Županijski sud u Puli je 27. travnja 2020. donio odluku kojom se utvrđuje da ogledni postupak kojim se utvrđivala valjanost aneksa za konverziju nema utjecaj na tužbe iz konvertiranih kredita. Prethodno je Županijski sud u Karlovcu donio istu takvu odluku 11. ožujka 2020.

Pulska sutkinja Alenka Paus i karlovačka sutkinja Milka Vraneš, obje na žalbu splitskog odvjetnika Srđana Kalebote zbog prekida privatnog sudskog postupka uslijed oglednog postupka, utvrdile su kako je donesena odluka u oglednom postupku te da ta odluka, odnosno valjanost ili ništetnost aneksa, nije od značaja za obeštećenje potrošača do dana konverzije.

Istaknuto je to u objavi udruge Franak koja je još prije desetak dana objavila i pravomoćnu presudu Županijskoga suda u Zadru kojom je također nakon oglednog postupka utvrđeno da unatoč valjanosti sporazuma potrošač ima pravo na preplaćene anuitete, jer konverzijom nije obeštećen, što je u skladu s presudom Suda EU C-118/17, Dunai.

- Sud prvog stupnja je pogrešno ocijenio da odluka ovisi o rješavanju naznačenog pravnog pitanja jer tužitelj, osim što ne tvrdi da je dodatak ugovoru odnosno sporazum o konverziji ništetan, isplatu traži samo za razdoblje do sklapanja navedenog dodatka Ugovoru o kreditu od 12. rujna 2007., odnosno do rujna 2015., a s osnova ništetnosti odredbe Ugovora, pa ništetnost ili ne dodatka ili nepostojanje istog nije, s obzirom na postavljen zahtjev, od značaja za odluku u predmetnoj pravnoj stvari, a s obzirom na vrijeme za koje se isplata navodno dugovanog iznosa potražuje – naveo je Županijski sud u Puli

Kako su priopćili iz udruge Franak, u međuvremenu je objavljeno da su donesene i presude u korist banaka, jedna također na Županijskome sudu u Puli i jedna na karlovačkom sudu.

- Te presude suprotne su rješenjima kojima se na tim istim sudovima utvrđuje kako aneksi i konverzije nisu od utjecaja na tužbene zahtjeve do dana konverzije i da nemaju nikakav utjecaj niti na pravo na obeštećenje – poručuju iz Franka.

Nadalje, navode kako rješenja Županijskoga suda u Puli i Karlovcu kojima se utvrđuje da ogledni postupak nema utjecaj na tužbe iz konvertiranih kredita nisu jedina takva rješenja.

Takva rješenja donesena su već i prije na pulskome Županijskom sudu, donijela ga je sutkinja Kristina Pavićić-Sirotić, zatim na zagrebačkom Županijskom sudu takvo rješenje donosi sutkinja Vesna Žulj te je konačno isto takvo rješenje doneseno i na bjelovarskome Županijskom sudu.

- Napominjemo da je do danas nakon oglednog postupka doneseno već desetak prvostupanjskih presuda u korist potrošača koji su konvertirali kredite, i to na sudovima u Vukovaru, Kutini i Sisku. Mi ćemo svakako upitati Sud EU o našim pravima, mada su ta prava već utvrđena presudom C-118/17, a žalosti nas činjenica da i dalje očito postoje visoki suci koji to uopće ne razumiju i ne shvaćaju da moraju primjenjivati pravo Europske Unije koje je za sve sudove obvezujuće.

Dok pojedini suci to konačno ne prihvate te dok se sudska praksa ne ujednači, i dalje ćemo imati i pozitivne i negativne vijesti s različitih pa čak i s istih sudova, kao što je primjer iz ovoga priopćenja. Žalosti nas činjenica da je Vrhovni sud RH pokretanjem oglednog postupka bespotrebno unio nered i kaos u sudski prostor, a takvo postupanje na štetu je 18.000 potrošača koji su tužili banke nakon konverzije CHF kredita. Županijski sud u Puli je 27. travnja 2020. donio odluku kojom se utvrđuje da ogledni postupak kojim se utvrđivala valjanost aneksa za konverziju nema utjecaj na tužbe iz konvertiranih kredita. Prethodno je Županijski sud u Karlovcu donio istu takvu odluku 11. ožujka 2020.

