Podsjetivši na presudu EU suda za ljudska prava, pravobraniteljica za ravnopravnost spolova Višnja Ljubičić u srijedu je upozorila kako se trudnicama i dalje uskraćuju prava te se založila za njihov pravedan tretman, prenosi N1.
Na konferenciji za novinare, Ljubičić je u Rijeci izvijestila kako je prema presudi Europskog suda za ljudska prava (ESLJP), Hrvatski zavod za zdravstveno osiguranje u slučaju “Jurčić protiv Hrvatske” 2009. povrijedio prava trudnice.
Odluka ESLJP, istaknula je, donijeta je nakon što je na svim razinama pravosuđa u Hrvatskoj ocjenjivano da je HZZO postupio ispravno.
Iznoseći kronologiju slučaja, Ljubičić je navela da je Kristina Jurčić 2009. provela postupak potpomognute oplodnje i potom sklopila ugovor o radu s poslodavcem, a desetak dana poslije utvrdila da je zatrudnjela. U HZZO-u, koji je trebao odobriti isplatu naknade za vrijeme čuvanje trudnoće te porodiljnu i rodiljnu naknadu, ocijenili su da je ugovor o radu fiktivan, sklopljen s namjerom da se ostvare navedena prava.
Trudnica je, kaže Ljubičić, dovedena u nezavidan položaj, jer je izgubila prava trudnica i rodilja, a nije mogla ostvariti svoja prava kao nezaposlena osoba jer je bila zaposlena. “HZZO-u smo poručili da mora napustiti takav način razmišljanja i ne može samovoljno donositi takve odluke, jer je ugovor o radu sklopljen između poslodavca i zaposlenika”, rekla je, a prenosi N1.
Navela je i da je Ministarstvo zdravstva upozoreno 2013. da će se pokrenuti postupak pred ESLJP. U međuvremenu je i Ustavni sud RH ocijenio da HZZO nije diskriminirao Jurčić, dodala je.
Ljubičić je istaknula da su izvješćivanjem o toj presudi željeli potaknuti institucije u Hrvatskoj na pravedan tretman trudnica, jer njen ured i dalje dobiva pritužbe trudnica kojima se uskraćuju prava.
Jurčić se prije zasnivanja radnog odnosa i trudnoće doselila u Rijeku, a prije toga je 14 godina bila u neprekinutom radnom odnosu kod drugog poslodavca, navedeno je.
Ured pravobraniteljice za ravnopravnost spolova, u suradnji s riječkim Centrom za participaciju žena u društvenom životu, predao je slučaj odvjetničkom društvu Jajaš-Vukelić iz Rijeke koji je podnio tužbu ESLJP. U presudi, donesenoj 4. veljače ove godine, utvrđeno je da je Jurčić diskriminirana te da je prekršeno nekoliko zakonskih akata RH, navela je odvjetnica Katja Jajaš.
U obrazloženju presude stoji da je HZZO zaključio da je žena u trenutku sklapanja ugovora o radu bila nesposobna za rad, a da to nije ni na koji način provjereno i nije se utvrđivalo je li uopće počela raditi. ESLJP je izrazio zabrinutost zbog takvih pretpostavki hrvatskih institucija, rekla je odvjetnica Stefana Požgaj.
Katja Jajaš je navela da je HZZO svoju procjenu temeljio na mišljenju ginekologa po kojem treba čuvati trudnoću.
“U svakom slučaju”, dodala je, “svaka žena ima slobodan izbor odlučivati sukladno mišljenju ginekologa”.
U presudi je Jurčić odobrena naknada od 7500 eura, što je dužna platiti Republika Hrvatska.

Podsjetivši na presudu EU suda za ljudska prava, pravobraniteljica za ravnopravnost spolova Višnja Ljubičić u srijedu je upozorila kako se trudnicama i dalje uskraćuju prava te se založila za njihov pravedan tretman, prenosi N1.
Na konferenciji za novinare, Ljubičić je u Rijeci izvijestila kako je prema presudi Europskog suda za ljudska prava (ESLJP), Hrvatski zavod za zdravstveno osiguranje u slučaju “Jurčić protiv Hrvatske” 2009. povrijedio prava trudnice.
Odluka ESLJP, istaknula je, donijeta je nakon što je na svim razinama pravosuđa u Hrvatskoj ocjenjivano da je HZZO postupio ispravno.
Iznoseći kronologiju slučaja, Ljubičić je navela da je Kristina Jurčić 2009. provela postupak potpomognute oplodnje i potom sklopila ugovor o radu s poslodavcem, a desetak dana poslije utvrdila da je zatrudnjela. U HZZO-u, koji je trebao odobriti isplatu naknade za vrijeme čuvanje trudnoće te porodiljnu i rodiljnu naknadu, ocijenili su da je ugovor o radu fiktivan, sklopljen s namjerom da se ostvare navedena prava.
Trudnica je, kaže Ljubičić, dovedena u nezavidan položaj, jer je izgubila prava trudnica i rodilja, a nije mogla ostvariti svoja prava kao nezaposlena osoba jer je bila zaposlena. “HZZO-u smo poručili da mora napustiti takav način razmišljanja i ne može samovoljno donositi takve odluke, jer je ugovor o radu sklopljen između poslodavca i zaposlenika”, rekla je, a prenosi N1.
Navela je i da je Ministarstvo zdravstva upozoreno 2013. da će se pokrenuti postupak pred ESLJP. U međuvremenu je i Ustavni sud RH ocijenio da HZZO nije diskriminirao Jurčić, dodala je.
Ljubičić je istaknula da su izvješćivanjem o toj presudi željeli potaknuti institucije u Hrvatskoj na pravedan tretman trudnica, jer njen ured i dalje dobiva pritužbe trudnica kojima se uskraćuju prava.
Jurčić se prije zasnivanja radnog odnosa i trudnoće doselila u Rijeku, a prije toga je 14 godina bila u neprekinutom radnom odnosu kod drugog poslodavca, navedeno je.
Ured pravobraniteljice za ravnopravnost spolova, u suradnji s riječkim Centrom za participaciju žena u društvenom životu, predao je slučaj odvjetničkom društvu Jajaš-Vukelić iz Rijeke koji je podnio tužbu ESLJP. U presudi, donesenoj 4. veljače ove godine, utvrđeno je da je Jurčić diskriminirana te da je prekršeno nekoliko zakonskih akata RH, navela je odvjetnica Katja Jajaš.
U obrazloženju presude stoji da je HZZO zaključio da je žena u trenutku sklapanja ugovora o radu bila nesposobna za rad, a da to nije ni na koji način provjereno i nije se utvrđivalo je li uopće počela raditi. ESLJP je izrazio zabrinutost zbog takvih pretpostavki hrvatskih institucija, rekla je odvjetnica Stefana Požgaj.
Katja Jajaš je navela da je HZZO svoju procjenu temeljio na mišljenju ginekologa po kojem treba čuvati trudnoću.
“U svakom slučaju”, dodala je, “svaka žena ima slobodan izbor odlučivati sukladno mišljenju ginekologa”.
U presudi je Jurčić odobrena naknada od 7500 eura, što je dužna platiti Republika Hrvatska.
