U Hrvatskoj je regulacija stambenog statusa podstanara, odnosno odnosa najmoprimca i najmodavca još uvijek nerazvijena, slabo zakonski regulirana i institucionalno zanemarena. To najmoprimce dovodi u nestalan, nesiguran i ranjiv položaj.
Inicijativa "Pravo na grad" je baš zato pripremila kratki poučni video kao nus-produkt "Priručnika za podstanare", ali i "Idealni ugovor" da bi sve one kojima bi to moglo koristiti upoznali s pravima podstanara.
Prava postoje čak i u trenutnom (manjkavom) obliku, u određenoj ih mjeri regulira postojeći Zakon o najmu stanova, ali se ona dodatno trebaju specificirati ugovorom, piše Bauštela.hr .
U gradovima Hrvatske bilježimo nezanemariv postotak stanovništva koje svoje stambeno pitanje rješava putem najma stana na tržištu. Oni koji žive u najmu nerijetko nisu upoznati sa svojim zakonski zagarantiranim pravima. U "Pravu na grad" su analizirali zakonodavni okvir i provedbu Zakona o najmu stanova, kao i postojeće ugovore o najmu stanova, a kroz radionice za podstanare prikupili su i analizirali mnoga podstanarska iskustva i zajednički radili na sastavljanju tzv. Idealnog ugovora.

Priručnik sadrži opis pojedinih elemenata ugovora o najmu stana, primjere iz postojećih ugovora, zakonski okvir i preporuku za najmoprimce pri pregovorima o ugovoru. Na kraju priručnika mogu se pronaći relevantne adrese za besplatnu pravnu pomoć u nekoliko gradova i županija kao i adrese na koje se adrese u gradskoj upravi može priložiti potpisani ugovor.
U tiskanoj verziji priručnika nalazi se i Ugovor o najmu stana koji se može istrgnuti i koristiti, a verzija koja se može online uređivati i prilagođavati može se pronaći ovdje .
Inicijativa je prisutna na mnogim društvenim mrežama, a na YouTube kanalu pokrenuli su seriju videa pod nazivom "I podstanari imaju pravo" u kojemu u kratkim i zanimljive snimkama objašnjavaju probleme s kojima se podstanari susreću. Između ostaloga, predstavili su Priručnik za podstanare.
Dakle, iako zakon nije savršen, ugovor to može biti! On omogućuje da se neka prava dodatno specificiraju.

Prava za koja možda niste znali:
1. Polog ne pokriva štetu nastalu redovitim korištenjem stana.
2. Pričuva nije trošak stanovanja.
3. Gosti u stanu koji unajmljujemo mogu ostati s nama do 30 dana prije nego ga moramo prijaviti stanodavcu.
4. Članovi obitelji za koje smo zakonski potrebni skrbiti (roditelji, djeca) po zakonu mogu živjeti s nama neograničeno.
5. Imamo pravo zatražiti smanjenje stanarine ako ne možemo stan koristiti na adekvatan način.
6. U slučaju kašnjenja s plaćanjem, stanodavac nema pravo potraživati kamate.
7. Radnje koje život u stanu čine ugodnijim i ukusnijim ne spadaju u nedozvoljene preinake stana.
8. Promjene nastale normalnim korištenjem stanari nisu dužni sanirati.
9. Tempo obilaska stana najmodavca treba regulirati ugovorom. Najmodavac nema pravo "banuti na vrata", piše Bauštela.hr .

U Hrvatskoj je regulacija stambenog statusa podstanara, odnosno odnosa najmoprimca i najmodavca još uvijek nerazvijena, slabo zakonski regulirana i institucionalno zanemarena. To najmoprimce dovodi u nestalan, nesiguran i ranjiv položaj.
Inicijativa "Pravo na grad" je baš zato pripremila kratki poučni video kao nus-produkt "Priručnika za podstanare", ali i "Idealni ugovor" da bi sve one kojima bi to moglo koristiti upoznali s pravima podstanara.
Prava postoje čak i u trenutnom (manjkavom) obliku, u određenoj ih mjeri regulira postojeći Zakon o najmu stanova, ali se ona dodatno trebaju specificirati ugovorom, piše Bauštela.hr .
U gradovima Hrvatske bilježimo nezanemariv postotak stanovništva koje svoje stambeno pitanje rješava putem najma stana na tržištu. Oni koji žive u najmu nerijetko nisu upoznati sa svojim zakonski zagarantiranim pravima. U "Pravu na grad" su analizirali zakonodavni okvir i provedbu Zakona o najmu stanova, kao i postojeće ugovore o najmu stanova, a kroz radionice za podstanare prikupili su i analizirali mnoga podstanarska iskustva i zajednički radili na sastavljanju tzv. Idealnog ugovora.

Priručnik sadrži opis pojedinih elemenata ugovora o najmu stana, primjere iz postojećih ugovora, zakonski okvir i preporuku za najmoprimce pri pregovorima o ugovoru. Na kraju priručnika mogu se pronaći relevantne adrese za besplatnu pravnu pomoć u nekoliko gradova i županija kao i adrese na koje se adrese u gradskoj upravi može priložiti potpisani ugovor.
U tiskanoj verziji priručnika nalazi se i Ugovor o najmu stana koji se može istrgnuti i koristiti, a verzija koja se može online uređivati i prilagođavati može se pronaći ovdje .
Inicijativa je prisutna na mnogim društvenim mrežama, a na YouTube kanalu pokrenuli su seriju videa pod nazivom "I podstanari imaju pravo" u kojemu u kratkim i zanimljive snimkama objašnjavaju probleme s kojima se podstanari susreću. Između ostaloga, predstavili su Priručnik za podstanare.
Dakle, iako zakon nije savršen, ugovor to može biti! On omogućuje da se neka prava dodatno specificiraju.

Prava za koja možda niste znali:
1. Polog ne pokriva štetu nastalu redovitim korištenjem stana.
2. Pričuva nije trošak stanovanja.
3. Gosti u stanu koji unajmljujemo mogu ostati s nama do 30 dana prije nego ga moramo prijaviti stanodavcu.
4. Članovi obitelji za koje smo zakonski potrebni skrbiti (roditelji, djeca) po zakonu mogu živjeti s nama neograničeno.
5. Imamo pravo zatražiti smanjenje stanarine ako ne možemo stan koristiti na adekvatan način.
6. U slučaju kašnjenja s plaćanjem, stanodavac nema pravo potraživati kamate.
7. Radnje koje život u stanu čine ugodnijim i ukusnijim ne spadaju u nedozvoljene preinake stana.
8. Promjene nastale normalnim korištenjem stanari nisu dužni sanirati.
9. Tempo obilaska stana najmodavca treba regulirati ugovorom. Najmodavac nema pravo "banuti na vrata", piše Bauštela.hr .
