Sa svakim novim korakom u aferi "softver", DORH i USKOK sve više tonu.

Prvo su odugovlačili s pokretanjem istrage protiv bivše ministrice i Plenkovićeve miljenice Gabrijele Žalac, držeći predmet u limbu, tako da ne bude „ni živ ni mrtav“.

Potpuno su ignorirali navode tvrtke Enel-Split koja je još 2018. posumnjala – i o tome obavijestila nadležne - u namještanje natječaja i milijunsku štetu za državni proračun. Ni DORH ni USKOK potom nisu obavijestili Ured europskog javnog tužitelja u Hrvatskoj, a to je potvrdila i europska tužiteljica Tamara Laptoš, da postoji sumnja u makinacije sa sredstvima iz EU fondova u koje je bila uključena članica Predsjedništva HDZ-a. Što su, s obzirom na to da je riječ o europskom novcu, bili dužni učiniti.

A onda su se, kako je to ovih dana otkrio tjednik Nacional, oglušili na prijedlog Samostalnog sektora za otkrivanje poreznih prijevara, tzv. „poreznog Uskoka“ da naprave vještačenje koje bi potvrdilo ili otklonilo sumnje u pranje novca.

Takav niz propusta čini se doista nevjerojatan da bi bio slučajan.

- Jednom riječju sve mi ovo izgleda prilično zbunjujuće. Možda je pregrubo reći da je čitava stvar problematična i treba vidjeti što se tu doista „iza brijega valja“. Ispada da je USKOK „zaboravio“ na ovaj predmet jer nakon izvida mora uslijediti državno-odvjetnička odluka. Ovdje te odluke nije bilo – kaže nam poznati splitski odvjetnik Branko Šerić, podsjećajući da su se, paralelno sa slučajem Gabrijele Žalac, DORH i USKOK našli na udaru kritika i zbog povlačenja optužnice u slučaju Agrokor.

- Doista se rijetko događa da Državno odvjetništvo ili USKOK povlače optužnicu. Je li optužnica bila ishitrena, neutemeljena, radi li se o potencijalnom sukobu interesa koji problematizira Visoki kazneni sud to ostaje vidjeti. U predmetima gospodarskog kriminala mora tijekom istrage biti obavljeno vještačenje. Moj je stav da je nažalost u Hrvatskoj mali broj financijskih vještaka forenzičara koji znaju slijediti trag novca, kao što psi znaju slijediti trag krvi pa dođu do leša.

Slijedeći trag novca dolazimo i do motiva zbog kojega je neko kazneno djelo iz gospodarskog kriminala i počinjeno. Događa nam se da vještaci rade po narudžbi DORH-a i USKOK-a, a ne po njihovu nalogu. Žele se jednostavno svidjeti DORH-u jer bi htjeli i dalje vještačiti i onda dolazi do problema u mnogim predmetima, pa tako i u slučaju Agrokor – smatra Šerić.

Koristeći za vještačenje tvrtku koja je bila na platnom popisu privremene uprave u Agrokoru – a koja je protiv Ivice Todorića i njegovih suradnika i podnijela kaznenu prijavu zbog gospodarskog kriminala – DORH je u pitanje doveo svoj kredibilitet. No u slučaju Žalac riječ je o nečem puno opasnijem. O mogućem političkom utjecaju na tužiteljstvo i tužitelje.

Pitanje svih pitanja je - jesu li u DORH-u i USKOK-u namjerno zažmirili na postupke Gabrijele Žalac u aferi "softver". Jesu li se autocenzurirali kada su vidjeli da slučaj vodi do osobe u samom vrhu HDZ-a. Ili su naprosto spori, tromi i inertni kao što to institucije u Hrvatskoj često znaju biti.

Državno odvjetništvo i USKOK su, naravno, u čitavom nizu slučajeva proveli kvalitetne istrage i krupne ribe strpali iza rešetaka. Bivši hrvatski premijer Ivo Sanader ima pravomoćnu presudu za korupciju. HDZ kao politička stranka također. Osuđen je čak i Zdravko Mamić, što je u zemlji premreženoj interesima pravi podvig. Procesi se vode protiv bivše SDP-ove županice Marine Lovrić Merzel, predsjednika HGK Nadana Vidoševića i Petra Pripuza. Podignuta je optužnica protiv bivšeg HDZ-ova ministra Lovre Kuščevića, istraga se vodi protiv nekadašnjih gradonačelnika Velike Gorice Danijela Barišića (HDZ) i Čakovca Stjepana Kovača (SDP), gradonačelnika Nove Gradiške Vinka Grgića, te bivšeg međimurskog župana Matije Posavca.

