Poučena iskustvom iz jednog trgovačkog centra u kojem joj je rečeni kako automatska blagajna neće prihvatiti više od 30 kuna u kovanicama, novinarka N1 poslala je upit trgovačkim centrima za koje zna da omogućavaju plaćanje na automatskoj blagajni, kao i kod Hrvatske narodne banke i Državnog inspektorata RH.
Ograničenje kovanica u našim trgovinama ne postoji”, odgovorili su na upit iz Kauflanda.
“Ne postoje tehnička ograničenja na samonaplatnim blagajnama kad je riječ o plaćanju kovanicama te kupci mogu cijeli iznos računa podmiriti na način koji im najviše odgovara, bilo da se radi o kovanicama, novčanicama ili kartičnom plaćanju. Također, ne postoje upute za asistente na samonaplatnim blagajnama oko ograničenja u načinima plaćanja”, kazali su.
Na njihov upit iz HNB-a odgovaraju kako ni Zakon o HNB-u, a ni podzakonski propisi koji iz njega proizlaze, ne propisuju način na koji će se izvršiti plaćanje u slučaju korištenja gotovog novca, tj. “ne propisuju može li primatelj plaćanja uvjetovati apoensku strukturu gotovog novca kojeg zaprima pri takvom plaćanju”.
“Mišljenja smo da bi trgovci trebali prihvaćati sve apoene kuna i lipa pri izvršavanju plaćanja gotovim novcem. Ipak, pri tome postoje objektivne okolnosti vezane za praktičnu primjenu u poslovnoj praksi koje uvjetuju odstupanje od navedenoga”, kažu iz HNB-a te poručuju kako bi se kupac koji smatra da mu je neopravdano odbijeno sredstvo plaćanja trebao obratiti Državnom inspektoratu.
U Državnom inspektoratu kažu kako su “kovanice kune i lipe zakonsko sredstvo plaćanja u Republici Hrvatskoj te da trgovac ne smije ograničavati potrošača vezano uz način plaćanja u kovanicama”.
“U slučaju ograničavanja plaćanja u lipama odnosno kunama kao kovanicama ističemo da potrošači mogu podnijeti predstavku Državnom inspektoratu i to ispunjavanjem elektroničkog obrasca objavljenog na web stranici Državnog inspektorata na poveznici podnošenje prijava ili slanjem prijave poštom odnosno dolaskom na adresu nadležnog ureda Državnog inspektorata, a sve kako bi tržišna inspekcija Državnog inspektorata mogla ovisno o okolnosti svakog pojedinog slučaja utvrditi da li postoje elementi nepoštene poslovne prakse sukladno odredbama Zakona o zaštiti potrošača”, odgovorili su im.

Poučena iskustvom iz jednog trgovačkog centra u kojem joj je rečeni kako automatska blagajna neće prihvatiti više od 30 kuna u kovanicama, novinarka N1 poslala je upit trgovačkim centrima za koje zna da omogućavaju plaćanje na automatskoj blagajni, kao i kod Hrvatske narodne banke i Državnog inspektorata RH.
Ograničenje kovanica u našim trgovinama ne postoji”, odgovorili su na upit iz Kauflanda.
“Ne postoje tehnička ograničenja na samonaplatnim blagajnama kad je riječ o plaćanju kovanicama te kupci mogu cijeli iznos računa podmiriti na način koji im najviše odgovara, bilo da se radi o kovanicama, novčanicama ili kartičnom plaćanju. Također, ne postoje upute za asistente na samonaplatnim blagajnama oko ograničenja u načinima plaćanja”, kazali su.
Na njihov upit iz HNB-a odgovaraju kako ni Zakon o HNB-u, a ni podzakonski propisi koji iz njega proizlaze, ne propisuju način na koji će se izvršiti plaćanje u slučaju korištenja gotovog novca, tj. “ne propisuju može li primatelj plaćanja uvjetovati apoensku strukturu gotovog novca kojeg zaprima pri takvom plaćanju”.
“Mišljenja smo da bi trgovci trebali prihvaćati sve apoene kuna i lipa pri izvršavanju plaćanja gotovim novcem. Ipak, pri tome postoje objektivne okolnosti vezane za praktičnu primjenu u poslovnoj praksi koje uvjetuju odstupanje od navedenoga”, kažu iz HNB-a te poručuju kako bi se kupac koji smatra da mu je neopravdano odbijeno sredstvo plaćanja trebao obratiti Državnom inspektoratu.
U Državnom inspektoratu kažu kako su “kovanice kune i lipe zakonsko sredstvo plaćanja u Republici Hrvatskoj te da trgovac ne smije ograničavati potrošača vezano uz način plaćanja u kovanicama”.
“U slučaju ograničavanja plaćanja u lipama odnosno kunama kao kovanicama ističemo da potrošači mogu podnijeti predstavku Državnom inspektoratu i to ispunjavanjem elektroničkog obrasca objavljenog na web stranici Državnog inspektorata na poveznici podnošenje prijava ili slanjem prijave poštom odnosno dolaskom na adresu nadležnog ureda Državnog inspektorata, a sve kako bi tržišna inspekcija Državnog inspektorata mogla ovisno o okolnosti svakog pojedinog slučaja utvrditi da li postoje elementi nepoštene poslovne prakse sukladno odredbama Zakona o zaštiti potrošača”, odgovorili su im.
