Konzultacijski sastanak koji se trebao održati na Općinskom sudu u Splitu kako bi se dogovorio ponovni pokušaj predaje Cesarea Avenatija (8) ocu Talijanu Alessandru Avenatiju odgođen je.

Naime, iz iz Centra za socijalnu skrb Split nitko iz stručnog tima ne može pristupiti na ročište u petak, a, osim toga, sud nije na vrijeme uspio naći prevoditelja. Stoga je odlučeno da se sastanak odgodi za početak studenoga.

Konzultacijski sastanak sazvan je sukladno Pravilniku o postupanju i suradnji suca, stručnog radnika CZSS-a i policijskog službenika za mladež prilikom prisilnog oduzimanja i predaje djeteta koji je donesen prošle godine. Upravo stoga su od rujna prošle godine - kad se majka dječaka Nina Kuluz predala policiji nakon pet godina bijega sa sinom, i od kada je određeno provođenje ovrhe - održana dva konzultacijska sastanka. Nakon toga je pokušana ovrha krajem lipnja ove godine, ali nije provedena.

Majka je zatražila od Općinskog suda u Splitu izmjenu odluke o vraćanju Cesarea u Italiju, što je određeno sukladno Haaškoj konvenciji o građanskopravnim aspektima međunarodne otmice djece. Prijedlog je početkom rujna ove godine odbijen kao nedopušten, a odbijen je i zahtjev za odgodom ovrhe. Zatim je početkom listopada nepravomoćno osuđena na talijanskom sudu na tri godine i četiri mjeseca zatvora zbog ilegalnog odvođenja djeteta iz Italije. Osim toga joj je sud potpuno oduzeo roditeljsku skrb, dok je dotad odlukom Obiteljskog suda u Torinu iz 2012. godine imala pravo na zajedničku skrb s ocem Alessandrom Avenatijem.

Sve to je više od godine dana od predaje Nine Kuluz i četiri mjeseca od prve neuspjele ovrhe nagnalo sud da ponovno pokuša. Za petak je zakazan konzultacijski sastanak, treći po redu na kojem se trebala dogovoriti strategija postupanja. Na sastanak su pozvani dječakova majka i otac, odvjetnici koji ih zastupaju te predstavnici policije i CZSS-a Split. Početkom ovog tjedna iz CZSS-a su usmeno obavijestili nadležnu sutkinju kako nitko od stručnog tima nije u mogućnosti pristupiti zbog bolovanja i seminara. Osim izostanka nadležnog socijalnog radnika, sutkinja je imala problema i s pronalaženjem sudskog tumača za talijanski jezik jer su svi redom odbijali angažman.

S obzirom na osjetljivost situacije i burne rekacije nakon svake odluke u slučaju ne čudi što se u CZSS-u Split nije našao nitko da zamijeni odsutne kolegice te što većina tumača odbija angažman. U konačnici sutkinja je uspjela pronaći sudskog tumača voljnog da odradi nezahvalan zadatak te je odgodila sastanak za početak studenog, do kada se očekuje i povratak odsutnih stručnjaka iz CZSS-a Split.

Konzultacijski sastanak koji se trebao održati na Općinskom sudu u Splitu kako bi se dogovorio ponovni pokušaj predaje Cesarea Avenatija (8) ocu Talijanu Alessandru Avenatiju odgođen je.

Naime, iz iz Centra za socijalnu skrb Split nitko iz stručnog tima ne može pristupiti na ročište u petak, a, osim toga, sud nije na vrijeme uspio naći prevoditelja. Stoga je odlučeno da se sastanak odgodi za početak studenoga.

Konzultacijski sastanak sazvan je sukladno Pravilniku o postupanju i suradnji suca, stručnog radnika CZSS-a i policijskog službenika za mladež prilikom prisilnog oduzimanja i predaje djeteta koji je donesen prošle godine. Upravo stoga su od rujna prošle godine - kad se majka dječaka Nina Kuluz predala policiji nakon pet godina bijega sa sinom, i od kada je određeno provođenje ovrhe - održana dva konzultacijska sastanka. Nakon toga je pokušana ovrha krajem lipnja ove godine, ali nije provedena.

Majka je zatražila od Općinskog suda u Splitu izmjenu odluke o vraćanju Cesarea u Italiju, što je određeno sukladno Haaškoj konvenciji o građanskopravnim aspektima međunarodne otmice djece. Prijedlog je početkom rujna ove godine odbijen kao nedopušten, a odbijen je i zahtjev za odgodom ovrhe. Zatim je početkom listopada nepravomoćno osuđena na talijanskom sudu na tri godine i četiri mjeseca zatvora zbog ilegalnog odvođenja djeteta iz Italije. Osim toga joj je sud potpuno oduzeo roditeljsku skrb, dok je dotad odlukom Obiteljskog suda u Torinu iz 2012. godine imala pravo na zajedničku skrb s ocem Alessandrom Avenatijem.

Sve to je više od godine dana od predaje Nine Kuluz i četiri mjeseca od prve neuspjele ovrhe nagnalo sud da ponovno pokuša. Za petak je zakazan konzultacijski sastanak, treći po redu na kojem se trebala dogovoriti strategija postupanja. Na sastanak su pozvani dječakova majka i otac, odvjetnici koji ih zastupaju te predstavnici policije i CZSS-a Split. Početkom ovog tjedna iz CZSS-a su usmeno obavijestili nadležnu sutkinju kako nitko od stručnog tima nije u mogućnosti pristupiti zbog bolovanja i seminara. Osim izostanka nadležnog socijalnog radnika, sutkinja je imala problema i s pronalaženjem sudskog tumača za talijanski jezik jer su svi redom odbijali angažman.

S obzirom na osjetljivost situacije i burne rekacije nakon svake odluke u slučaju ne čudi što se u CZSS-u Split nije našao nitko da zamijeni odsutne kolegice te što većina tumača odbija angažman. U konačnici sutkinja je uspjela pronaći sudskog tumača voljnog da odradi nezahvalan zadatak te je odgodila sastanak za početak studenog, do kada se očekuje i povratak odsutnih stručnjaka iz CZSS-a Split.
