Državni inspektorat najavio je još prošlog tjedna kako kreće u nadzor nepravilnosti tijekom sezonskih sniženja u dućanima. Ljetno sezonsko sniženje započelo je 1. srpnja.

"Tržišna inspekcija Državnog inspektorata sukladno godišnjem programu rada provodi nadzorne aktivnosti tijekom zimskog i ljetnog sezonskog sniženja. Sezonskim sniženjem, sukladno odredbama Zakona o zaštiti potrošača i Pravilnika o uvjetima i načinu provođenja sezonskog sniženja, smatra se prodaja proizvoda po sniženoj cijeni nakon proteka sezone", pojasnili su za N1 iz DIRH-a.

"U okviru sezonskog sniženja, najniža cijena koju je trgovac primjenjivao tijekom razdoblja od 30 dana prije provođenja sezonskog sniženja i snižena cijena moraju biti istaknute jasno, vidljivo i čitljivo. U slučaju kada se cijena postupno i bez prekida smanjuje u okviru istog sezonskog sniženja, trgovac ističe najnižu cijenu koju je primjenjivao tijekom razdoblja od 30 dana prije provođenja sezonskog sniženja i novu sniženu cijenu", kažu iz DIRH-a.

Sezonsko sniženje odvija se dva puta godišnje. Zimsko sezonsko sniženje počinje od 27. prosinca, a ljetno sezonsko sniženje počinje od 1. srpnja i mogu trajati najdulje 60 dana, računajući od dana početka sezonskog sniženja.

"Tržišna inspekcija za vrijeme zimskog i ljetnog sezonskog sniženja pri provođenju nadzora kontrolira odredbe Zakona o zaštiti potrošača kojima se reguliraju posebni oblici prodaje, između ostalog i sezonsko sniženje te se tada kontroliraju odredbe ZZP-a vezane uz isticanje cijena od strane trgovaca sukladno odredbama ZZP-a, no istovremeno se provodi i kontrola odredbi o nepoštenoj poslovnoj praksi", pojašnjavaju iz DIRH-a za N1 što će točno inspektori kontrolirati tijekom nadzora sezonskih sniženja u trgovinama.

"Inspektori provode i pokreću inspekcijski postupak po službenoj dužnosti, a iznimno na zahtjev stranke, kada je to propisano posebnim zakonom. Isto tako, zaprimljene predstavke u kojima su navedeni podaci o prijavitelju, a kojima se ukazuje na postupanja protivna propisima mogu se koristiti kao povod za obavljanje inspekcijskog nadzora. Ako inspektor povodom zaprimljene predstavke obavi inspekcijski nadzor, podnositelja će u pisanom obliku obavijestiti o utvrđenom činjeničnom stanju i poduzetim mjerama, a ako prema sadržaju zaprimljene predstavke inspektor nije ovlašten obavljati inspekcijski nadzor, o tome će pisano obavijestiti podnositelja predstavke", pojašnjavaju iz Državnog inspektorata postupak pokretanja inspekcije.

Kazne za nepridržavanje pravila

U slučaju nepridržavanja zakonskih odredbi propisane su novčane kazne za prekršaje trgovca. Pravne osobe mogu dobiti kaznu u iznosu od 10.000,00 do 200.000,00 kn, odgovorne osobe u pravnoj osobi u iznosu 10.000,00 do 15.000,00 kn, a fizičke osobe u iznosu od 5.000,00 do 15.000,00 kuna.

Međutim, ZZP predviđa da se u određenim slučajevima može primijeniti i načelo oportuniteta, odnosno napraviti iznimka od obveze pokretanja prekršajnog postupka. Nadležni inspektor neće podnijeti optužni prijedlog odnosno izdati prekršajni nalog, ako:

– nadzirana pravna ili fizička osoba tijekom inspekcijskog nadzora odnosno do donošenja rješenja otkloni nepravilnosti i nedostatke odnosno posljedice tih nepravilnosti i nedostataka, utvrđenih u inspekcijskom nadzoru,

– za utvrđene nepravilnosti doneseno je rješenje i nadzirana osoba postupila je po izvršnom rješenju inspektora ili je postupila po rješenju prije nego što je ono postalo izvršno,

– nadzirana osoba očitovanjem na zapisnik preuzme obvezu da u određenom roku otkloni nepravilnosti i nedostatke utvrđene u inspekcijskom nadzoru za koje nije propisana upravna mjera, a inspektor utvrdi da je počinjen prekršaj.

Manje od 100 prekršaja tijekom zimskog sezonskog sniženja

Iz Državnog inspektorata doznajemo da je 2022. za vrijeme zimskog sezonskog sniženja obavljen ukupno 531 inspekcijski nadzor tijekom kojeg su utvrđena ukupno 94 prekršaja. Prekršaji su se odnosili na neisticanje cijena proizvoda tijekom posebnog oblika prodaje, nepropisno isticanje cijena proizvoda (uz cijene na sniženju nisu bile istaknute cijene u redovnoj prodaji), neisticanje uvjeta prodaje, neisticanje obavijesti o podnošenju pisanog prigovora kao i tri prekršaja nepoštene poslovne prakse koja se odnosila na zavaravanje potrošača u odnosu na isticanje određene pogodnosti u odnosu na cijenu proizvoda.

Ljetno sezonsko sniženje je u tijeku te za sada još ne raspolažemo traženim podacima, kažu iz DIRH-a za N1.

