Nema više pravnih zapreka, bivši splitski gradonačelnici Ivo Baldasar i Miroslav Buličić trebali bi se uskoro naći na klupi za okrivljenike u sudnici splitskog Županijskog suda nakon što je potvrđena USKOK-ova optužnica protiv njih dvojice i to zbog zlouporabe položaja i ovlasti te poticanja na zlouporabu.

Osim njih dvojice, pred sudskim vijećem će se naći i bivši šef splitske komunale Špiro Cokarić, koji je otišao u mirovinu i Damir Babić, voditelj Odsjeka za komunalne poslove koje se također optužuje za zlouporabu položaja i ovlasti.

Sudit će se još i Natali Ribičić, voditeljici Pododsjeka za javne površine i predsjednici Komisije za utvrđivanje uvjeta za postavljanje štekata, potom Jasni Parčini direktorici tvrtke "Mimoza", Josipu Čuliću, voditelju hotela "Luxe" te poduzetniku Stipi Mađoru. USKOK, dakle, Baldasara, Cokarića, Babića i Ribičić tereti za produljeno kazneno djelo zlouporabe položaja i ovlasti, dok se Buličića, Parčinu, Čulića i Mađora tereti za poticanje.

Baldasara, Cokarića i Babića se optužuje da su, na traženje Parčine i Čulića, hotelu "Luxe" u periodu od 8. srpnja 2014. do 28. ožujka 2017. godine omogućili korištenje besplatnih ili povoljnijih parkirnih mjesta. Time je, smatra USKOK, Grad oštećen za 663 700 kuna. Od 19 mjesta koliko je "Mimoza" koristila, USKOK tvrdi, za 16 su plaćali 400 umjesto 800 kuna naknade.

Baldasarova obrana pokušala je uvjeriti sud da određivanje cijena parkinga, za razliku od određivanja broja mjesta, jest u nadležnosti gradonačelnika te da je Baldasar imao ovlasti odrediti povlaštenu cijenu pojedinim pravnim osobama od posebnog značaja pa tako i "Mimozi".

Obrana isto tako tvrdi da Baldasar nema veze sa storniranjem obaveza "Mimoze" za 2016. godinu već da ugovor nije potpisan zbog kadrovskih problema u Gradu te da je u ožujku 2017. godine zaključen i za tu godinu i retroaktivno.

Nadalje se Baldasara tereti da je Cokariću i Natali Ribičić naložio da tvrtkama Stipe Mađora na tri godine daju u zakup površinu oko Turističke palače "s pravom prvenstva produljenja ugovora i davanja u podzakup, uz popust od 20 posto za jednokratnu uplatu te da se dopušta postavljanje šanka uz ugovor o zakupu poslovnog prostora na 25 godina".

Tako je, smatra USKOK, Baldasar omogućio Mađorovim tvrtkama pribavljanje nepripadne imovinske koristi za razliku između plaćene zakupnine s popustom i punog iznosa podzakupnine u iznosu od najmanje 63 tisuće kuna te za neplaćanje naknade za postavljeni šank od 60 tisuća kuna, čime je Split tijekom trajanja sklopljenih ugovora godišnje ukupno oštećen za preko 123 tisuće kuna.

I naposljetku, Babić je optužen da je, na traženje bivšeg gradonačelnika Buličića izdao nalog jednoj tvrtki da izvede radove postavljanja prometnog ogledala, asfaltiranja i iscrtavanja parkirališnog prostora ispred njegove obiteljske kuće iako je znao da će navedene radove neosnovano platiti Split. Tako je, po USKOK-u, na štetu Splita, Buličiću pribavio nepripadnu imovinsku korist od najmanje 30 tisuća kuna.

Obrane svih okrivljenih koji su se izjasnili da se ne osjećaju krivima, tražile su, naravno, da se kazneni postupak obustavi i optužnica odbaci jer je neutemeljena i nema dokaza o počinjenim kaznenim djelima.

No, Optužno vijeće je ipak ocijenilo da za opstanak optužnice postoji dovoljno dokaza u spisu (osim dokumenata i snimke snimljenih razgovora) koji ukazuju na to da postoji osnovana sumnja da su počinili to za što se terete.

Nema više pravnih zapreka, bivši splitski gradonačelnici Ivo Baldasar i Miroslav Buličić trebali bi se uskoro naći na klupi za okrivljenike u sudnici splitskog Županijskog suda nakon što je potvrđena USKOK-ova optužnica protiv njih dvojice i to zbog zlouporabe položaja i ovlasti te poticanja na zlouporabu.

