Bivši potpredsjednik Vlade i predsjednik HDZ-a Tomislav Karamarko u utorak nije bio dostupan za komentar presude zagrebačkog Upravnog suda koji je dan ranije potvrdio lipanjsku odluku Povjerenstva za odlučivanje o sukobu interesa prema kojoj je Karamarko bio u sukobu interesa zbog poslovnih i prijateljskih odnosa sa savjetnikom MOL-a Josipom Petrovićem.
Glasnogovornica Upravnog suda, sutkinja Tamara Bogdanović, potvrdila je da je odbijen Karamarkov tužbeni zahtjev za poništavanje odluke Povjerenstva za sukoba interesa.
Sud je zaključio da je odluka Povjerenstva bila zakonita odnosno da je Karamarko kao potpredsjednik Vlade bio u sukobu interesa. Na odluku suda Karamarko ima pravo žalbe o kojoj će odlučivati Visoki upravni sud.
Kada je nakon odluke Povjerenstva o tzv. aferi Drimia podnio ostavku na mjesto prvog potpredsjednika Vlade i najavio sudsku tužbu Karamarko je odluku nazvao "napola nakaradnom", navodeći da podsjeća na verbalni delikt i da je "isforsirana pritiskom".
Povjerenstvo za odlučivanje o sukobu interesa je 15. lipnja zaključilo da je Karamarko u sukobu interesa jer njegovi privatni interesi mogu utjecati na nepristranost u obavljanju javne dužnosti, kao i da zbog potencijalnog sukoba interesa ne može sudjelovati u donošenju odluka vezanih uz Inu i arbitražne postupke između Hrvatske i MOL-a.
"Iznošenjem osobnih stavova i prijedloga kojima se zalagao za povlačenje Hrvatske iz arbitražnih postupaka koji se vode između Hrvatske i MOL-a, osobito na sastanku Vijeća za suradnju održanom 5. svibnja 2016. godine, između predstavnika Domoljubne koalicije i Mosta, dužnosnik Tomislav Karamarko bio je u sukobu interesa", stoji u odluci Povjerenstva.
Sukob interesa Povjerenstvo je utvrdilo temeljem članka 2. Zakona o sprječavanju sukoba interesa, koji navodi da sukob interesa dužnosnika postoji ako je njegov privatni interes u suprotnosti s javnim, a posebice kada taj privatni interes može utjecati na nepristranost u obavljanju javne dužnosti.
Povjerenstvo je utvrđivalo je li Karamarko u sukobu interesa jer je tvrtka njegove supruge dvije godine imala ugovor s tvrtkom Josipa Petrovića "Peritus savjetovanja“ u razdoblju nakon dolaska Karamarka na čelo HDZ-a, a prije njegova dolaska u Banske dvore te zbog toga što je u prijateljskim odnosima s Petrovićem, zastupnikom i savjetnikom MOL-a s kojim je Hrvatska zbog Ine u dva postupka arbitraže.

Bivši potpredsjednik Vlade i predsjednik HDZ-a Tomislav Karamarko u utorak nije bio dostupan za komentar presude zagrebačkog Upravnog suda koji je dan ranije potvrdio lipanjsku odluku Povjerenstva za odlučivanje o sukobu interesa prema kojoj je Karamarko bio u sukobu interesa zbog poslovnih i prijateljskih odnosa sa savjetnikom MOL-a Josipom Petrovićem.
Glasnogovornica Upravnog suda, sutkinja Tamara Bogdanović, potvrdila je da je odbijen Karamarkov tužbeni zahtjev za poništavanje odluke Povjerenstva za sukoba interesa.
Sud je zaključio da je odluka Povjerenstva bila zakonita odnosno da je Karamarko kao potpredsjednik Vlade bio u sukobu interesa. Na odluku suda Karamarko ima pravo žalbe o kojoj će odlučivati Visoki upravni sud.
Kada je nakon odluke Povjerenstva o tzv. aferi Drimia podnio ostavku na mjesto prvog potpredsjednika Vlade i najavio sudsku tužbu Karamarko je odluku nazvao "napola nakaradnom", navodeći da podsjeća na verbalni delikt i da je "isforsirana pritiskom".
Povjerenstvo za odlučivanje o sukobu interesa je 15. lipnja zaključilo da je Karamarko u sukobu interesa jer njegovi privatni interesi mogu utjecati na nepristranost u obavljanju javne dužnosti, kao i da zbog potencijalnog sukoba interesa ne može sudjelovati u donošenju odluka vezanih uz Inu i arbitražne postupke između Hrvatske i MOL-a.
"Iznošenjem osobnih stavova i prijedloga kojima se zalagao za povlačenje Hrvatske iz arbitražnih postupaka koji se vode između Hrvatske i MOL-a, osobito na sastanku Vijeća za suradnju održanom 5. svibnja 2016. godine, između predstavnika Domoljubne koalicije i Mosta, dužnosnik Tomislav Karamarko bio je u sukobu interesa", stoji u odluci Povjerenstva.
Sukob interesa Povjerenstvo je utvrdilo temeljem članka 2. Zakona o sprječavanju sukoba interesa, koji navodi da sukob interesa dužnosnika postoji ako je njegov privatni interes u suprotnosti s javnim, a posebice kada taj privatni interes može utjecati na nepristranost u obavljanju javne dužnosti.
Povjerenstvo je utvrđivalo je li Karamarko u sukobu interesa jer je tvrtka njegove supruge dvije godine imala ugovor s tvrtkom Josipa Petrovića "Peritus savjetovanja“ u razdoblju nakon dolaska Karamarka na čelo HDZ-a, a prije njegova dolaska u Banske dvore te zbog toga što je u prijateljskim odnosima s Petrovićem, zastupnikom i savjetnikom MOL-a s kojim je Hrvatska zbog Ine u dva postupka arbitraže.
