U srijedu popodne na riječkom Županijskom sudu krivim je proglašen 40-godišnji Kristijan Daka za poticanje na teško ubojstvo i nepravomoćno je osuđen na šest godina zatvora, piše Novi list.
Oslobađajuće presuda je donesena po pitanju druge točke optužnice, nedopuštenog posjedovanja oružja i eksplozivnih tvari te mu je produljen istražni zatvor u kojem se sada nalazi. Daka se trenutno nalazi u izolaciji zbog kontakta s osobom zaraženom koronavirusom te se zbog toga nije danas mogao doći na izricanje presude.
Prema neslužbenim napisima Novog lista, Daka radi u zatvorskoj kuhinji gdje je bio u kontaktu sa zaraženom osobom.
Predsjednik sudskog vijeća sudac Domagoj Vučkov je u obrazloženju presude naveo je kako je sud iskaze svjedoka smatrao vjerodostojnim, kao i nalaz i mišljenje vještaka.
– Sud ne nalazi niti jedan razlog zbog kojeg bi pouzdanik neistinito iskazivao. Pouzdanikove tvrdnje terete okrivljenika. Sudu je prihvatljivo da se pouzdanik zbog proteka vremena nekih događaja slabije sjeća. Sadržaj izvješća pouzdanika u velikom se dijelu poklapaju s transkriptima tajno snimanih razgovora. Iz snimki se zaključuje o kriminalnim namjerama okrivljenika. Jasno je da je okrivljenik pouzdaniku pokazao gdje u Hrvatskoj živi žrtva. Okrivljenik je tražio plaćenog ubojicu kako bi se žrtvi osvetio za događaj iz 2007. godine, no ubojstvo nije pokušano pa je iz tog razloga mogla biti izrečena blaža zatvorska kazna- rekao je sudac.
Kazneno djelo izvršeno je u vidu poticanja, ali nije došlo do pokušaja ubojstva. Kod izricanja presude kao otegotnu okolnost su uzeli upornost okrivljenika, ali u korist mi je išlo to što je do sada neosuđivan te je otac djeteta o kojem se brine.
Druga točka optužnice odnosila se na nedopušteno posjedovanje oružja i eksplozivnih tvari. Po tom pitanju, 40-godišnjak je oslobođen optužbi.
– U situaciji kada su eksplozivna sredstva uništena objektivno nije moguće odlučivati o njihovoj ispravnosti. Ne može se utvrditi originalnost eksplozivnih sredstava i njihova ispravnost- obrazložio predsjednik vijeća odluku suda.
Daka se optužnicom teretio da je delikte počinio u razdoblju od ožujka do svibnja 2018. godine, a sve s ciljem da učini osvetu nad muškarcem za kojeg je mislio da ga je vrlo teško ozlijedio u fizičkom sukobu u središtu Rijeke u lipnju 2017. godine. Štoviše, od policijskog „pouzdanika“ je, ne znajući da on surađuje s policijom, tražio da pronađe osobu koja bi u zamjenu za nagradu lišila života napadača na njega u slučaju starom 14 godina.
Na navode optužnice se bio izjasnio kako se ne smatra krivim, a to proizlazi i iz njegove obrane koju je iznio prošli tjedan.
– Pouzdanik je običan lažov. Siguran sam da radi po nečijem naputku, ali ne znam po čijem. On je za sve ovo očito plaćen. Meni se pakira cijeli slučaj. Pouzdanik ima i drugih prijatelja na ovom području kojima možda ja ne odgovaram. To je moguće i zbog moje nacionalnosti, pa mi možda i zbog toga smještaju. Smatram da pouzdanik na snimljenim razgovorima priča s trećom osobom o oružju i o poslu u svezi s oružjem. Stalno mi je nudio neke kombinacije. Doslovno mi je nudio kaznena djela. Međutim, ništa nije išlo dalje od razgovora, niti smo išta pokušavali- rekao je u svojoj obrani Daka.

