Splitski odvjetnik Željko Lubina pravomoćno je osuđen na osam mjeseci zatvora koje, pak, neće odslužiti iza rešetaka ukoliko u roku od dvije godine ne počini neko novo kazneno djelo.

Lubina je osuđen zbog kaznenog djela protiv pravosuđa - davanja lažnog iskaza. Županijski sud u Zagrebu je tako na svojoj sjednici 18. veljače potvrdio prvostupanjsku presudu Općinskog suda u Splitu koja je donesena u svibnju prošle godine.

Tu nam je informaciju potvrdio i Vuko Adžić Katalinić, glasnogovornik Kaznenog odjela splitskog Općinskog suda dodajući da je o pravomoćnosti presude 3. ožujka dopisom obaviještena i Hrvatska odvjetnička komora.

Splitskog odvjetnika teretilo se optužnicom ODO-a da je 24. srpnja 2013. godine u Splitu u izvanparničnom postupku pred Trgovačkim sudom u Splitu, a koji se vodio radi upisa Odvjetničkog društva Lubina i Čutura j.t.d. u sudski registar, kao osnivač i odgovorn osoba dao izjavu i istu ovjerio pred javnim bilježnikom Teo Karabotić – Milovac.

U toj je izjavi stajalo da on niti društvo u kojem je član nema nepodmirenih dugovanja na osnovi poreza te doprinosa za mirovinsko odnosno zdravstvenom osiguranju kao ni dugovanje za neto plaće radnicima.

No, po presudi, Lubina je znao da to nije istina jer je član društva Lubina i dr. j.t.d. sa 75 % udjela u glasačkim pravima koje ima nepodmirenih dugovanja na osnovi poreza u iznosu glavnice od 4.737.560,53 kune koje se ne može naplatiti jer društvo nema imovine niti sredstava na žiro-računu zbog neprekidne blokade od 23. listopada 2007. godine.

Na temelju te potpisane izjave je Trgovački sud u Splitu 31. srpnja 2013. godine pod poslovnim brojem Tt-13/4175 donio rješenje o upisu u registar suda društva Lubina i Čutura j.t.d..

Kontaktirali smo porukom osuđenog odvjetnika za komentar presude, no iako ju je pročitao nije nam na nju odgovorio, a nije se javljao niti na telefonski poziv.

Splitski odvjetnik Željko Lubina pravomoćno je osuđen na osam mjeseci zatvora koje, pak, neće odslužiti iza rešetaka ukoliko u roku od dvije godine ne počini neko novo kazneno djelo.

Lubina je osuđen zbog kaznenog djela protiv pravosuđa - davanja lažnog iskaza. Županijski sud u Zagrebu je tako na svojoj sjednici 18. veljače potvrdio prvostupanjsku presudu Općinskog suda u Splitu koja je donesena u svibnju prošle godine.

Tu nam je informaciju potvrdio i Vuko Adžić Katalinić, glasnogovornik Kaznenog odjela splitskog Općinskog suda dodajući da je o pravomoćnosti presude 3. ožujka dopisom obaviještena i Hrvatska odvjetnička komora.

Splitskog odvjetnika teretilo se optužnicom ODO-a da je 24. srpnja 2013. godine u Splitu u izvanparničnom postupku pred Trgovačkim sudom u Splitu, a koji se vodio radi upisa Odvjetničkog društva Lubina i Čutura j.t.d. u sudski registar, kao osnivač i odgovorn osoba dao izjavu i istu ovjerio pred javnim bilježnikom Teo Karabotić – Milovac.

U toj je izjavi stajalo da on niti društvo u kojem je član nema nepodmirenih dugovanja na osnovi poreza te doprinosa za mirovinsko odnosno zdravstvenom osiguranju kao ni dugovanje za neto plaće radnicima.

No, po presudi, Lubina je znao da to nije istina jer je član društva Lubina i dr. j.t.d. sa 75 % udjela u glasačkim pravima koje ima nepodmirenih dugovanja na osnovi poreza u iznosu glavnice od 4.737.560,53 kune koje se ne može naplatiti jer društvo nema imovine niti sredstava na žiro-računu zbog neprekidne blokade od 23. listopada 2007. godine.

Na temelju te potpisane izjave je Trgovački sud u Splitu 31. srpnja 2013. godine pod poslovnim brojem Tt-13/4175 donio rješenje o upisu u registar suda društva Lubina i Čutura j.t.d..

Kontaktirali smo porukom osuđenog odvjetnika za komentar presude, no iako ju je pročitao nije nam na nju odgovorio, a nije se javljao niti na telefonski poziv.

Splitski odvjetnik Željko Lubina pravomoćno je osuđen na osam mjeseci zatvora koje, pak, neće odslužiti iza rešetaka ukoliko u roku od dvije godine ne počini neko novo kazneno djelo.

Lubina je osuđen zbog kaznenog djela protiv pravosuđa - davanja lažnog iskaza. Županijski sud u Zagrebu je tako na svojoj sjednici 18. veljače potvrdio prvostupanjsku presudu Općinskog suda u Splitu koja je donesena u svibnju prošle godine.

Tu nam je informaciju potvrdio i Vuko Adžić Katalinić, glasnogovornik Kaznenog odjela splitskog Općinskog suda dodajući da je o pravomoćnosti presude 3. ožujka dopisom obaviještena i Hrvatska odvjetnička komora.
