Osim što je optužnicu dva puta vratio na doradu Županijski sud je u ožujku ukinuo prvu točku optužnice kojom su se bivši čelnici HPB-a Protega, Ivan Sladonja i Mario Kirninić te osmorica povlaštenih klijenata teretila za udruživanje za počinjenje kaznenih djela.

Vrhovni je sud, međutim, nakon USKOK-ove žalbe zauzeo stav da je optužnica valjana te da odluku o tome jesu li se optuženi udružili treba donijeti sudsko vijeće nakon provedenog postupka.

Riječ je o prvoj optužnici o čijoj je valjanosti raspravljao Vrhovni sud.

Odlukom Vrhovnog suda optužnica se vraća optužnom vijeću zagrebačkog Županijskog suda radi sastavljanja raspravnog spisa odnosno odluke koji će dokazi i dokumenti ući u spis, pojasnio je glasnogovornik Županijskog suda Krešimir Devčić.

Nakon toga zakazat će se pripremno ročište na kojem će se, među ostalim, zakazati datum početka suđenja u ovom slučaju.

Bivše čelnike Hrvatske poštanske banke USKOK tereti da su od 2005. do 2009. oštetili banku za najmanje 255 milijuna kuna jer su davali visokorizične kredite koji nisu vraćeni banci. Terete ih i za dodatnu štetu od 26 milijuna kuna zbog isplate menadžerskih bonusa, od čega su međusobno navodno podijelili više od 13 milijuna kuna.

Obrana je ranije tvrdila da optuženi nisu počinili nikakvo kazneno djelo te da je riječ o klasičnom građansko-pravnom odnos između klijenata i banke koja je, suprotno optužbama USKOK-a, osigurala naplatu svojih potraživanja. Uz to su isticali i da je USKOK zakasnio s podizanjem optužnice, no Županijski je sud to odbacio, uz pojašnjenje da su zakonom propisani rokovi ponovno krenuli kada je optužnica USKOK-u prvi puta vraćena na doradu.

optužnicu protiv bivšeg direktora Hrvatske poštanske banke Josipa Protege i ostalih u slučaju "Bankomat", koju je zagrebački Županijski sud u ožujku ove godine drugi puta vratio USKOK-u na doradu.

Osim što je optužnicu dva puta vratio na doradu Županijski sud je u ožujku ukinuo prvu točku optužnice kojom su se bivši čelnici HPB-a Protega, Ivan Sladonja i Mario Kirninić te osmorica povlaštenih klijenata teretila za udruživanje za počinjenje kaznenih djela.

Vrhovni je sud, međutim, nakon USKOK-ove žalbe zauzeo stav da je optužnica valjana te da odluku o tome jesu li se optuženi udružili treba donijeti sudsko vijeće nakon provedenog postupka.

Riječ je o prvoj optužnici o čijoj je valjanosti raspravljao Vrhovni sud.

Odlukom Vrhovnog suda optužnica se vraća optužnom vijeću zagrebačkog Županijskog suda radi sastavljanja raspravnog spisa odnosno odluke koji će dokazi i dokumenti ući u spis, pojasnio je glasnogovornik Županijskog suda Krešimir Devčić.

Nakon toga zakazat će se pripremno ročište na kojem će se, među ostalim, zakazati datum početka suđenja u ovom slučaju.

Bivše čelnike Hrvatske poštanske banke USKOK tereti da su od 2005. do 2009. oštetili banku za najmanje 255 milijuna kuna jer su davali visokorizične kredite koji nisu vraćeni banci. Terete ih i za dodatnu štetu od 26 milijuna kuna zbog isplate menadžerskih bonusa, od čega su međusobno navodno podijelili više od 13 milijuna kuna.

Obrana je ranije tvrdila da optuženi nisu počinili nikakvo kazneno djelo te da je riječ o klasičnom građansko-pravnom odnos između klijenata i banke koja je, suprotno optužbama USKOK-a, osigurala naplatu svojih potraživanja. Uz to su isticali i da je USKOK zakasnio s podizanjem optužnice, no Županijski je sud to odbacio, uz pojašnjenje da su zakonom propisani rokovi ponovno krenuli kada je optužnica USKOK-u prvi puta vraćena na doradu.

Vrhovni sud potvrdio optužnicu u "slučaju Bankomat"

Vrhovni sud potvrdio je optužnicu protiv bivšeg direktora Hrvatskepoštanske banke Josipa Protege i ostalih u slučaju "Bankomat", koju jezagrebački Županijski sud u ožujku ove godine drugi puta vratio USKOK-una doradu.

Osim što je optužnicu dva puta vratio nadoradu Županijski sud je u ožujku ukinuo prvu točku optužnice kojom suse bivši čelnici HPB-a Protega, Ivan Sladonja i Mario Kirninić teosmorica povlaštenih klijenata teretila za udruživanje za počinjenjekaznenih djela.

Vrhovni je sud, međutim, nakon USKOK-ove žalbe zauzeo stav da jeoptužnica valjana te da odluku o tome jesu li se optuženi udružilitreba donijeti sudsko vijeće nakon provedenog postupka.
