Procedura posvajanja djeteta u Republici Hrvatskoj je dugotrajna, ali jasna. Procedura posvajanja djeteta iz DR Konga je jednostavna i brza, ali rubno (ne)zakonita, neizvjesna, skupa i rizična. Kako je taj postupak izgledao u slučaju osmero uhićenih hrvatskh državljana koji su sada već 30 dana u zambijskom zatvoru zbog sumnjive dokumentacije za posvajanje možemo dobro rekonstruirati na temelju iskustava osoba koje su istu stvar radile prije njih, piše Jutarnji list. 

Ono u čemu se svi slažu su sljedeće činjenice: oni su morali znati da se upuštaju u rizičan postupak, slobode ih je gotovo sigurno koštala krivotvorena izlazna viza za djecu, jer je naprosto nije moguće dobiti legalnim putem, i treće, oni su sada u velikim problemima.

- Posvajanje djeteta kreće preko foruma ili nekoliko zatvorenih WhatsApp grupa, gdje se dobivaju prve informacije. Potom se stupa u kontakt s kongoaškim odvjetnikom. Njemu se šalju osnovne karakteristike djeteta koje želiš posvojiti, u pravilu se to svodi na izbor spola, dobi i inzistiranja da je ono zdravo. I, naravno, hrpa novca.

I tamo legalan postupak iziskuje opsežnu dokumentaciju, treba pripremiti izvještaj o karakteru i osobnosti, odnosno podobnosti za posvojenje, koji treba izdati naše nadležno tijelo. Znači, moraš imati status posvojitelja u svojoj državi - kaže osoba koja je tu proceduru prošla.

Nadležni sudovi

Koju su dokumentaciju hrvatski posvojitelji poslali nije jasno, zna se da su taj status imala samo dva para, jedan iz prošle, drugi iz 2021. Na temelju dostavljene dokumentacije, ma kakva ona bila, kongoanski sud očito je donio odluku o posvojenju, koja je potom verificirana na hrvatskim sudovima i izvađeni su dokumenti za djecu, ali djeca nisu mogla legalno napustiti DR Kongo.

- To je vjerojatni razlog zašto su oni djecu dočekali u Zambiji, a nisu išli po njih u DR Kongo. Ranije je država preko koje se to radilo bila Kenija, ali su se tamo stvari u međuvremenu zakomplicirale. Tada, u Zambiji, oni su prvi put vidjeli svoju djecu, nikada prije nisu stupili na tlo države iz koje ju posvajaju niti će to vjerojatno ikada, a Hrvatska je dobila državljane koji tek trebaju stupiti na njezino tlo - kaže nam.

Zašto su posvojitelji djece u Kongu, iako su prijavljeni u Zagrebu, zahtjeve za priznavanje presuda podnosili u sudovima u Zlataru i Varaždinu, jedno je od pitanja na koje do sada nije bilo odgovora, a na naš upit, glasnogovornica Općinskog suda u Zlataru sutkinja Aleksandra Leljak rekla je da se prijedlog može podnijeti nekom od stvarno nadležnih sudova u RH, što znači bilo kojem općinskom sudu.

Status oduzete djece

No, nije nam odgovoreno jesu li to posvojitelji učinili osobno ili u njihovo ime netko od odvjetnika jer davanje informacija o radu suda ne uključuje davanje informacija o osobnim podacima stranaka ni njihovih punomoćenika, odnosno zastupnika.

Još su odgovorili kako je postupak priznanja odluke stranog suda propisan Zakonom o međunarodnom privatnom pravu te da se sukladno tom zakonu, ako stranka protiv koje se priznanje i ovrha traže nema prebivalište u Hrvatskoj, niti se u RH treba provesti ovrha, tada se prijedlog može podnijeti bilo kojem sudu pa su se tako, primjerice, Azra Imamović Subošić i Zoran Subošić za priznanje presude kongoanskog suda obratili sudu u Zlataru iako imaju prebivalište u Zagrebu i dijete je i u matičnu knjigu upisano u Zagrebu.

Pitali su u Ministarstvu vanjskih poslova kakav je status oduzete djece, a odgovoreno je da "posjet djeci nije moguć s obzirom na to da zambijske vlasti osporavaju zakonitost postupka posvojenja, a samim time i hrvatsko državljanstvo djece".

Ured pravobraniteljice za djecu Helence Pirnat Dragičević izvijestio je kako je nadležnim tijelima preporučio da se izmjenama postojećih propisa, donošenjem smjernica i procedura ili na drugi odgovarajući način žurno stvore uvjeti za zaštitu djece posvojene u državama koje nisu potpisnice Haške konvencije.

Kronologija

6. 12.
Četiri hrvatska bračna para uočena su u zambijskoj Ndoli s četvero tamnopute djece, čime su pobudila sumnju na njihovo krijumčarenje. Dan poslije svi su uhićeni i smješteni u istražni zatvor, a djeca su oduzeta i predana socijalnim službama.


10. 12.
Veleposlanstvo RH u Pretoriji na temelju medijskih napisa od predstavnika Republike Zambije zatražilo je službenu potvrdu o uhićenju hrvatskih državljana, te im je 13. prosinca to usmeno priopćeno.


23. 12.
Prva vijest o uhićenjima objavljena je u hrvatskim medijima. Do danas nisu jasne okolnosti slučaja, a isplivale su brojne rupe u našim zakonima o posvajanju djece iz inozemstva.