Državni inspektorat najavio je još prošlog tjedna kako kreće u nadzor nepravilnosti tijekom sezonskih sniženja u dućanima. Ljetno sezonsko sniženje započelo je 1. srpnja.

"Tržišna inspekcija Državnog inspektorata sukladno godišnjem programu rada provodi nadzorne aktivnosti tijekom zimskog i ljetnog sezonskog sniženja. Sezonskim sniženjem, sukladno odredbama Zakona o zaštiti potrošača i Pravilnika o uvjetima i načinu provođenja sezonskog sniženja, smatra se prodaja proizvoda po sniženoj cijeni nakon proteka sezone", pojasnili su za N1 iz DIRH-a.

"U okviru sezonskog sniženja, najniža cijena koju je trgovac primjenjivao tijekom razdoblja od 30 dana prije provođenja sezonskog sniženja i snižena cijena moraju biti istaknute jasno, vidljivo i čitljivo. U slučaju kada se cijena postupno i bez prekida smanjuje u okviru istog sezonskog sniženja, trgovac ističe najnižu cijenu koju je primjenjivao tijekom razdoblja od 30 dana prije provođenja sezonskog sniženja i novu sniženu cijenu", kažu iz DIRH-a.

Sezonsko sniženje odvija se dva puta godišnje. Zimsko sezonsko sniženje počinje od 27. prosinca, a ljetno sezonsko sniženje počinje od 1. srpnja i mogu trajati najdulje 60 dana, računajući od dana početka sezonskog sniženja.

"Tržišna inspekcija za vrijeme zimskog i ljetnog sezonskog sniženja pri provođenju nadzora kontrolira odredbe Zakona o zaštiti potrošača kojima se reguliraju posebni oblici prodaje, između ostalog i sezonsko sniženje te se tada kontroliraju odredbe ZZP-a vezane uz isticanje cijena od strane trgovaca sukladno odredbama ZZP-a, no istovremeno se provodi i kontrola odredbi o nepoštenoj poslovnoj praksi", pojašnjavaju iz DIRH-a za N1 što će točno inspektori kontrolirati tijekom nadzora sezonskih sniženja u trgovinama.

"Inspektori provode i pokreću inspekcijski postupak po službenoj dužnosti, a iznimno na zahtjev stranke, kada je to propisano posebnim zakonom. Isto tako, zaprimljene predstavke u kojima su navedeni podaci o prijavitelju, a kojima se ukazuje na postupanja protivna propisima mogu se koristiti kao povod za obavljanje inspekcijskog nadzora. Ako inspektor povodom zaprimljene predstavke obavi inspekcijski nadzor, podnositelja će u pisanom obliku obavijestiti o utvrđenom činjeničnom stanju i poduzetim mjerama, a ako prema sadržaju zaprimljene predstavke inspektor nije ovlašten obavljati inspekcijski nadzor, o tome će pisano obavijestiti podnositelja predstavke", pojašnjavaju iz Državnog inspektorata postupak pokretanja inspekcije.

Kazne za nepridržavanje pravila

U slučaju nepridržavanja zakonskih odredbi propisane su novčane kazne za prekršaje trgovca. Pravne osobe mogu dobiti kaznu u iznosu od 10.000,00 do 200.000,00 kn, odgovorne osobe u pravnoj osobi u iznosu 10.000,00 do 15.000,00 kn, a fizičke osobe u iznosu od 5.000,00 do 15.000,00 kuna.

Međutim, ZZP predviđa da se u određenim slučajevima može primijeniti i načelo oportuniteta, odnosno napraviti iznimka od obveze pokretanja prekršajnog postupka. Nadležni inspektor neće podnijeti optužni prijedlog odnosno izdati prekršajni nalog, ako:

– nadzirana pravna ili fizička osoba tijekom inspekcijskog nadzora odnosno do donošenja rješenja otkloni nepravilnosti i nedostatke odnosno posljedice tih nepravilnosti i nedostataka, utvrđenih u inspekcijskom nadzoru,

– za utvrđene nepravilnosti doneseno je rješenje i nadzirana osoba postupila je po izvršnom rješenju inspektora ili je postupila po rješenju prije nego što je ono postalo izvršno,

– nadzirana osoba očitovanjem na zapisnik preuzme obvezu da u određenom roku otkloni nepravilnosti i nedostatke utvrđene u inspekcijskom nadzoru za koje nije propisana upravna mjera, a inspektor utvrdi da je počinjen prekršaj.

Manje od 100 prekršaja tijekom zimskog sezonskog sniženja

Iz Državnog inspektorata doznajemo da je 2022. za vrijeme zimskog sezonskog sniženja obavljen ukupno 531 inspekcijski nadzor tijekom kojeg su utvrđena ukupno 94 prekršaja. Prekršaji su se odnosili na neisticanje cijena proizvoda tijekom posebnog oblika prodaje, nepropisno isticanje cijena proizvoda (uz cijene na sniženju nisu bile istaknute cijene u redovnoj prodaji), neisticanje uvjeta prodaje, neisticanje obavijesti o podnošenju pisanog prigovora kao i tri prekršaja nepoštene poslovne prakse koja se odnosila na zavaravanje potrošača u odnosu na isticanje određene pogodnosti u odnosu na cijenu proizvoda.

Ljetno sezonsko sniženje je u tijeku te za sada još ne raspolažemo traženim podacima, kažu iz DIRH-a za N1.