Ipak, sumnje u taktiziranje tužitelja uvijek su pratile pojedine zvučne slučajeve. Otvorenim tako ostaje pitanje zašto se Milana Bandića zbog izvlačenja novca na adventskim kućicama nije privelo kada je bio na vrhuncu moći – i kada je o njemu ovisila većina u Saboru, kao i HDZ-ovo sudjelovanje na vlasti u Zagrebu – nego se sa hapšenjima krenulo tek godinu dana kasnije. Kada je zagrebački gradonačelnik već bio pokojni, i kada su u mrežu USKOK-a mogle upasti sam sitne ribe.

Dugo im je trebalo i da pokrenu izvide vezane uz Projekt Slavonija, Baranja i Srijem, kroz kojega su milijuni iz EU fondova umjesto za pomoć pauperiziranoj regiji završavali u džepovima HDZ-ovaca i njihovih obitelji. A javnost ništa ne zna ni što je sa izvidima vezanima uz druge HDZ-ove moćnike. Gorana Marića i Tomislava Tolušića primjerice.

Bura koju je izazvao slučaj Žalac tolika je da je teško očekivati da DORH i USKOK prođu lišo. Glavna državna odvjetnica Zlata Hrvoj Šipek teško da će dati ostavku. Jedan od mogućnosti je i da istu zatraži od ravnateljice USKOK-a Vanje Marušić. Lako je pozvati se na njezinu izravnu odgovornost za propuste u ovome predmetu.

To međutim neće riješiti problem. Jer ako je politika doista kumovala odluci da se ne ide u istragu protiv Žalac – za što postoji sumnja, ali još uvijek ne i dokazi – problem je puno širi od imena Vanje Marušić. I ostat će i nakon što ona ode sa svoje funkcije.

Sa svakim novim korakom u aferi "softver", DORH i USKOK sve više tonu.

Prvo su odugovlačili s pokretanjem istrage protiv bivše ministrice i Plenkovićeve miljenice Gabrijele Žalac, držeći predmet u limbu, tako da ne bude „ni živ ni mrtav“.

Potpuno su ignorirali navode tvrtke Enel-Split koja je još 2018. posumnjala – i o tome obavijestila nadležne - u namještanje natječaja i milijunsku štetu za državni proračun. Ni DORH ni USKOK potom nisu obavijestili Ured europskog javnog tužitelja u Hrvatskoj, a to je potvrdila i europska tužiteljica Tamara Laptoš, da postoji sumnja u makinacije sa sredstvima iz EU fondova u koje je bila uključena članica Predsjedništva HDZ-a. Što su, s obzirom na to da je riječ o europskom novcu, bili dužni učiniti.

A onda su se, kako je to ovih dana otkrio tjednik Nacional, oglušili na prijedlog Samostalnog sektora za otkrivanje poreznih prijevara, tzv. „poreznog Uskoka“ da naprave vještačenje koje bi potvrdilo ili otklonilo sumnje u pranje novca.

Takav niz propusta čini se doista nevjerojatan da bi bio slučajan.

- Jednom riječju sve mi ovo izgleda prilično zbunjujuće. Možda je pregrubo reći da je čitava stvar problematična i treba vidjeti što se tu doista „iza brijega valja“. Ispada da je USKOK „zaboravio“ na ovaj predmet jer nakon izvida mora uslijediti državno-odvjetnička odluka. Ovdje te odluke nije bilo – kaže nam poznati splitski odvjetnik Branko Šerić, podsjećajući da su se, paralelno sa slučajem Gabrijele Žalac, DORH i USKOK našli na udaru kritika i zbog povlačenja optužnice u slučaju Agrokor.

