Općinski sudac Domagoj Kurobasa tražio je 65 tisuća kuna od izdavača Slobodne Dalmacije tvrdeći da ga je njihov novinar Ivica Nevešćanin uvrijedio. Novinar je u tekstu, “U prvom licu: Kako sam preživio sudski mobing kojem sam osam godina bio izložen od suca Domagoja Kurobase”, opisao kako je ovaj sudac vodio postupak protiv njega zbog tužbe poduzetnika Rena Sinovčića. Kako donosi Telegram.hr Sinovčić je novinara tužio za klevetu, a sve je na kraju završeno zastarom.

Tri puta sudac Kurobasa izricao je osuđujuće presude novinaru, no sve tri pale su na višem sudu. Nakon što je postupak i četvrti put ponovljen došlo je do zastare.

Doduše, sudac Kurobasa obustavio ga je jer se Sinovčić i njegov odvjetnik nisu pojavili na ročištu sazvanom svega tri dana prije roka zastare. Zato je Sinovčićevu tužbu odbio, da bi na kraju Županijski sud u Zadru zaključio da je nastupila zastara.

Opisujući što se sve događalo tijekom tih osam godina suđenja novinar, koji je 25 godina pratio teme iz pravosuđa, ocijenio je kako je sudac Kurobasa u sudnici vodio svoj privatni obračun s njim. Tako mu, primjerice, nije dao da iznese cijelu obranu tvrdeći da vrijeđa neke osobe. To je, ispostavit će kasnije, bila sučeva greška zbog koje je prva osuđujuća presuda Nevešćaninu ukinuta.

I u druge dvije osuđujuće presude sudac Kurobasa je, prema stavu višeg suda, napravio pogreške. Naime, nije dao dovoljnu važnost iskazima svjedoka koje je tijekom suđenja novinaru ispitao. Zbog toga, naveo je viši sud, nije dobro utvrdio sve činjenice, odnosno sve ono što je išlo u korist Nevešćaninu protiv optužbi za klevetu.

Naime, svi ti svjedoci redom su opisivali Sinovčićevu nekadašnju moć, spominjući čak i medijski reket kojem je pribjegavao budući da je bio vlasnik više medija. Upravo zbog tvrdnji o medijskom reketu u jednom Nevešćaninovom tekstu Sinovčić ga je tužio za klevetu, donosi Telegram.hr

“Postojanje medijskog reketa nije konstrukcija Ivice Nevešćanina, nije napisana isključivo s namjerom klevete Rena Sinovčića, već je on kao novinar u to mogao povjerovati, jer se spominjalo u nekoliko javnih medija, a utvrđeno je i pravomoćnom sudskom presudom”, navela je, među ostalim, nekadašnja Neveščaninova urednica svjedočeći na sudu. Kurobasa je, međutim, njezin iskaz ignorirao, što je Neveščanin i naveo u tekstu zbog kojeg ga je sudac onda tužio.

“Nisam ga imao namjeru time uvrijediti već sam samo analizirao njegov rad, te iznio ono što su o njegovim presudama u mom slučaju, rekli viši sudovi”, izjavio je novinar tijekom suđenja.

Sudac imao problema zbog teksta

Sudac je pak opisao kako je zbog teksta Ivice Nevešćanina imao golemih problema.

“Sa mnom su se povezivali mobing i pravosudni pakao, čime me se klevetalo i vrijeđalo i privatno i poslovno. Uvjeravao je kako nije točno da je na Facebooku koristio pseudonim Pajo Patak, iako su, kako je napisao Nevešćanin, svi u Zadru to znali.

“Nisam koristio Facebook pod imenom Pajo Patak. Sve što je o meni u tom tekstu bilo napisano odrazilo se na moj privatni život i profesionalno djelovanje, posebno stoga što sam 2020. počeo raditi na Općinskom kaznenom sudu u Zagrebu”, naveo je sudac u svom iskazu žaleći se i što mu je uz tekst objavljena fotografija.

Kako donosi Telegram.hr Kurobasi je tužba nepravomoćnom presudom Općinskog građanskog suda u Zagrebu odbijena. Sud je zaključio da je novinar pisao o jednom pravosudnom slučaju, a pitanja koja se tiču “funkcioniranja pravosudnog sustava predstavljaju pitanja od općeg interesa koja uživaju zaštitu slobode izražavanja”.

“Sporni članak novinar je napisao o načinu na koji je Domagoj Kurobasa vodio postupak protiv njega. Sloboda medija se proteže i na slobodno izražavanje stavova novinara čak i u okviru područja u kojem govori o vlastitom iskustvu u sudskom postupku, pa i kad su ti stavovi kontroverzni ili nepopularni. S druge strane, suci, kada postupaju u okviru svoje dužnosti, mogu očekivati da će biti izloženi kritikama”, poručila je u presudi sutkinja Vanesa Peruzović Čuić.

