Posljednji dan norveške parnice u kojoj se Tomislav Debeljak suočava s optužbom "Stečajne mase" da je kao predsjednik uprave "Kleven Verfta" bacio u stečaj to norveško brodogradilište - samo tri mjeseca nakon što ga je bio kupio u proljeće 2020. godine - zaključen je u petak završnim riječima odvjetnika, a presuda se očekuje kroz dva tjedna ili nešto kasnije.
Kao što smo već javljali, u naplatnom redu je 200 vjerovnika. Odštetni zahtjev zasad je težak 136 milijuna norveških kruna, odnosno 11,5 milijuna eura. Eurski iznos se mijenja s obzirom na tečajne fluktuacije. Brzinski ljetni bankrot na krovu Europe ostavio je bio 440 ljudi bez posla. U međuvremenu je škver prodan i bez problema radi pod imenom "Green Yard Kleven", nemajući veze s parnicom o kojoj govorimo.
Norveški mediji jako su zainteresirani za slučaj i prate ga s velikom pažnjom. Tako je naš kolega Arvid Steen, glavni urednik portala "Kystens Næringsliv", u petak donio obiman zaključni tekst, sažimajući najbitnije dijelove osmodnevnog procesa u sudnici hordalandskog okružnog suda.
Ključno je pitanje tko je odgovoran za "Klevenov" šokantni i iznenadni stečaj - Debeljak, kako to vjeruju zastupnici "Stečajne mase", ili bankari, što potencira Debeljakova obrana?! I hoće li vjerovnici na koncu doći do ikakva obeštećenja?!
"Riječ je jednostavno o apsurdnom sudskom sporu sa stečajem koji je trebalo izbjeći. Ne razumijemo koja je bila Debeljakova namjera kada je provocirao banke govoreći da im neće platiti kredit. A ni platiti podizvođače radova u brodogradilištu. Kao predsjednik uprave i vlasnik brodogradilišta. To je bilo potpuno apsurdno!"

Istaknuo je to Jan Vablum, zastupnik "Stečajne mase", iz uglednog odvjetničkog društva "Simonsen Vogt Wiig" još prvog dana suđenja, nazivajući u više navrata "Klevenov" bankrot apsurdnim i nepotrebnim.
Norveški novinari, prije svih "Kystensov" urednik Arvid Steen, smatraju da će mnogo toga ovisiti o sučevoj procjeni ključnog i eksplozivnog Debeljakova sastanka s bankarima u Oslu, sudbonosnog dana 23. lipnja 2020. godine. O teškim riječima, lupanju šakama o stol i naelektriziranoj atmosferi s tog skupa već smo javljali.
- Na sastanku je bilo više od 20 ljudi. Pokazalo se da je to bio početak kraja brodogradilišta "Kleven". To je imalo i velike negativne učinke među stanovnicima okruga Sunnmøre, budući su mnogi računi ostali neplaćeni, kaže urednik Steen.
Ali tko pobjeđuje? Tko govori istinu? To se pitaju norveški mediji. Debeljak tvrdi da su ga bankari prevarili, a oni uzvraćaju istom mjerom - da ih je posrnuli poduzetnik, vlasnik "Brodosplita" i "DIV Grupe", grdio i ismijavao.
Debeljak ističe kako mu je bez ikakva upozorenja rečeno da banke ne vjeruju njegovoj platežnoj sposobnosti. I da su ga htjele pregaziti. Nisu ga, navodno, ni upozorile, nastojeći spasiti sebe.
Štoviše, obrana tvrdi da je "nevini otac devetoro djece koji živi na minimalcu izgubio sto milijuna eura u ‘Klevenu‘". A i da bankari nisu napravili sve po proceduri kada su - poslije ključnog sastanka - otkazali financiranje škvera. Užasnuti njegovim navodima da kredite neće vratiti, ni podizvođače platiti.
Tek će se vidjeti komu će sud povjerovati. Stane li na stranu Debeljaka, Samoborac neće morati isplatiti odštetu "Stečajnoj masi" i vjerovnicima.
"U tom slučaju ni banke ne bi odgovarale, budući da bi taj odštetni zahtjev bio u zastari, sve bi palo u vodu i vjerovnicima nitko ne bi platio ni centa", kaže urednik Steen, pozivajući se na dobro upućene izvore.

