Prošle jeseni su inspektori Ministarstva financija u novčaniku konobara u jednom poznatom istarskom obiteljskom hotelu s četiri zvjezdice pronašli 23 kune viška. Nekoliko mjeseci kasnije vlasniku je od države stigla kazna. Drakonska kazna.

- Na ime tvrtke dobio sam kaznu od 20.100 kuna, a meni, kao odgovornoj osobi, odrezali su novčanu kaznu u iznosu od 5.100 kuna. Sveukupno 25.200 kuna, što je tisuću puta više od utvrđenog 'viška' u novčaniku, objašnjava vlasnik hotela za Glas Istre.

Ovaj ugledni ugostitelj kaže da se radilo o napojnici koju je konobar dobio netom prije nego što je inspektor tražio njegov novčanik na uvid.

- Došetali su iznenada do mog hotela i zavirili u novčanik konobara koji je radio u jutarnjoj smjeni. Budnom oku inspektora nije promakao spomenuti višak u novčaniku, a konobar je pokušao objasniti da je to napojnica što je uredno zavedeno i u zapisniku, kaže vlasnik hotela koji je novinarima dao na uvid i izjavu svog zaposlenika s lica mjesta.

- Navedene 23 kune koje su zatečene kao višak dio su napojnice koju sam ranije dobio od gostiju, koji su svoju konzumaciju plaćali gotovinom. Svatko je plaćao svoju pijaču, pa sam od svakog i ponešto dobio. Odmah pri ulasku u objekt inspektor je zatražio da mu pružim novčanik, tako da nisam stigao izdvojiti razliku, ali sam uredno napomenuo da postoji moguća razlika od 23 kune, kazao je nesretni konobar, a inspektor je to zapisao, prenosi Glas Istre.

Nakon tog inspekcijskog nalaza poduzetniku je uslijedila 'čestitka' teška više od 25.000 kuna.

U dopisu pristiglom iz Ministarstva financija - Carinske uprave i njezine službe za nadzor iz Pule stiglo je i obrazloženje vezano uz ovaj slučaj.

Između ostalog, u obrazloženju stoji da je "…ovo tijelo uzelo osobito u obzir kao otegotnu okolnost da se u konkretnom slučaju radi o počinjenju djela prekršaja iznimne i očite društvene opasnosti kojim se izravno podriva stabilnost i temeljni smisao uređenja poreznog sustava s izravnim društveno štetnim konzekvencama za stabilnost ukupnog poreznog sustava Republike Hrvatske… Temeljem članka 76. stavka 1. Prekršajnog zakona uz primjenu članka 192. stavaka 6. Općeg poreznog zakona od poreznog obveznika oduzima se imovinska korist ostvarena počinjenjem prekršaja u iznosu od 23 tisuće kuna."

- Možda je ovo obrazloženje za izricanje prekršaja običan copy paste, šablonizirani tekst, ali meni je zazvučalo kao pretjerano treniranje strogoće i zaista bi trebalo biti uvredljivo za svakog hrvatskog poduzetnika koji uredno ispunjava sve svoje obveze prema državi i ostalim poslovnim partnerima.

Trideset godina sam u poduzetništvu, zapošljavam stotine radnika i osvajao sam prestižne nagrade za rezultate rada. Stoga mislim da su trebali provjeriti status moje firme i pokazati malo poštovanja, pronaći i olakotne okolnosti. Mogli su mi poslati opomenu, kulturnu obavijest, a ne ovako rigoroznu kaznu, kaže razočarani ugostitelj.

Vlasnik hotela kaže i da je podnio prigovor na rješenje pa zaključio:

- Toliko o razvoju poduzetništva i turizma u nas, toliko o poticajnim mjerama od strane države prema poduzetnicima. Ma recite mi, zašto bih trebao ostati u takvoj državi? Nisam jedini koji tako razmišlja. Pa zamislite vi takve optužbe i tolika kazna zbog samo 23 kune napojnice.

Prošle jeseni su inspektori Ministarstva financija u novčaniku konobara u jednom poznatom istarskom obiteljskom hotelu s četiri zvjezdice pronašli 23 kune viška. Nekoliko mjeseci kasnije vlasniku je od države stigla kazna. Drakonska kazna.