- Doista se rijetko događa da Državno odvjetništvo ili USKOK povlače optužnicu. Je li optužnica bila ishitrena, neutemeljena, radi li se o potencijalnom sukobu interesa koji problematizira Visoki kazneni sud to ostaje vidjeti. U predmetima gospodarskog kriminala mora tijekom istrage biti obavljeno vještačenje. Moj je stav da je nažalost u Hrvatskoj mali broj financijskih vještaka forenzičara koji znaju slijediti trag novca, kao što psi znaju slijediti trag krvi pa dođu do leša.

Slijedeći trag novca dolazimo i do motiva zbog kojega je neko kazneno djelo iz gospodarskog kriminala i počinjeno. Događa nam se da vještaci rade po narudžbi DORH-a i USKOK-a, a ne po njihovu nalogu. Žele se jednostavno svidjeti DORH-u jer bi htjeli i dalje vještačiti i onda dolazi do problema u mnogim predmetima, pa tako i u slučaju Agrokor – smatra Šerić.

Koristeći za vještačenje tvrtku koja je bila na platnom popisu privremene uprave u Agrokoru – a koja je protiv Ivice Todorića i njegovih suradnika i podnijela kaznenu prijavu zbog gospodarskog kriminala – DORH je u pitanje doveo svoj kredibilitet. No u slučaju Žalac riječ je o nečem puno opasnijem. O mogućem političkom utjecaju na tužiteljstvo i tužitelje.

Pitanje svih pitanja je - jesu li u DORH-u i USKOK-u namjerno zažmirili na postupke Gabrijele Žalac u aferi "softver". Jesu li se autocenzurirali kada su vidjeli da slučaj vodi do osobe u samom vrhu HDZ-a. Ili su naprosto spori, tromi i inertni kao što to institucije u Hrvatskoj često znaju biti.

Državno odvjetništvo i USKOK su, naravno, u čitavom nizu slučajeva proveli kvalitetne istrage i krupne ribe strpali iza rešetaka. Bivši hrvatski premijer Ivo Sanader ima pravomoćnu presudu za korupciju. HDZ kao politička stranka također. Osuđen je čak i Zdravko Mamić, što je u zemlji premreženoj interesima pravi podvig. Procesi se vode protiv bivše SDP-ove županice Marine Lovrić Merzel, predsjednika HGK Nadana Vidoševića i Petra Pripuza. Podignuta je optužnica protiv bivšeg HDZ-ova ministra Lovre Kuščevića, istraga se vodi protiv nekadašnjih gradonačelnika Velike Gorice Danijela Barišića (HDZ) i Čakovca Stjepana Kovača (SDP), gradonačelnika Nove Gradiške Vinka Grgića, te bivšeg međimurskog župana Matije Posavca.

Ipak, sumnje u taktiziranje tužitelja uvijek su pratile pojedine zvučne slučajeve. Otvorenim tako ostaje pitanje zašto se Milana Bandića zbog izvlačenja novca na adventskim kućicama nije privelo kada je bio na vrhuncu moći – i kada je o njemu ovisila većina u Saboru, kao i HDZ-ovo sudjelovanje na vlasti u Zagrebu – nego se sa hapšenjima krenulo tek godinu dana kasnije. Kada je zagrebački gradonačelnik već bio pokojni, i kada su u mrežu USKOK-a mogle upasti sam sitne ribe.

Dugo im je trebalo i da pokrenu izvide vezane uz Projekt Slavonija, Baranja i Srijem, kroz kojega su milijuni iz EU fondova umjesto za pomoć pauperiziranoj regiji završavali u džepovima HDZ-ovaca i njihovih obitelji. A javnost ništa ne zna ni što je sa izvidima vezanima uz druge HDZ-ove moćnike. Gorana Marića i Tomislava Tolušića primjerice.

Bura koju je izazvao slučaj Žalac tolika je da je teško očekivati da DORH i USKOK prođu lišo. Glavna državna odvjetnica Zlata Hrvoj Šipek teško da će dati ostavku. Jedan od mogućnosti je i da istu zatraži od ravnateljice USKOK-a Vanje Marušić. Lako je pozvati se na njezinu izravnu odgovornost za propuste u ovome predmetu.

To međutim neće riješiti problem. Jer ako je politika doista kumovala odluci da se ne ide u istragu protiv Žalac – za što postoji sumnja, ali još uvijek ne i dokazi – problem je puno širi od imena Vanje Marušić. I ostat će i nakon što ona ode sa svoje funkcije.