Osim njih dvojice, pred sudskim vijećem će se naći i bivši šef splitske komunale Špiro Cokarić, koji je otišao u mirovinu i Damir Babić, voditelj Odsjeka za komunalne poslove koje se također optužuje za zlouporabu položaja i ovlasti.

Sudit će se još i Natali Ribičić, voditeljici Pododsjeka za javne površine i predsjednici Komisije za utvrđivanje uvjeta za postavljanje štekata, potom Jasni Parčini direktorici tvrtke "Mimoza", Josipu Čuliću, voditelju hotela "Luxe" te poduzetniku Stipi Mađoru. USKOK, dakle, Baldasara, Cokarića, Babića i Ribičić tereti za produljeno kazneno djelo zlouporabe položaja i ovlasti, dok se Buličića, Parčinu, Čulića i Mađora tereti za poticanje.

Baldasara, Cokarića i Babića se optužuje da su, na traženje Parčine i Čulića, hotelu "Luxe" u periodu od 8. srpnja 2014. do 28. ožujka 2017. godine omogućili korištenje besplatnih ili povoljnijih parkirnih mjesta. Time je, smatra USKOK, Grad oštećen za 663 700 kuna. Od 19 mjesta koliko je "Mimoza" koristila, USKOK tvrdi, za 16 su plaćali 400 umjesto 800 kuna naknade.

Baldasarova obrana pokušala je uvjeriti sud da određivanje cijena parkinga, za razliku od određivanja broja mjesta, jest u nadležnosti gradonačelnika te da je Baldasar imao ovlasti odrediti povlaštenu cijenu pojedinim pravnim osobama od posebnog značaja pa tako i "Mimozi".

Obrana isto tako tvrdi da Baldasar nema veze sa storniranjem obaveza "Mimoze" za 2016. godinu već da ugovor nije potpisan zbog kadrovskih problema u Gradu te da je u ožujku 2017. godine zaključen i za tu godinu i retroaktivno.

Nadalje se Baldasara tereti da je Cokariću i Natali Ribičić naložio da tvrtkama Stipe Mađora na tri godine daju u zakup površinu oko Turističke palače "s pravom prvenstva produljenja ugovora i davanja u podzakup, uz popust od 20 posto za jednokratnu uplatu te da se dopušta postavljanje šanka uz ugovor o zakupu poslovnog prostora na 25 godina".

Tako je, smatra USKOK, Baldasar omogućio Mađorovim tvrtkama pribavljanje nepripadne imovinske koristi za razliku između plaćene zakupnine s popustom i punog iznosa podzakupnine u iznosu od najmanje 63 tisuće kuna te za neplaćanje naknade za postavljeni šank od 60 tisuća kuna, čime je Split tijekom trajanja sklopljenih ugovora godišnje ukupno oštećen za preko 123 tisuće kuna.

I naposljetku, Babić je optužen da je, na traženje bivšeg gradonačelnika Buličića izdao nalog jednoj tvrtki da izvede radove postavljanja prometnog ogledala, asfaltiranja i iscrtavanja parkirališnog prostora ispred njegove obiteljske kuće iako je znao da će navedene radove neosnovano platiti Split. Tako je, po USKOK-u, na štetu Splita, Buličiću pribavio nepripadnu imovinsku korist od najmanje 30 tisuća kuna.

Obrane svih okrivljenih koji su se izjasnili da se ne osjećaju krivima, tražile su, naravno, da se kazneni postupak obustavi i optužnica odbaci jer je neutemeljena i nema dokaza o počinjenim kaznenim djelima.

No, Optužno vijeće je ipak ocijenilo da za opstanak optužnice postoji dovoljno dokaza u spisu (osim dokumenata i snimke snimljenih razgovora) koji ukazuju na to da postoji osnovana sumnja da su počinili to za što se terete.

Nema više pravnih zapreka, bivši splitski gradonačelnici Ivo Baldasar i Miroslav Buličić trebali bi se uskoro naći na klupi za okrivljenike u sudnici splitskog Županijskog suda nakon što je potvrđena USKOK-ova optužnica protiv njih dvojice i to zbog zlouporabe položaja i ovlasti te poticanja na zlouporabu.

Osim njih dvojice, pred sudskim vijećem će se naći i bivši šef splitske komunale Špiro Cokarić, koji je otišao u mirovinu i Damir Babić, voditelj Odsjeka za komunalne poslove koje se također optužuje za zlouporabu položaja i ovlasti.

Sudit će se još i Natali Ribičić, voditeljici Pododsjeka za javne površine i predsjednici Komisije za utvrđivanje uvjeta za postavljanje štekata, potom Jasni Parčini direktorici tvrtke "Mimoza", Josipu Čuliću, voditelju hotela "Luxe" ...
