Na temelju dosadašnje sudske prakse možemo sa sigurnošću utvrditi da potraživanja fizičkih i pravnih osoba za leasing ugovore s nezakonito ugovorenim kamatama i naknadama nisu u zastari, dok potrošači s ugovorenim CHF leasingom imaju pravo i na tečajne razlike, poručuju iz Udruge Franak.

Navode kako imaju najnoviji primjer gdje je u presudi Trgovačkog suda u Zagrebu od 19. svibnja 2023., po sutkinji Ljiljani Tomić, utvrđena ništetnost ugovorene odredbe o visini kamatne stope u čak trima ugovorima o financijskom leasingu s valutnom klauzulom u francima koje je OTP Leasing ugovorio s istom pravnom osobom.

Na temelju utvrđene ništetnosti odredbe o promjeni kamatne stope, OTP Leasing mora vratiti ukupno oko 6.500 eura uz pripadajuće zatezne kamate odnosno ukupno oko 13.000 eura.

Prije toga je, pojašnjavaju, Mercedes Benz Leasing na temelju nezakonitih odredaba iz ugovora o poslovnom najmu već isplatio tužitelju ukupno 9.000 eura preplaćenih kamata i pripadajućih zateznih kamata na temelju dviju pravomoćnih presuda koje je ishodovao odvjetnik Igor Metelko.

Budući da se radi o poslovnim ugovorima, nažalost nije utvrđena ništetnost valutne klauzule u francima, jer sudovi u Hrvatskoj nisu shvatili da je ugovorna odredba o valutnoj klauzuli u švicarcima ništetna i za pravne osobe, za razliku od njemačkih sudova koji ne rade razliku između potrošača i pravnih osoba po tom pitanju.

No, leasing kuće, ističu, pokušale su umanjiti svoje nesavjesno i nezakonito poslovanje tvrdeći da su preplaćene kamate odnosno naknade, unatoč utvrđenju HANFA-e u zastari.

Te sudske presude, među nekoliko desetaka takvih presuda, dokaz su da zastare nema. Naime, leasing kuće su u gotovo svim ugovorima ugovarale s jedne strane maržu i promjenjivi parametar, a s druge strane dodatno su se osiguravale odredbom kako će se kamata odnosno naknada mijenjati odlukom vjerovnika. Ta druga, za vjerovnika zaštitna odredba nezakonita je i zbog toga ništetna te utvrđenjem ništetnosti zastarni rok potraživanja počinje teći tek pravomoćnošću toga sudskog utvrđenja, navode u Udruzi Franak.

Drugim riječima, velika većina korisnika leasinga jednako kao korisnici kredita ima pravo na preplaćene iznose kamata, ili naknada, bez obzira radi li se o ugovorima u švicarcima, eurima ili kunama.

Ako se radi o potrošačkim ugovorima, a to su svi leasing ugovori fizičkih osoba za vlastite potrebe, onda je u takvim ugovorima ništetna i valutna klauzula u švicarcima, što znači da je njihovo obeštećenje daleko veće, budući da potrošači imaju pravo i na razliku tečaja, i na razliku kamata odnosno naknada, pojašnjavaju nadalje.

-Ogromni su repovi nezakonita i nesavjesnog poslovanja banaka i leasing kuća u Hrvatskoj, moglo bi se reći da je to epidemija koja nije zaliječena, i koja može biti zaliječena samo ako banke i leasing kuće vrate ono što su neosnovano stekle, i pritom plate pripadajuće zatezne kamate, a radi se o stotinama milijuna eura koji su nezakonito oteti i potrošačima, i pravnim osobama putem leasing ugovora - navode u Franku.

-Pravnim i fizičkim osobama ne preostaje drugo nego da se raspitaju o svojim pravima i tuže bivše vjerovnike zbog izvršene pljačke. Izvršnu vlast, kao što smo već navikli, to uopće ne zanima. Umjesto da se izvršna vlast time pozabavi, da pokrene kazneni progon protiv nesavjesnih vjerovnika i time omogući njihovo kažnjavanje, ali i naloži vraćanje novca koji pripada hrvatskim građanima i pravnim osobama, hrvatska izvršna vlast poslovično šuti i "ne bi se štelamešat". Zbog toga, svatko se mora sam pobrinuti o svojim pravima - ističu u Udruzi Franak.