Pulska sutkinja Alenka Paus i karlovačka sutkinja Milka Vraneš, obje na žalbu splitskog odvjetnika Srđana Kalebote zbog prekida privatnog sudskog postupka uslijed oglednog postupka, utvrdile su kako je donesena odluka u oglednom postupku te da ta odluka, odnosno valjanost ili ništetnost aneksa, nije od značaja za obeštećenje potrošača do dana konverzije.

Istaknuto je to u objavi udruge Franak koja je još prije desetak dana objavila i pravomoćnu presudu Županijskoga suda u Zadru kojom je također nakon oglednog postupka utvrđeno da unatoč valjanosti sporazuma potrošač ima pravo na preplaćene anuitete, jer konverzijom nije obeštećen, što je u skladu s presudom Suda EU C-118/17, Dunai.

- Sud prvog stupnja je pogrešno ocijenio da odluka ovisi o rješavanju naznačenog pravnog pitanja jer tužitelj, osim što ne tvrdi da je dodatak ugovoru odnosno sporazum o konverziji ništetan, isplatu traži samo za razdoblje do sklapanja navedenog dodatka Ugovoru o kreditu od 12. rujna 2007., odnosno do rujna 2015., a s osnova ništetnosti odredbe Ugovora, pa ništetnost ili ne dodatka ili nepostojanje istog nije, s obzirom na postavljen zahtjev, od značaja za odluku u predmetnoj pravnoj stvari, a s obzirom na vrijeme za koje se isplata navodno dugovanog iznosa potražuje – naveo je Županijski sud u Puli

Kako su priopćili iz udruge Franak, u međuvremenu je objavljeno da su donesene i presude u korist banaka, jedna također na Županijskome sudu u Puli i jedna na karlovačkom sudu.

- Te presude suprotne su rješenjima kojima se na tim istim sudovima utvrđuje kako aneksi i konverzije nisu od utjecaja na tužbene zahtjeve do dana konverzije i da nemaju nikakav utjecaj niti na pravo na obeštećenje – poručuju iz Franka.

Nadalje, navode kako rješenja Županijskoga suda u Puli i Karlovcu kojima se utvrđuje da ogledni postupak nema utjecaj na tužbe iz konvertiranih kredita nisu jedina takva rješenja.

Takva rješenja donesena su već i prije na pulskome Županijskom sudu, donijela ga je sutkinja Kristina Pavićić-Sirotić, zatim na zagrebačkom Županijskom sudu takvo rješenje donosi sutkinja Vesna Žulj te je konačno isto takvo rješenje doneseno i na bjelovarskome Županijskom sudu.

- Napominjemo da je do danas nakon oglednog postupka doneseno već desetak prvostupanjskih presuda u korist potrošača koji su konvertirali kredite, i to na sudovima u Vukovaru, Kutini i Sisku. Mi ćemo svakako upitati Sud EU o našim pravima, mada su ta prava već utvrđena presudom C-118/17, a žalosti nas činjenica da i dalje očito postoje visoki suci koji to uopće ne razumiju i ne shvaćaju da moraju primjenjivati pravo Europske Unije koje je za sve sudove obvezujuće.

Dok pojedini suci to konačno ne prihvate te dok se sudska praksa ne ujednači, i dalje ćemo imati i pozitivne i negativne vijesti s različitih pa čak i s istih sudova, kao što je primjer iz ovoga priopćenja. Žalosti nas činjenica da je Vrhovni sud RH pokretanjem oglednog postupka bespotrebno unio nered i kaos u sudski prostor, a takvo postupanje na štetu je 18.000 potrošača koji su tužili banke nakon konverzije CHF kredita. Županijski sud u Puli i Karlovcu: Rješenje iz oglednog postupka nema nikakav utjecaj na obeštećenje iz konvertiranih kredita

Županijski sud u Puli je 27. travnja 2020. donio odluku kojom se utvrđuje da ogledni postupak kojim se utvrđivala valjanost aneksa za konverziju nema utjecaj na tužbe iz konvertiranih kredita. Prethodno je Županijski sud u Karlovcu donio istu takvu odluku 11. ožujka 2020.

Pulska sutkinja Alenka Paus i karlovačka sutkinja Milka Vraneš, obje na žalbu splitskog odvjetnika Srđana Kalebote zbog prekida privatnog sudskog postupka uslijed oglednog postupka, utvrdile su kako je donesena odluka u oglednom postupku te da ta odluka, odnosno valjanost ili ništetnost aneksa, nije od značaja za obeštećenje potrošača do dana konverzije.

Istaknuto je to u objavi udruge Franak koja je još prije desetak dana objavila i pravomoćnu presudu Županijskoga suda u Zadru kojom je također nakon ogle...