Općinski sudac Domagoj Kurobasa tražio je 65 tisuća kuna od izdavača Slobodne Dalmacije tvrdeći da ga je njihov novinar Ivica Nevešćanin uvrijedio. Novinar je u tekstu, “U prvom licu: Kako sam preživio sudski mobing kojem sam osam godina bio izložen od suca Domagoja Kurobase”, opisao kako je ovaj sudac vodio postupak protiv njega zbog tužbe poduzetnika Rena Sinovčića. Kako donosi Telegram.hr Sinovčić je novinara tužio za klevetu, a sve je na kraju završeno zastarom.

Tri puta sudac Kurobasa izricao je osuđujuće presude novinaru, no sve tri pale su na višem sudu. Nakon što je postupak i četvrti put ponovljen došlo je do zastare.

Doduše, sudac Kurobasa obustavio ga je jer se Sinovčić i njegov odvjetnik nisu pojavili na ročištu sazvanom svega tri dana prije roka zastare. Zato je Sinovčićevu tužbu odbio, da bi na kraju Županijski sud u Zadru zaključio da je nastupila zastara.

Opisujući što se sve događalo tijekom tih osam godina suđenja novinar, koji je 25 godina pratio teme iz pravosuđa, ocijenio je kako je sudac Kurobasa u sudnici vodio svoj privatni obračun s njim. Tako mu, primjerice, nije dao da iznese cijelu obranu tvrdeći da vrijeđa neke osobe. To je, ispostavit će kasnije, bila sučeva greška zbog koje je prva osuđujuća presuda Nevešćaninu ukinuta.

I u druge dvije osuđujuće presude sudac Kurobasa je, prema stavu višeg suda, napravio pogreške. Naime, nije dao dovoljnu važnost iskazima svjedoka koje je tijekom suđenja novinaru ispitao. Zbog toga, naveo je viši sud, nije dobro utvrdio sve činjenice, odnosno sve ono što je išlo u korist Nevešćaninu protiv optužbi za klevetu.

Naime, svi ti svjedoci redom su opisivali Sinovčićevu nekadašnju moć, spominjući čak i medijski reket kojem je pribjegavao budući da je bio vlasnik više medija. Upravo zbog tvrdnji o medijskom reketu u jednom Nevešćaninovom tekstu Sinovčić ga je tužio za klevetu, donosi Telegram.hr

“Postojanje medijskog reketa nije konstrukcija Ivice Nevešćanina, nije napisana isključivo s namjerom klevete Rena Sinovčića, već je on kao novinar u to mogao povjerovati, jer se spominjalo u nekoliko javnih medija, a utvrđeno je i pravomoćnom sudskom presudom”, navela je, među ostalim, nekadašnja Neveščaninova urednica svjedočeći na sudu. Kurobasa je, međutim, njezin iskaz ignorirao, što je Neveščanin i naveo u tekstu zbog kojeg ga je sudac onda tužio.

“Nisam ga imao namjeru time uvrijediti već sam samo analizirao njegov rad, te iznio ono što su o njegovim presudama u mom slučaju, rekli viši sudovi”, izjavio je novinar tijekom suđenja.

Sudac imao problema zbog teksta

Sudac je pak opisao kako je zbog teksta Ivice Nevešćanina imao golemih problema.

“Sa mnom su se povezivali mobing i pravosudni pakao, čime me se klevetalo i vrijeđalo i privatno i poslovno. Uvjeravao je kako nije točno da je na Facebooku koristio pseudonim Pajo Patak, iako su, kako je napisao Nevešćanin, svi u Zadru to znali.

“Nisam koristio Facebook pod imenom Pajo Patak. Sve što je o meni u tom tekstu bilo napisano odrazilo se na moj privatni život i profesionalno djelovanje, posebno stoga što sam 2020. počeo raditi na Općinskom kaznenom sudu u Zagrebu”, naveo je sudac u svom iskazu žaleći se i što mu je uz tekst objavljena fotografija.

Kako donosi Telegram.hr Kurobasi je tužba nepravomoćnom presudom Općinskog građanskog suda u Zagrebu odbijena. Sud je zaključio da je novinar pisao o jednom pravosudnom slučaju, a pitanja koja se tiču “funkcioniranja pravosudnog sustava predstavljaju pitanja od općeg interesa koja uživaju zaštitu slobode izražavanja”.

“Sporni članak novinar je napisao o načinu na koji je Domagoj Kurobasa vodio postupak protiv njega. Sloboda medija se proteže i na slobodno izražavanje stavova novinara čak i u okviru područja u kojem govori o vlastitom iskustvu u sudskom postupku, pa i kad su ti stavovi kontroverzni ili nepopularni. S druge strane, suci, kada postupaju u okviru svoje dužnosti, mogu očekivati da će biti izloženi kritikama”, poručila je u presudi sutkinja Vanesa Peruzović Čuić.

Općinski sudac Domagoj Kurobasa tražio je 65 tisuća kuna od izdavača Slobodne Dalmacije tvrdeći da ga je njihov novinar Ivica Nevešćanin uvrijedio. Novinar je u tekstu, “U prvom licu: Kako sam preživio sudski mobing kojem sam osam godina bio izložen od suca Domagoja Kurobase”, opisao kako je ovaj sudac vodio postupak protiv njega zbog tužbe poduzetnika Rena Sinovčića. Kako donosi Telegram.hr Sinovčić je novinara tužio za klevetu, a sve je na kraju završeno zastarom.
