nasilja u nadležnost prekršajnih sudova. Kako je nasilje u obitelji opet vraćeno u Kazneni zakon, od 2015. bilježi se rast prijava, ali prisutan je i trend opadanja prijava za prekršajna djela nasilja u obitelji, što dr. sc. Aljinović pripisuje i naporima policije u prepoznavanju i pravilnom klasificiranju nasilničkih ponašanja kroz kaznenopravnu zaštitu.

Ali, činjenica da je prisutan trend porasta kaznenih djela, uz opadanje prekršaja, govori u prilog tvrdnji da postojeći sustav prevencije dugoročno odvraća žrtve nasilja od prijavljivanja lakših oblika nasilja u obitelji. Kad nasilje nad žrtvom eskalira obično svjedočimo zločinu i na vidjelo izlazi neefikasnost i pasivnost sustava koji bi trebao spriječiti najteža kaznena djela.
