Prije nekoliko dana Glas Istre je objavio priču o bračnom paru iz Pule kojem je privremeno oduzeto 20-mjesečno dijete trenutno smješteno u Dječjem domu Ivana Brlić Mažuranić u Lovranu.

Zbog roditeljske nepažnje dijete je bilo vitalno ugroženo i tek mu je intervencijom liječnika stanje stabilizirano, a život spašen. Uvidom u rješenje Općinskog suda u Puli "Glas Istre" je otkrio neke do sada nepoznate činjenice o cijelom slučaju.

Roditelji su u ponovnom razgovoru za "Glas Istre" priznali većinu navoda iz rješenja temeljem kojeg im je dijete privremeno oduzeto, dok za dio tvrde da ne odgovara istini.

Podsjetimo, nakon novogodišnjeg druženja s dvoje prijatelja mladi par iz Pule ostavio je komadić tabletice ecstasyja na stolu. I, kako kažu oba roditelja, zaboravili su na to. Spletom nesretnih okolnosti doveli su u životnu opasnost svoje 20-mjesečno dijete.

Ono je, naime, pronašlo drogu i progutalo ju. Zabrinuti su roditelji pozvali hitnu pomoć te je dijete odmah hospitalizirano. Djelatnici OB Pula pozvali su policiju i roditelji su otišli na obavijesni razgovor, nakon čega ih je policija uhitila zbog osnovane sumnje da su počinili kazneno djelo - povreda djetetovih prava. Od uhićenja pa do danas roditelji nisu vidjeli svoje dijete, budući da im je ono privremeno oduzeto i smješteno u ustanovu Dom u Lovranu.

U rješenju Općinskog suda u Puli od 8. siječnja, međutim, stoji da, osim što je u krvi djeteta pronađen ecstasy, "prilikom dolaska u bolnicu majka nije navela što se točno dogodilo te je otežala liječenje djeteta, koje je u bolnicu dovedeno u teškom stanju, vitalno ugroženo".

Majka, s druge strane, tvrdi da ni ona ni suprug nisu mogli znati što je dijete uzelo da mu je tako pozlilo. Zaboravili su na taj komadić ecstasyja koji se, igrom slučaja, zagubio među osobnim stvarima na radnom stolu. Tek po uvidu u toksikološki nalaz djeteta, nastavlja se u obrazloženju suda, majka priznaje da su ona i suprug tri dana prije nemilog događaja, prilikom dočeka Nove godine, konzumirali kanabis i ecstasy, što je pokazala i njihova toksikološka obrada. Dijete je u to vrijeme bilo povjereno na čuvanje baki, majčinoj majci.

Uvidom u testove na prisutnost droga kojima su se roditelji naknadno podvrgli u Zavodu za javno zdravstvo, 12. i 27. siječnja te 3. veljače, razvidno je da su kod oboje svi nalazi bili negativni, osim prvog koji je još pokazivao prisutnost THC-a i lijekova za smirenje. Učestalim testiranjem na opijate mladi par očito želi dokazati da nisu ovisnici. Tvrde da je situacija koja se dogodila bila iznimka, a ne pravilo.

- Ovih dana učestalo vodimo razgovore s Centrom za socijalnu skrb koji, izgleda, utvrđuje naše stanje, ali i uvjete života nas i naših majki. Vjerojatno procjenjuju hoće li produžiti mjeru izdvajanja našeg sina ili neće, hoće li ga povjeriti bakama, ili pak nama. Ne znamo što im je na umu, ali se nadamo da ćemo što prije vidjeti naše dijete, ističe otac djeteta, a s njim se slaže i majka.

- Od početka nesretnog događaja surađujemo s institucijama, nerijetko našom inicijativom, te želimo učiniti sve što je potrebno da dokažemo da nismo ovisnici i da se neizmjerno kajemo zbog svega. Ne moram ni napominjati da se takvo što neće više nikada dogoditi, zaključuje majka.

"Glas Istre" se obratio pulskom Općinskom državnom odvjetništvu, Centru za socijalnu skrb koji se, međutim, do vremena pisanja ovog teksta nisu se očitovali o slučaju.

