Vrhovni sud odbio je žalbe četvero okrivljenika optuženih za primanje mita radi legalizacije hotela Vila Harmony na splitskim Bačvicama čime je postalo pravomoćno rješenje kojim su odbijeni prijedlozi obrane za izdvajanje nezakonitih dokaza.
Najviši sud je priopćio da je odbio žalbe bivšeg inspektora u Ministarstvu graditeljstva i kasnijeg pomoćnika direktora Sektora razvoja i investicija u Janafu Željka Korice (67), člana Uprave tvrtke Špinut i investitora Vile Harmony Zorana Sikirice (59), arhitekta Damira Rake (57) i bivše voditeljice Odsjeka za graditeljstvo Upravnog odjela za prostorno uređenje i graditeljstvo Grada Splita Lade Pocrnić Mladinić (58).

Vrhovni sud je, priopćivši samo inicijale okrivljenika, pojasnio da su odbijeni prijedlozi obrane za izdvajanje kao nezakonitih dokaza niza naloga suca istrage za primjenu posebnih dokaznih radnji i svih ostalih dokaza proizašlih iz tih naloga, zapisnika o ispitivanju svjedoka, razne dokumentacije te vještačenja vještaka za graditeljstvo.

Vrhovni sud smatra da je prvostupanjski sud pravilno zaključio da svi nalozi suca istrage u spisu, a kojima je određeno provođenje posebnih dokaznih radnji, zadovoljavaju standarde postavljene za dopuštenost miješanja države u temeljna prava i slobode pojedinca.

Sud je dodao kako iznijeti razlozi u obrazloženju svakog naloga jasno upućuju da je miješanje u ostvarivanje temeljnih prava pojedinca bilo nužno i u skladu sa zakonom. Uz to, sud je pojasnio da posebne dokazne radnje nisu naložene nemarno, neregularno ili bez potrebnog razmatranja.

- Stoga nije bilo razloga da se ti nalozi i dokazi koji su iz njih proizašli izdvoje iz spisa kao nezakoniti dokazi jer su valjano i zakonito pribavljeni dokazi na kojima se može temeljiti sudska odluka - priopćio je sud.

Vrhovni sud također smatra da je prvostupanjski sud pravilno zaključio da je građevinsko vještačenje provedeno zakonito, sukladno nalogu ovlaštenog tijela i po stalnom sudskom vještaku za graditeljstvo. Uskok je u lipnju 2020. optužio sedmero osoba radi primanja i davanja mita radi legalizacije dijela Vile Harmony na Bačvicama čiju izgradnju je investirala splitska tvrtka Špinut.

Pored Korice, Sikirice, Rake i Pocrnić Maldinić, optuženi su bivši načelnik Samostalnog sektora za pravne poslove Ministarstva graditeljstva i prostornog uređenja Josip Bienenfled (59), voditelj Odjela za katastarske programe i geodetske poslove Državne geodetske uprave u Splitu Ante Duvančić (56) i djelatnica Katastra Kata Boban (55).

Vrhovni sud odbio je žalbe četvero okrivljenika optuženih za primanje mita radi legalizacije hotela Vila Harmony na splitskim Bačvicama čime je postalo pravomoćno rješenje kojim su odbijeni prijedlozi obrane za izdvajanje nezakonitih dokaza.
Najviši sud je priopćio da je odbio žalbe bivšeg inspektora u Ministarstvu graditeljstva i kasnijeg pomoćnika direktora Sektora razvoja i investicija u Janafu Željka Korice (67), člana Uprave tvrtke Špinut i investitora Vile Harmony Zorana Sikirice (59), arhitekta Damira Rake (57) i bivše voditeljice Odsjeka za graditeljstvo Upravnog odjela za prostorno uređenje i graditeljstvo Grada Splita Lade Pocrnić Mladinić (58).

Vrhovni sud je, priopćivši samo inicijale okrivljenika, pojasnio da su odbijeni prijedlozi obrane za izdvajanje kao nezakonitih dokaza niza naloga suca istrage za primjenu posebnih dokaznih radnji i svih ostalih dokaza proizašlih iz tih naloga, zapisnika o ispitivanju svjedoka, razne dokumentacije te vještačenja vještaka za graditeljstvo.

Vrhovni sud smatra da je prvostupanjski sud pravilno zaključio da svi nalozi suca istrage u spisu, a kojima je određeno provođenje posebnih dokaznih radnji, zadovoljavaju standarde postavljene za dopuštenost miješanja države u temeljna prava i slobode pojedinca.

Sud je dodao kako iznijeti razlozi u obrazloženju svakog naloga jasno upućuju da je miješanje u ostvarivanje temeljnih prava pojedinca bilo nužno i u skladu sa zakonom. Uz to, sud je pojasnio da posebne dokazne radnje nisu naložene nemarno, neregularno ili bez potrebnog razmatranja.

- Stoga nije bilo razloga da se ti nalozi i dokazi koji su iz njih proizašli izdvoje iz spisa kao nezakoniti dokazi jer su valjano i zakonito pribavljeni dokazi na kojima se može temeljiti sudska odluka - priopćio je sud.

Vrhovni sud također smatra da je prvostupanjski sud pravilno zaključio da je građevinsko vještačenje provedeno zakonito, sukladno nalogu ovlaštenog tijela i po stalnom sudskom vještaku za graditeljstvo. Uskok je u lipnju 2020. optužio sedmero osoba radi primanja i davanja mita radi legalizacije dijela Vile Harmony na Bačvicama čiju izgradnju je investirala splitska tvrtka Špinut.

Pored Korice, Sikirice, Rake i Pocrnić Maldinić, optuženi su bivši načelnik Samostalnog sektora za pravne poslove Ministarstva graditeljstva i prostornog uređenja Josip Bienenfled (59), voditelj Odjela za katastarske programe i geodetske poslove Državne geodetske uprave u Splitu Ante Duvančić (56) i djelatnica Katastra Kata Boban (55).
