Općinski sud u Ljubuškom ponovno je odbio prijedlog Tužiteljstva da se Denisa Buntića pritvori zbog osnova sumnje na nasilje u obitelji, ali i kaznenog djela držanja nedopuštenog oružja ili eksplozivnih stvari. Ovo je drugi put da postupajući sudac odbija pritvor, a Tužiteljstvo Županije Zapadnohercegovačke opet je uložilo žalbu na odluku, javlja Hercegovina.info.

"Nakon što je Izvanraspravno vijeće Općinskog suda u Ljubuškom dana 28. 9. 2023. godine uvažilo žalbu Županijskog tužiteljstva ŽZH Široki Brijeg i ukinulo rješenje Općinskog suda u Ljubuškom od 23. 9. 2023. godine, te predmet vratilo sucu za prethodni postupak na ponovno odlučivanje, sudac za prethodni postupak je ponovno dana 29. 9. 2023. godine donio rješenje kojim je odbijen prijedlog ovog Tužiteljstva za određivanje pritvora prema osumnjičenom D. B. protiv kojeg se vodi istraga zbog osnova sumnje da je u stjecaju počinio kazneno djelo Nasilje u obitelji iz čl. 222. st. 2 i st. 4 u vezi sa st. 1 KZ F BiH i kazneno djelo Nedopušteno držanje oružja ili eksplozivnih tvari iz čl. 371. st. 2 u vezi sa st. 1 KZ  F BiH, a sve u vezi sa čl. 54. KZ F BiH, na koje rješenje je Županijsko tužiteljstvo ŽZH Široki Brijeg ponovno uložilo žalbu zbog bitnih povreda kaznenog postupka te pogrešno i nepotpuno utvrđenog činjeničnog stanja", stoji u priopćenju Tužiteljstva ŽZH.

Zatraženo je da se žalba uvaži, osporeno rješenje ukine i predmet vrati sucu na ponovno odlučivanje ili da pobijano rješenje preinači i protiv osumnjičenog odredi pritvor. Razlozi za određivanje pritvora su opravdana bojazan da bi osumnjičeni boravkom na slobodi sa sigurnošću mogao utjecati na iskaze svjedoka, odnosno ometati kazneni postupak utjecajem na iste i opravdane bojazni da će ponoviti kaznena djela koja mu se stavljaju na teret.

Iz Tužiteljstva su Indexu potvrdili su da su već jutros otpremili novu žalbu te da se čeka odluka Sudbenog vijeća. “I dalje smatramo da postoje razlozi za određivanje pritvora. Mi smo jutros ponovno uložili žalbu i dalje ćemo iskorištavati naše pravne lijekove u tijeku istrage, u okviru svojih nadležnosti”, kazala je tužiteljica Natalija Marić.

O pritvoru je, podsjetimo, opet odlučivao sud u Ljubuškom, na kojemu radi majka Denisa Buntića, koji je nedavno premlatio svoju ženu

Općinski sud u Ljubuškom ponovno je odbio prijedlog Tužiteljstva da se Denisa Buntića pritvori zbog osnova sumnje na nasilje u obitelji, ali i kaznenog djela držanja nedopuštenog oružja ili eksplozivnih stvari. Ovo je drugi put da postupajući sudac odbija pritvor, a Tužiteljstvo Županije Zapadnohercegovačke opet je uložilo žalbu na odluku, javlja Hercegovina.info.

"Nakon što je Izvanraspravno vijeće Općinskog suda u Ljubuškom dana 28. 9. 2023. godine uvažilo žalbu Županijskog tužiteljstva ŽZH Široki Brijeg i ukinulo rješenje Općinskog suda u Ljubuškom od 23. 9. 2023. godine, te predmet vratilo sucu za prethodni postupak na ponovno odlučivanje, sudac za prethodni postupak je ponovno dana 29. 9. 2023. godine donio rješenje kojim je odbijen prijedlog ovog Tužiteljstva za određivanje pritvora prema osumnjičenom D. B. protiv kojeg se vodi istraga zbog osnova sumnje da je u stjecaju počinio kazneno djelo Nasilje u obitelji iz čl. 222. st. 2 i st. 4 u vezi sa st. 1 KZ F BiH i kazneno djelo Nedopušteno držanje oružja ili eksplozivnih tvari iz čl. 371. st. 2 u vezi sa st. 1 KZ  F BiH, a sve u vezi sa čl. 54. KZ F BiH, na koje rješenje je Županijsko tužiteljstvo ŽZH Široki Brijeg ponovno uložilo žalbu zbog bitnih povreda kaznenog postupka te pogrešno i nepotpuno utvrđenog činjeničnog stanja", stoji u priopćenju Tužiteljstva ŽZH.