No, pravobraniteljica za djecu Helenca Pirnat Dragičević potvrdila je "Glasu Istre" da je upoznata s navedenim slučajem te da prati postupanja nadležnih institucija, ali konkretan predmet ne želi komentirati. Ona navodi da je Centar za socijalnu skrb dužan po službenoj dužnosti izreći mjeru žurnog izdvajanja djeteta i smjestiti ga u sigurno okruženje u situacijama u kojima je došlo do počinjenja kaznenog djela na štetu djeteta te su život i zdravlje djeteta bili ugroženi.

Napominje da je riječ o privremenom povjeravanju djeteta koje može trajati najdulje trideset dana, a u posebno opravdanim okolnostima sud je može produljiti za daljnjih trideset dana. Centar za socijalnu skrb dužan je najkasnije pet dana prije isteka roka izraditi obiteljsku procjenu i dostaviti je sudu s prijedlogom za donošenje druge mjere za zaštitu osobnih prava i dobrobiti djeteta, ako je to potrebno.

- Sud također može, u izvanparničnom postupku, ukinuti mjeru privremenog povjeravanja i smještaja djeteta prije isteka roka ako prestanu postojati razlozi zbog kojih je mjera određena. Važno je naglasiti da se sve institucije koje su uključene u ovakve postupke moraju u svojim postupanjima rukovoditi zaštitom najboljeg interesa djeteta, zaključuje Pirnat Dragičević.

Prije nekoliko dana Glas Istre je objavio priču o bračnom paru iz Pule kojem je privremeno oduzeto 20-mjesečno dijete trenutno smješteno u Dječjem domu Ivana Brlić Mažuranić u Lovranu.

Zbog roditeljske nepažnje dijete je bilo vitalno ugroženo i tek mu je intervencijom liječnika stanje stabilizirano, a život spašen. Uvidom u rješenje Općinskog suda u Puli "Glas Istre" je otkrio neke do sada nepoznate činjenice o cijelom slučaju.

Roditelji su u ponovnom razgovoru za "Glas Istre" priznali većinu navoda iz rješenja temeljem kojeg im je dijete privremeno oduzeto, dok za dio tvrde da ne odgovara istini.

Podsjetimo, nakon novogodišnjeg druženja s dvoje prijatelja mladi par iz Pule ostavio je komadić tabletice ecstasyja na stolu. I, kako kažu oba roditelja, zaboravili su na to. Spletom nesretnih okolnosti doveli su u životnu opasnost svoje 20-mjesečno dijete.

Ono je, naime, pronašlo drogu i progutalo ju. Zabrinuti su roditelji pozvali hitnu pomoć te je dijete odmah hospitalizirano. Djelatnici OB Pula pozvali su policiju i roditelji su otišli na obavijesni razgovor, nakon čega ih je policija uhitila zbog osnovane sumnje da su počinili kazneno djelo - povreda djetetovih prava. Od uhićenja pa do danas roditelji nisu vidjeli svoje dijete, budući da im je ono privremeno oduzeto i smješteno u ustanovu Dom u Lovranu.

U rješenju Općinskog suda u Puli od 8. siječnja, međutim, stoji da, osim što je u krvi djeteta pronađen ecstasy, "prilikom dolaska u bolnicu majka nije navela što se točno dogodilo te je otežala liječenje djeteta, koje je u bolnicu dovedeno u teškom stanju, vitalno ugroženo".

Majka, s druge strane, tvrdi da ni ona ni suprug nisu mogli znati što je dijete uzelo da mu je tako pozlilo. Zaboravili su na taj komadić ecstasyja koji se, igrom slučaja, zagubio među osobnim stvarima na radnom stolu. Tek po uvidu u toksikološki nalaz djeteta, nastavlja se u obrazloženju suda, majka priznaje da su ona i suprug tri dana prije nemilog događaja, prilikom dočeka Nove godine, konzumirali kanabis i ecstasy, što je pokazala i njihova toksikološka obrada. Dijete je u to vrijeme bilo povjereno na čuvanje baki, majčinoj majci.