Procedura posvajanja djeteta u Republici Hrvatskoj je dugotrajna, ali jasna. Procedura posvajanja djeteta iz DR Konga je jednostavna i brza, ali rubno (ne)zakonita, neizvjesna, skupa i rizična. Kako je taj postupak izgledao u slučaju osmero uhićenih hrvatskh državljana koji su sada već 30 dana u zambijskom zatvoru zbog sumnjive dokumentacije za posvajanje možemo dobro rekonstruirati na temelju iskustava osoba koje su istu stvar radile prije njih, piše Jutarnji list. 

Ono u čemu se svi slažu su sljedeće činjenice: oni su morali znati da se upuštaju u rizičan postupak, slobode ih je gotovo sigurno koštala krivotvorena izlazna viza za djecu, jer je naprosto nije moguće dobiti legalnim putem, i treće, oni su sada u velikim problemima.

- Posvajanje djeteta kreće preko foruma ili nekoliko zatvorenih WhatsApp grupa, gdje se dobivaju prve informacije. Potom se stupa u kontakt s kongoaškim odvjetnikom. Njemu se šalju osnovne karakteristike djeteta koje želiš posvojiti, u pravilu se to svodi na izbor spola, dobi i inzistiranja da je ono zdravo. I, naravno, hrpa novca.

I tamo legalan postupak iziskuje opsežnu dokumentaciju, treba pripremiti izvještaj o karakteru i osobnosti, odnosno podobnosti za posvojenje, koji treba izdati naše nadležno tijelo. Znači, moraš imati status posvojitelja u svojoj državi - kaže osoba koja je tu proceduru prošla.

Nadležni sudovi

Koju su dokumentaciju hrvatski posvojitelji poslali nije jasno, zna se da su taj status imala samo dva para, jedan iz prošle, drugi iz 2021. Na temelju dostavljene dokumentacije, ma kakva ona bila, kongoanski sud očito je donio odluku o posvojenju, koja je potom verificirana na hrvatskim sudovima i izvađeni su dokumenti za djecu, ali djeca nisu mogla legalno napustiti DR Kongo.

- To je vjerojatni razlog zašto su oni djecu dočekali u Zambiji, a nisu išli po njih u DR Kongo. Ranije je država preko koje se to radilo bila Kenija, ali su se tamo stvari u međuvremenu zakomplicirale. Tada, u Zambiji, oni su prvi put vidjeli svoju djecu, nikada prije nisu stupili na tlo države iz koje ju posvajaju niti će to vjerojatno ikada, a Hrvatska je dobila državljane koji tek trebaju stupiti na njezino tlo - kaže nam.

Zašto su posvojitelji djece u Kongu, iako su prijavljeni u Zagrebu, zahtjeve za priznavanje presuda podnosili u sudovima u Zlataru i Varaždinu, jedno je od pitanja na koje do sada nije bilo odgovora, a na naš upit, glasnogovornica Općinskog suda u Zlataru sutkinja Aleksandra Leljak rekla je da se prijedlog može podnijeti nekom od stvarno nadležnih sudova u RH, što znači bilo kojem općinskom sudu.

Status oduzete djece

No, nije nam odgovoreno jesu li to posvojitelji učinili osobno ili u njihovo ime netko od odvjetnika jer davanje informacija o radu suda ne uključuje davanje informacija o osobnim podacima stranaka ni njihovih punomoćenika, odnosno zastupnika.

Još su odgovorili kako je postupak priznanja odluke stranog suda propisan Zakonom o međunarodnom privatnom pravu te da se sukladno tom zakonu, ako stranka protiv koje se priznanje i ovrha traže nema prebivalište u Hrvatskoj, niti se u RH treba provesti ovrha, tada se prijedlog može podnijeti bilo kojem sudu pa su se tako, primjerice, Azra Imamović Subošić i Zoran Subošić za priznanje presude kongoanskog suda obratili sudu u Zlataru iako imaju prebivalište u Zagrebu i dijete je i u matičnu knjigu upisano u Zagrebu.

Pitali su u Ministarstvu vanjskih poslova kakav je status oduzete djece, a odgovoreno je da "posjet djeci nije moguć s obzirom na to da zambijske vlasti osporavaju zakonitost postupka posvojenja, a samim time i hrvatsko državljanstvo djece".

Ured pravobraniteljice za djecu Helence Pirnat Dragičević izvijestio je kako je nadležnim tijelima preporučio da se izmjenama postojećih propisa, donošenjem smjernica i procedura ili na drugi odgovarajući način žurno stvore uvjeti za zaštitu djece posvojene u državama koje nisu potpisnice Haške konvencije.

Kronologija

6. 12.
Četiri hrvatska bračna para uočena su u zambijskoj Ndoli s četvero tamnopute djece, čime su pobudila sumnju na njihovo krijumčarenje. Dan poslije svi su uhićeni i smješteni u istražni zatvor, a djeca su oduzeta i predana socijalnim službama.


10. 12.
Veleposlanstvo RH u Pretoriji na temelju medijskih napisa od predstavnika Republike Zambije zatražilo je službenu potvrdu o uhićenju hrvatskih državljana, te im je 13. prosinca to usmeno priopćeno.


23. 12.
Prva vijest o uhićenjima objavljena je u hrvatskim medijima. Do danas nisu jasne okolnosti slučaja, a isplivale su brojne rupe u našim zakonima o posvajanju djece iz inozemstva.

Procedura posvajanja djeteta u Republici Hrvatskoj je dugotrajna, ali jasna. Procedura posvajanja djeteta iz DR Konga je jednostavna i brza, ali rubno (ne)zakonita, neizvjesna, skupa i rizična. Kako je taj postupak izgledao u slučaju osmero uhićenih hrvatskh državljana koji su sada već 30 dana u zambijskom zatvoru zbog sumnjive dokumentacije za posvajanje možemo dobro rekonstruirati na temelju iskustava osoba koje su istu stvar radile prije njih, piše Jutarnji list.
