Općinski sud u Zadru donio je 30. siječnja 2019. još jednu presudu u korist potrošača nakon konverzije kredita u švicarskim francima (CHF) na temelju koje OTP banka mora platiti 400.000 kuna preplaćenih i zateznih kamata potrošaču te još 36.000 kuna sudskih troškova.

Kako su izvijestili iz Udruge "Franak", sud je utvrdio da je konverzijom obavljena samo promjena valute kredita, ali da uopće nisu sanirane nevaljane odredbe o promjenjivoj kamatnoj stopi.

- Sud je odlučio da zaključenjem i potpisivanjem Aneksa nisu sanirani razlozi koji su bili razlog ništetnosti konkretne ugovorne odredbe te je utvrdio da prema odredbi članka 326. stavka 1. Zakona o obveznim odnosima ništetan ugovor, ili njegov dio, ne postaje valjan nakon što uzrok ništetnosti naknadno nestane - priopćili su iz Udruge.

Dodaju da je sud odlučio kako se aneksom ugovora o kreditu uredilo pitanje određivanja kamatne stope isključivo nakon njegova sklapanja, ali se time nije riješilo pitanje preplaćenih kamata u CHF kreditima u prethodno utuženom razdoblju, a do kojih je došlo zbog nepoštena postupanja banaka.

- To je veliko novo ohrabrenje prije donošenja konačne odluke Vrhovnoga suda RH o našim pravima nakon konverzije. Ponovno apeliramo na Vrhovni sud RH da vremena za čekanje više nema.

Potrošači moraju imati pravnu sigurnost, i mada pravo EU-a nedvojbeno nalaže da se mora izvršiti restitucija zbog nepoštenih ugovora od početka nepoštene prakse, mi i dalje nemamo pravnu sigurnost sve dok Vrhovni sud ne donese potrebnu odluku o tome - ističu u Udruzi "Franak".

Općinski sud u Zadru donio je 30. siječnja 2019. još jednu presudu u korist potrošača nakon konverzije kredita u švicarskim francima (CHF) na temelju koje OTP banka mora platiti 400.000 kuna preplaćenih i zateznih kamata potrošaču te još 36.000 kuna sudskih troškova.

Kako su izvijestili iz Udruge "Franak", sud je utvrdio da je konverzijom obavljena samo promjena valute kredita, ali da uopće nisu sanirane nevaljane odredbe o promjenjivoj kamatnoj stopi.

- Sud je odlučio da zaključenjem i potpisivanjem Aneksa nisu sanirani razlozi koji su bili razlog ništetnosti konkretne ugovorne odredbe te je utvrdio da prema odredbi članka 326. stavka 1. Zakona o obveznim odnosima ništetan ugovor, ili njegov dio, ne postaje valjan nakon što uzrok ništetnosti naknadno nestane - priopćili su iz Udruge.

Dodaju da je sud odlučio kako se aneksom ugovora o kreditu uredilo pitanje određivanja kamatne stope isključivo nakon njegova sklapanja, ali se time nije riješilo pitanje preplaćenih kamata u CHF kreditima u prethodno utuženom razdoblju, a do kojih je došlo zbog nepoštena postupanja banaka.

- To je veliko novo ohrabrenje prije donošenja konačne odluke Vrhovnoga suda RH o našim pravima nakon konverzije. Ponovno apeliramo na Vrhovni sud RH da vremena za čekanje više nema.

Potrošači moraju imati pravnu sigurnost, i mada pravo EU-a nedvojbeno nalaže da se mora izvršiti restitucija zbog nepoštenih ugovora od početka nepoštene prakse, mi i dalje nemamo pravnu sigurnost sve dok Vrhovni sud ne donese potrebnu odluku o tome - ističu u Udruzi "Franak".