Na temelju dosadašnje sudske prakse možemo sa sigurnošću utvrditi da potraživanja fizičkih i pravnih osoba za leasing ugovore s nezakonito ugovorenim kamatama i naknadama nisu u zastari, dok potrošači s ugovorenim CHF leasingom imaju pravo i na tečajne razlike, poručuju iz Udruge Franak.

Navode kako imaju najnoviji primjer gdje je u presudi Trgovačkog suda u Zagrebu od 19. svibnja 2023., po sutkinji Ljiljani Tomić, utvrđena ništetnost ugovorene odredbe o visini kamatne stope u čak trima ugovorima o financijskom leasingu s valutnom klauzulom u francima koje je OTP Leasing ugovorio s istom pravnom osobom.

Na temelju utvrđene ništetnosti odredbe o promjeni kamatne stope, OTP Leasing mora vratiti ukupno oko 6.500 eura uz pripadajuće zatezne kamate odnosno ukupno oko 13.000 eura.

Prije toga je, pojašnjavaju, Mercedes Benz Leasing na temelju nezakonitih odredaba iz ugovora o poslovnom najmu već isplatio tužitelju ukupno 9.000 eura preplaćenih kamata i pripadajućih zateznih kamata na temelju dviju pravomoćnih presuda koje je ishodovao odvjetnik Igor Metelko.

Budući da se radi o poslovnim ugovorima, nažalost nije utvrđena ništetnost valutne klauzule u francima, jer sudovi u Hrvatskoj nisu shvatili da je ugovorna odredba o valutnoj klauzuli u švicarcima ništetna i za pravne osobe, za razliku od njemačkih sudova koji ne rade razliku između potrošača i pravnih osoba po tom pitanju.

No, leasing kuće, ističu, pokušale su umanjiti svoje nesavjesno i nezakonito poslovanje tvrdeći da su preplaćene kamate odnosno naknade, unatoč utvrđenju HANFA-e u zastari.

Te sudske presude, među nekoliko desetaka takvih presuda, dokaz su da zastare nema. Naime, leasing kuće su u gotovo svim ugovorima ugovarale s jedne strane maržu i promjenjivi parametar, a s druge strane dodatno su se osiguravale odredbom kako će se kamata odnosno naknada mijenjati odlukom vjerovnika. Ta druga, za vjerovnika zaštitna odredba nezakonita je i zbog toga ništetna te utvrđenjem ništetnosti zastarni rok potraživanja počinje teći tek pravomoćnošću toga sudskog utvrđenja, navode u Udruzi Franak.

Drugim riječima, velika većina korisnika leasinga jednako kao korisnici kredita ima pravo na preplaćene iznose kamata, ili naknada, bez obzira radi li se o ugovorima u švicarcima, eurima ili kunama.

Ako se radi o potrošačkim ugovorima, a to su svi leasing ugovori fizičkih osoba za vlastite potrebe, onda je u takvim ugovorima ništetna i valutna klauzula u švicarcima, što znači da je njihovo obeštećenje daleko veće, budući da potrošači imaju pravo i na razliku tečaja, i na razliku kamata odnosno naknada, pojašnjavaju nadalje.

-Ogromni su repovi nezakonita i nesavjesnog poslovanja banaka i leasing kuća u Hrvatskoj, moglo bi se reći da je to epidemija koja nije zaliječena, i koja može biti zaliječena samo ako banke i leasing kuće vrate ono što su neosnovano stekle, i pritom plate pripadajuće zatezne kamate, a radi se o stotinama milijuna eura koji su nezakonito oteti i potrošačima, i pravnim osobama putem leasing ugovora - navode u Franku.

-Pravnim i fizičkim osobama ne preostaje drugo nego da se raspitaju o svojim pravima i tuže bivše vjerovnike zbog izvršene pljačke. Izvršnu vlast, kao što smo već navikli, to uopće ne zanima. Umjesto da se izvršna vlast time pozabavi, da pokrene kazneni progon protiv nesavjesnih vjerovnika i time omogući njihovo kažnjavanje, ali i naloži vraćanje novca koji pripada hrvatskim građanima i pravnim osobama, hrvatska izvršna vlast poslovično šuti i "ne bi se štelamešat". Zbog toga, svatko se mora sam pobrinuti o svojim pravima - ističu u Udruzi Franak.

Leasing obeštećenja nisu u zastari, leasing kuće u nekoliko sudskih presuda osuđene na vraćanje novca
