Ako je suditi po jučerašnjem svjedočenju pomorca D. B., koji je, nakon dugog traženja splitskog suda, jučer napokon pod pratnjom policije doveden kao svjedok u sudnicu suca Vladimira Živaljića, na suđenje Kristijanu Stojanoviću zbog pokušaja ubojstva Lea Paurevića u lipnju 2010. godine, on je doživio gotovo potpunu amneziju.

Naime, taj je svjedok 7. prosinca 2012. godine dao iskaz Rene Lauri, zamjenici ŽDO-a, u kojem je kazao da je te večeri u lipnju 2010. godine vozio na skuteru Stojanovića i da je ovaj u jednom trenutku zapucao prema automobilu jaguar u kojem se nalazio Leo Paurević.

No, jučer se ključni svjedok ničega nije sjećao pa ni nakon što mu je predočen taj iskaz.

– Je li vam poznato da ste dali iskaz ŽDO-u? Je li vam poznato da ste 6. lipnja 2010. godine upravljali motociklom? Je li vas Stojanović molio da ga vozite i jeste li ga vozili kad je došlo do pucnjave? – pitala je jučer tužiteljica.

– Ne sjećam se i ne bih odgovarao na ta pitanja – odgovorio je pomorac.

Stojanović je pitao svjedoka je li u vrijeme kad je dao iskaz na ŽDO-u, koristio metadon, heroin ili kokain. Ovaj je odgovorio da jest te da je tada pušio marihuanu, ali da ne zna koliko prije davanja iskaza.

– Moguće je da sam bio u apstinencijskoj krizi u vrijeme ispitivanja u tužiteljstvu. Moguće je da su mi ostale “rupe” u sjećanju – odgovorio je svjedok.

Zamjenica ŽDO-a je prigovorila njegovu iskazu tvrdeći da je neistinit jer da je on sam došao u ŽDO dati iskaz te da ne želi ulaziti u razloge zbog kojih danas ništa ne govori.

Stojanovićev odvjetnik Željko Gulišija, pak, zatražio je od sudskog vijeća da izdvoji kao nezakonit iskaz svjedoka dan na Državnom odvjetništvu jer svjedok nije tada bio propisno upozoren na svoja prava.

Budući da je ovaj zahtjev obrane, koja je upozorila i na dio zapisnika o ispitivanju iz kojeg se ne vidi upozorenje o pravima, čini se, iznenadio i suca Živaljića, on je odgodio raspravu kako bi sudsko vijeće moglo donijeti odluku o eventualnom izdvajanju iskaza kao nezakonitog.

Ako je suditi po jučerašnjem svjedočenju pomorca D. B., koji je, nakon dugog traženja splitskog suda, jučer napokon pod pratnjom policije doveden kao svjedok u sudnicu suca Vladimira Živaljića, na suđenje Kristijanu Stojanoviću zbog pokušaja ubojstva Lea Paurevića u lipnju 2010. godine, on je doživio gotovo potpunu amneziju.

Naime, taj je svjedok 7. prosinca 2012. godine dao iskaz Rene Lauri, zamjenici ŽDO-a, u kojem je kazao da je te večeri u lipnju 2010. godine vozio na skuteru Stojanovića i da je ovaj u jednom trenutku zapucao prema automobilu jaguar u kojem se nalazio Leo Paurević.

No, jučer se ključni svjedok ničega nije sjećao pa ni nakon što mu je predočen taj iskaz.

– Je li vam poznato da ste dali iskaz ŽDO-u? Je li vam poznato da ste 6. lipnja 2010. godine upravljali motociklom? Je li vas Stojanović molio da ga vozite i jeste li ga vozili kad je došlo do pucnjave? – pitala je jučer tužiteljica.

– Ne sjećam se i ne bih odgovarao na ta pitanja – odgovorio je pomorac.

Stojanović je pitao svjedoka je li u vrijeme kad je dao iskaz na ŽDO-u, koristio metadon, heroin ili kokain. Ovaj je odgovorio da jest te da je tada pušio marihuanu, ali da ne zna koliko prije davanja iskaza.

– Moguće je da sam bio u apstinencijskoj krizi u vrijeme ispitivanja u tužiteljstvu. Moguće je da su mi ostale “rupe” u sjećanju – odgovorio je svjedok.

Zamjenica ŽDO-a je prigovorila njegovu iskazu tvrdeći da je neistinit jer da je on sam došao u ŽDO dati iskaz te da ne želi ulaziti u razloge zbog kojih danas ništa ne govori.

Stojanovićev odvjetnik Željko Gulišija, pak, zatražio je od sudskog vijeća da izdvoji kao nezakonit iskaz svjedoka dan na Državnom odvjetništvu jer svjedok nije tada bio propisno upozoren na svoja prava.

Budući da je ovaj zahtjev obrane, koja je upozorila i na dio zapisnika o ispitivanju iz kojeg se ne vidi upozorenje o pravima, čini se, iznenadio i suca Živaljića, on je odgodio raspravu kako bi sudsko vijeće moglo donijeti odluku o eventualnom izdvajanju iskaza kao nezakonitog.