Uvidom u testove na prisutnost droga kojima su se roditelji naknadno podvrgli u Zavodu za javno zdravstvo, 12. i 27. siječnja te 3. veljače, razvidno je da su kod oboje svi nalazi bili negativni, osim prvog koji je još pokazivao prisutnost THC-a i lijekova za smirenje. Učestalim testiranjem na opijate mladi par očito želi dokazati da nisu ovisnici. Tvrde da je situacija koja se dogodila bila iznimka, a ne pravilo.

- Ovih dana učestalo vodimo razgovore s Centrom za socijalnu skrb koji, izgleda, utvrđuje naše stanje, ali i uvjete života nas i naših majki. Vjerojatno procjenjuju hoće li produžiti mjeru izdvajanja našeg sina ili neće, hoće li ga povjeriti bakama, ili pak nama. Ne znamo što im je na umu, ali se nadamo da ćemo što prije vidjeti naše dijete, ističe otac djeteta, a s njim se slaže i majka.

- Od početka nesretnog događaja surađujemo s institucijama, nerijetko našom inicijativom, te želimo učiniti sve što je potrebno da dokažemo da nismo ovisnici i da se neizmjerno kajemo zbog svega. Ne moram ni napominjati da se takvo što neće više nikada dogoditi, zaključuje majka.

"Glas Istre" se obratio pulskom Općinskom državnom odvjetništvu, Centru za socijalnu skrb koji se, međutim, do vremena pisanja ovog teksta nisu se očitovali o slučaju.

No, pravobraniteljica za djecu Helenca Pirnat Dragičević potvrdila je "Glasu Istre" da je upoznata s navedenim slučajem te da prati postupanja nadležnih institucija, ali konkretan predmet ne želi komentirati. Ona navodi da je Centar za socijalnu skrb dužan po službenoj dužnosti izreći mjeru žurnog izdvajanja djeteta i smjestiti ga u sigurno okruženje u situacijama u kojima je došlo do počinjenja kaznenog djela na štetu djeteta te su život i zdravlje djeteta bili ugroženi.

Napominje da je riječ o privremenom povjeravanju djeteta koje može trajati najdulje trideset dana, a u posebno opravdanim okolnostima sud je može produljiti za daljnjih trideset dana. Centar za socijalnu skrb dužan je najkasnije pet dana prije isteka roka izraditi obiteljsku procjenu i dostaviti je sudu s prijedlogom za donošenje druge mjere za zaštitu osobnih prava i dobrobiti djeteta, ako je to potrebno.

- Sud također može, u izvanparničnom postupku, ukinuti mjeru privremenog povjeravanja i smještaja djeteta prije isteka roka ako prestanu postojati razlozi zbog kojih je mjera određena. Važno je naglasiti da se sve institucije koje su uključene u ovakve postupke moraju u svojim postupanjima rukovoditi zaštitom najboljeg interesa djeteta, zaključuje Pirnat Dragičević.

Prije nekoliko dana Glas Istre je objavio priču o bračnom paru iz Pule kojem je privremeno oduzeto 20-mjesečno dijete trenutno smješteno u Dječjem domu Ivana Brlić Mažuranić u Lovranu.

Zbog roditeljske nepažnje dijete je bilo vitalno ugroženo i tek mu je intervencijom liječnika stanje stabilizirano, a život spašen. Uvidom u rješenje Općinskog suda u Puli "Glas Istre" je otkrio neke do sada nepoznate činjenice o cijelom slučaju.

Roditelji su u ponovnom razgovoru za "Glas Istre" priznali većinu navoda iz rješenja temeljem kojeg im je dijete privremeno oduzeto, dok za dio tvrde da ne odgovara istini.

Podsjetimo, nakon novogodišnjeg druženja s dvoje prijatelja mladi par iz Pule ostavio je komadić tabletice ecstasyja na stolu. I, kako kažu oba roditelja, zaboravili su na to. ...