Zatraženo je da se žalba uvaži, osporeno rješenje ukine i predmet vrati sucu na ponovno odlučivanje ili da pobijano rješenje preinači i protiv osumnjičenog odredi pritvor. Razlozi za određivanje pritvora su opravdana bojazan da bi osumnjičeni boravkom na slobodi sa sigurnošću mogao utjecati na iskaze svjedoka, odnosno ometati kazneni postupak utjecajem na iste i opravdane bojazni da će ponoviti kaznena djela koja mu se stavljaju na teret.

Iz Tužiteljstva su Indexu potvrdili su da su već jutros otpremili novu žalbu te da se čeka odluka Sudbenog vijeća. “I dalje smatramo da postoje razlozi za određivanje pritvora. Mi smo jutros ponovno uložili žalbu i dalje ćemo iskorištavati naše pravne lijekove u tijeku istrage, u okviru svojih nadležnosti”, kazala je tužiteljica Natalija Marić.

Denis Buntić ostaje na slobodi! Sud u Ljubuškom ponovno odbio pritvor

Općinski sud u Ljubuškom ponovno je odbio prijedlog Tužiteljstva da se Denisa Buntića pritvori zbog osnova sumnje na nasilje u obitelji, ali i kaznenog djela držanja nedopuštenog oružja ili eksplozivnih stvari. Ovo je drugi put da postupajući sudac odbija pritvor, a Tužiteljstvo Županije Zapadnohercegovačke opet je uložilo žalbu na odluku, javlja Hercegovina.info.

"Nakon što je Izvanraspravno vijeće Općinskog suda u Ljubuškom dana 28. 9. 2023. godine uvažilo žalbu Županijskog tužiteljstva ŽZH Široki Brijeg i ukinulo rješenje Općinskog suda u Ljubuškom od 23. 9. 2023. godine, te predmet vratilo sucu za prethodni postupak na ponovno odlučivanje, sudac za prethodni postupak je ponovno dana 29. 9. 2023. godine donio rješenje kojim je odbijen prijedlog ovog Tužiteljstva za određivanje pritvora prema osumnjičenom D. B. protiv kojeg se vodi istraga zbog osnova sumnje da je u stjecaju počinio kazneno djelo Nasilje u obitelji iz čl. 222. st. 2 i st. 4 u vezi sa st. 1 KZ F BiH i kazneno djelo Nedopušteno držanje oružja ili eksplozivnih tvari iz čl. 371. st. 2 u vezi sa st. 1 KZ  F BiH, a sve u vezi sa čl. 54. KZ F BiH, na koje rješenje je Županijsko tužiteljstvo ŽZH Široki Brijeg ponovno uložilo žalbu zbog bitnih povreda kaznenog postupka te pogrešno i nepotpuno utvrđenog činjeničnog stanja", stoji u priopćenju Tužiteljstva ŽZH.

Zatraženo je da se žalba uvaži, osporeno rješenje ukine i predmet vrati sucu na ponovno odlučivanje ili da pobijano rješenje preinači i protiv osumnjičenog odredi pritvor. Razlozi za određivanje pritvora su opravdana bojazan da bi osumnjičeni boravkom na slobodi sa sigurnošću mogao utjecati na iskaze svjedoka, odnosno ometati kazneni postupak utjecajem na iste i opravdane bojazni da će ponoviti kaznena djela koja mu se stavljaju na teret.

Iz Tužiteljstva su Indexu potvrdili su da su već jutros otpremili novu žalbu te da se čeka odluka Sudbenog vijeća. “I dalje smatramo da postoje razlozi za određivanje pritvora. Mi smo jutros ponovno uložili žalbu i dalje ćemo iskorištavati naše pravne lijekove u tijeku istrage, u okviru svojih nadležnosti”, kazala je tužiteljica Natalija Marić.