U srijedu popodne na riječkom Županijskom sudu krivim je proglašen 40-godišnji Kristijan Daka za poticanje na teško ubojstvo i nepravomoćno je osuđen na šest godina zatvora, piše Novi list.
Oslobađajuće presuda je donesena po pitanju druge točke optužnice, nedopuštenog posjedovanja oružja i eksplozivnih tvari te mu je produljen istražni zatvor u kojem se sada nalazi. Daka se trenutno nalazi u izolaciji zbog kontakta s osobom zaraženom koronavirusom te se zbog toga nije danas mogao doći na izricanje presude.
Prema neslužbenim napisima Novog lista, Daka radi u zatvorskoj kuhinji gdje je bio u kontaktu sa zaraženom osobom.
Predsjednik sudskog vijeća sudac Domagoj Vučkov je u obrazloženju presude naveo je kako je sud iskaze svjedoka smatrao vjerodostojnim, kao i nalaz i mišljenje vještaka.
– Sud ne nalazi niti jedan razlog zbog kojeg bi pouzdanik neistinito iskazivao. Pouzdanikove tvrdnje terete okrivljenika. Sudu je prihvatljivo da se pouzdanik zbog proteka vremena nekih događaja slabije sjeća. Sadržaj izvješća pouzdanika u velikom se dijelu poklapaju s transkriptima tajno snimanih razgovora. Iz snimki se zaključuje o kriminalnim namjerama okrivljenika. Jasno je da je okrivljenik pouzdaniku pokazao gdje u Hrvatskoj živi žrtva. Okrivljenik je tražio plaćenog ubojicu kako bi se žrtvi osvetio za događaj iz 2007. godine, no ubojstvo nije pokušano pa je iz tog razloga mogla biti izrečena blaža zatvorska kazna- rekao je sudac.
Kazneno djelo izvršeno je u vidu poticanja, ali nije došlo do pokušaja ubojstva. Kod izricanja presude kao otegotnu okolnost su uzeli upornost okrivljenika, ali u korist mi je išlo to što je do sada neosuđivan te je otac djeteta o kojem se brine.
Druga točka optužnice odnosila se na nedopušteno posjedovanje oružja i eksplozivnih tvari. Po tom pitanju, 40-godišnjak je oslobođen optužbi.
– U situaciji kada su eksplozivna sredstva uništena objektivno nije moguće odlučivati o njihovoj ispravnosti. Ne može se utvrditi originalnost eksplozivnih sredstava i njihova ispravnost- obrazložio predsjednik vijeća odluku suda.
Daka se optužnicom teretio da je delikte počinio u razdoblju od ožujka do svibnja 2018. godine, a sve s ciljem da učini osvetu nad muškarcem za kojeg je mislio da ga je vrlo teško ozlijedio u fizičkom sukobu u središtu Rijeke u lipnju 2017. godine. Štoviše, od policijskog „pouzdanika“ je, ne znajući da on surađuje s policijom, tražio da pronađe osobu koja bi u zamjenu za nagradu lišila života napadača na njega u slučaju starom 14 godina.
Na navode optužnice se bio izjasnio kako se ne smatra krivim, a to proizlazi i iz njegove obrane koju je iznio prošli tjedan.
– Pouzdanik je običan lažov. Siguran sam da radi po nečijem naputku, ali ne znam po čijem. On je za sve ovo očito plaćen. Meni se pakira cijeli slučaj. Pouzdanik ima i drugih prijatelja na ovom području kojima možda ja ne odgovaram. To je moguće i zbog moje nacionalnosti, pa mi možda i zbog toga smještaju. Smatram da pouzdanik na snimljenim razgovorima priča s trećom osobom o oružju i o poslu u svezi s oružjem. Stalno mi je nudio neke kombinacije. Doslovno mi je nudio kaznena djela. Međutim, ništa nije išlo dalje od razgovora, niti smo išta pokušavali- rekao je u svojoj obrani Daka.