Debeljak bi se, kažu Norvežani, mogao rasterećen vratiti kući u Hrvatsku "gdje ga čekaju mnogostruko veći problemi s vlastima i kreditorima".
Ipak, zastupnici "Stečajne mase" drže da se Debeljak ponašao neodgovorno i nemarno, toliko nepoželjno i senzacionalno da su banke odmah raskinule ugovore o kreditu.
"Samo ponašanje predsjedavajućeg na sastanku 23. lipnja 2020. dovoljno je za utvrđivanje odgovornosti za štetu i bilo je uzrokom štete koju je ‘Kleven‘ pretrpio raskidom ugovora o zajmu", ističu tužitelji u završnici procesa.
Novinari u Norveškoj iznose sumnju u realnost naplate odštete od Debeljaka, bude li proglašen krivim. Soli na rep, reklo bi se u nas...
- On je u posebno teškoj financijskoj situaciji u svojoj domovini. I privatno i poslovno, kaže urednik Steen.
Iako, presuda norveškog suda može biti ovršna isprava i u Hrvatskoj, na temelju čega bi "Stečajna masa" mogla tražiti prisilnu naplatu ili blokirati Debeljakove račune i imovinu. Ako je još ima... On u Norveškoj posjeduje i policu osiguranja od menažerske odgovornosti tešku 30 milijuna kruna (oko 2,5 milijuna eura).
Uglavnom, šef portala "Kystens.no" zaključuje da zatvora ne može biti jer nije riječ o kaznenom postupku:
- Dakle, u ovoj parnici neće biti pobjednika. Bez obzira tko formalno pobijedi u sudnici.

Posljednji dan norveške parnice u kojoj se Tomislav Debeljak suočava s optužbom "Stečajne mase" da je kao predsjednik uprave "Kleven Verfta" bacio u stečaj to norveško brodogradilište - samo tri mjeseca nakon što ga je bio kupio u proljeće 2020. godine - zaključen je u petak završnim riječima odvjetnika, a presuda se očekuje kroz dva tjedna ili nešto kasnije.
Kao što smo već javljali, u naplatnom redu je 200 vjerovnika. Odštetni zahtjev zasad je težak 136 milijuna norveških kruna, odnosno 11,5 milijuna eura. Eurski iznos se mijenja s obzirom na tečajne fluktuacije. Brzinski ljetni bankrot na krovu Europe ostavio je bio 440 ljudi bez posla. U međuvremenu je škver prodan i bez problema radi pod imenom "Green Yard Kleven", nemajući veze s parnicom o kojoj govorimo.
Norveški mediji jako su zainteresirani za slučaj i prate ga s velikom pažnjom. Tako je naš kolega Arvid Steen, glavni urednik portala "Kystens Næringsliv", u petak donio obiman zaključni tekst, sažimajući najbitnije dijelove osmodnevnog procesa u sudnici hordalandskog okružnog suda.
Ključno je pitanje tko je odgovoran za "Klevenov" šokantni i iznenadni stečaj - Debeljak, kako to vjeruju zastupnici "Stečajne mase", ili bankari, što potencira Debeljakova obrana?! I hoće li vjerovnici na koncu doći do ikakva obeštećenja?!
"Riječ je jednostavno o apsurdnom sudskom sporu sa stečajem koji je trebalo izbjeći. Ne razumijemo koja je bila Debeljakova namjera kada je provocirao banke govoreći da im neće platiti kredit. A ni platiti podizvođače radova u brodogradilištu. Kao predsjednik uprave i vlasnik brodogradilišta. To je bilo potpuno apsurdno!"