- Na ime tvrtke dobio sam kaznu od 20.100 kuna, a meni, kao odgovornoj osobi, odrezali su novčanu kaznu u iznosu od 5.100 kuna. Sveukupno 25.200 kuna, što je tisuću puta više od utvrđenog 'viška' u novčaniku, objašnjava vlasnik hotela za Glas Istre.

Ovaj ugledni ugostitelj kaže da se radilo o napojnici koju je konobar dobio netom prije nego što je inspektor tražio njegov novčanik na uvid.

- Došetali su iznenada do mog hotela i zavirili u novčanik konobara koji je radio u jutarnjoj smjeni. Budnom oku inspektora nije promakao spomenuti višak u novčaniku, a konobar je pokušao objasniti da je to napojnica što je uredno zavedeno i u zapisniku, kaže vlasnik hotela koji je novinarima dao na uvid i izjavu svog zaposlenika s lica mjesta.

- Navedene 23 kune koje su zatečene kao višak dio su napojnice koju sam ranije dobio od gostiju, koji su svoju konzumaciju plaćali gotovinom. Svatko je plaćao svoju pijaču, pa sam od svakog i ponešto dobio. Odmah pri ulasku u objekt inspektor je zatražio da mu pružim novčanik, tako da nisam stigao izdvojiti razliku, ali sam uredno napomenuo da postoji moguća razlika od 23 kune, kazao je nesretni konobar, a inspektor je to zapisao, prenosi Glas Istre.

Nakon tog inspekcijskog nalaza poduzetniku je uslijedila 'čestitka' teška više od 25.000 kuna.

U dopisu pristiglom iz Ministarstva financija - Carinske uprave i njezine službe za nadzor iz Pule stiglo je i obrazloženje vezano uz ovaj slučaj.

Između ostalog, u obrazloženju stoji da je "…ovo tijelo uzelo osobito u obzir kao otegotnu okolnost da se u konkretnom slučaju radi o počinjenju djela prekršaja iznimne i očite društvene opasnosti kojim se izravno podriva stabilnost i temeljni smisao uređenja poreznog sustava s izravnim društveno štetnim konzekvencama za stabilnost ukupnog poreznog sustava Republike Hrvatske… Temeljem članka 76. stavka 1. Prekršajnog zakona uz primjenu članka 192. stavaka 6. Općeg poreznog zakona od poreznog obveznika oduzima se imovinska korist ostvarena počinjenjem prekršaja u iznosu od 23 tisuće kuna."

- Možda je ovo obrazloženje za izricanje prekršaja običan copy paste, šablonizirani tekst, ali meni je zazvučalo kao pretjerano treniranje strogoće i zaista bi trebalo biti uvredljivo za svakog hrvatskog poduzetnika koji uredno ispunjava sve svoje obveze prema državi i ostalim poslovnim partnerima.

Trideset godina sam u poduzetništvu, zapošljavam stotine radnika i osvajao sam prestižne nagrade za rezultate rada. Stoga mislim da su trebali provjeriti status moje firme i pokazati malo poštovanja, pronaći i olakotne okolnosti. Mogli su mi poslati opomenu, kulturnu obavijest, a ne ovako rigoroznu kaznu, kaže razočarani ugostitelj.

Vlasnik hotela kaže i da je podnio prigovor na rješenje pa zaključio:

- Toliko o razvoju poduzetništva i turizma u nas, toliko o poticajnim mjerama od strane države prema poduzetnicima. Ma recite mi, zašto bih trebao ostati u takvoj državi? Nisam jedini koji tako razmišlja. Pa zamislite vi takve optužbe i tolika kazna zbog samo 23 kune napojnice.

Prošle jeseni su inspektori Ministarstva financija u novčaniku konobara u jednom poznatom istarskom obiteljskom hotelu s četiri zvjezdice pronašli 23 kune viška. Nekoliko mjeseci kasnije vlasniku je od države stigla kazna. Drakonska kazna.

- Na ime tvrtke dobio sam kaznu od 20.100 kuna, a meni, kao odgovornoj osobi, odrezali su novčanu kaznu u iznosu od 5.100 kuna. Sveukupno 25.200 kuna, što je tisuću puta više od utvrđenog 'viška' u novčaniku, objašnjava vlasnik hotela za Glas Istre.

Ovaj ugledni ugostitelj kaže da se radilo o napojnici koju je konobar dobio netom prije nego što je inspektor tražio njegov novčanik na uvid.