Istaknuo je to Jan Vablum, zastupnik "Stečajne mase", iz uglednog odvjetničkog društva "Simonsen Vogt Wiig" još prvog dana suđenja, nazivajući u više navrata "Klevenov" bankrot apsurdnim i nepotrebnim.
Norveški novinari, prije svih "Kystensov" urednik Arvid Steen, smatraju da će mnogo toga ovisiti o sučevoj procjeni ključnog i eksplozivnog Debeljakova sastanka s bankarima u Oslu, sudbonosnog dana 23. lipnja 2020. godine. O teškim riječima, lupanju šakama o stol i naelektriziranoj atmosferi s tog skupa već smo javljali.
- Na sastanku je bilo više od 20 ljudi. Pokazalo se da je to bio početak kraja brodogradilišta "Kleven". To je imalo i velike negativne učinke među stanovnicima okruga Sunnmøre, budući su mnogi računi ostali neplaćeni, kaže urednik Steen.
Ali tko pobjeđuje? Tko govori istinu? To se pitaju norveški mediji. Debeljak tvrdi da su ga bankari prevarili, a oni uzvraćaju istom mjerom - da ih je posrnuli poduzetnik, vlasnik "Brodosplita" i "DIV Grupe", grdio i ismijavao.
Debeljak ističe kako mu je bez ikakva upozorenja rečeno da banke ne vjeruju njegovoj platežnoj sposobnosti. I da su ga htjele pregaziti. Nisu ga, navodno, ni upozorile, nastojeći spasiti sebe.
Štoviše, obrana tvrdi da je "nevini otac devetoro djece koji živi na minimalcu izgubio sto milijuna eura u ‘Klevenu‘". A i da bankari nisu napravili sve po proceduri kada su - poslije ključnog sastanka - otkazali financiranje škvera. Užasnuti njegovim navodima da kredite neće vratiti, ni podizvođače platiti.
Tek će se vidjeti komu će sud povjerovati. Stane li na stranu Debeljaka, Samoborac neće morati isplatiti odštetu "Stečajnoj masi" i vjerovnicima.
"U tom slučaju ni banke ne bi odgovarale, budući da bi taj odštetni zahtjev bio u zastari, sve bi palo u vodu i vjerovnicima nitko ne bi platio ni centa", kaže urednik Steen, pozivajući se na dobro upućene izvore.

Debeljak bi se, kažu Norvežani, mogao rasterećen vratiti kući u Hrvatsku "gdje ga čekaju mnogostruko veći problemi s vlastima i kreditorima".
Ipak, zastupnici "Stečajne mase" drže da se Debeljak ponašao neodgovorno i nemarno, toliko nepoželjno i senzacionalno da su banke odmah raskinule ugovore o kreditu.
"Samo ponašanje predsjedavajućeg na sastanku 23. lipnja 2020. dovoljno je za utvrđivanje odgovornosti za štetu i bilo je uzrokom štete koju je ‘Kleven‘ pretrpio raskidom ugovora o zajmu", ističu tužitelji u završnici procesa.

- On je u posebno teškoj financijskoj situaciji u svojoj domovini. I privatno i poslovno, kaže urednik Steen.
Iako, presuda norveškog suda može biti ovršna isprava i u Hrvatskoj, na temelju čega bi "Stečajna masa" mogla tražiti prisilnu naplatu ili blokirati Debeljakove račune i imovinu. Ako je još ima... On u Norveškoj posjeduje i policu osiguranja od menažerske odgovornosti tešku 30 milijuna kruna (oko 2,5 milijuna eura).
Uglavnom, šef portala "Kystens.no" zaključuje da zatvora ne može biti jer nije riječ o kaznenom postupku:
- Dakle, u ovoj parnici neće biti pobjednika. Bez obzira tko formalno pobijedi u sudnici.
