Hrvatska agencija za poštu i elektroničke komunikacije (HAKOM) utvrdila je da je Hrvatski telekom (HT) kršio regulirane maloprodajne cijene telekomunikacijskih usluga u nepokrenoj mreži te je rješenjem HT-u zabranio svako daljnje nuđenje, ugovaranje i pružanje usluga u fiksnoj telefoniji po cijenama nižim od onih odobrenih od strane HAKOM-a, kao i odobravanje bilo kakvih popusta na cijene niže od odobrenih.

Prekršena obveza

HAKOM je, kako se navodi u rješenju objavljenom na web-stranicama te agencije, postupak stručnog nadzora nad HT-om pokrenuo na temelju prijave tvrtke Metronet telekomunikacije iz veljače ove godine.

Utvrđeno je da je HT prekršio regulatornu obvezu iz članka 63. Zakona o telekomunikacijama jer je nudio, ugovarao i pružao javnu govornu uslugu u nepokretnoj mreži velikim korisnicima po cijenama nižim od onih odobrenih od strane HAKOM-a i uz primjenu diskriminirajućih i netransparentnih popusta, čime je onemogućio pravednu tržišnu utakmicu definiranu Zakonom o telekomunikacijama.

HAKOM je stoga zabranio HT-u svako daljnje nuđenje, ugovaranje i pružanje usluga po cijenama nižim od odobrenih, kao i odobravanje bilo kakvih popusta na cijene niže od odobrenih.

HT, pak, u jednom od svojih podnesaka koji se citira u obrazloženju rješenja, navodi da maloprodajne usluge u nepokretnoj javnoj telefonskoj mreži nudi prema cijenama iz cjenika objavljenog na svojoj službenoj internetskoj stranici, sukladno zakonu.

Navodi i da radi ostvarivanja zahtjeva za troškovno orijentiranim cijenama, na cijene iz cjenika za uslugu u nepokretnoj javnoj telefonskoj mreži velikim poslovnim korisnicima odobrava količinske popuste koji nisu zabranjeni.

HT smatra da se odobravanjem tih popusta ne mijenja pojedinačna cijena po jedinici usluge, nego se samo korisnicima koji dosegnu određene količine prometa odobrava popust.

Hrvatska agencija za poštu i elektroničke komunikacije (HAKOM) utvrdila je da je Hrvatski telekom (HT) kršio regulirane maloprodajne cijene telekomunikacijskih usluga u nepokrenoj mreži te je rješenjem HT-u zabranio svako daljnje nuđenje, ugovaranje i pružanje usluga u fiksnoj telefoniji po cijenama nižim od onih odobrenih od strane HAKOM-a, kao i odobravanje bilo kakvih popusta na cijene niže od odobrenih.

Prekršena obveza

HAKOM je, kako se navodi u rješenju objavljenom na web-stranicama te agencije, postupak stručnog nadzora nad HT-om pokrenuo na temelju prijave tvrtke Metronet telekomunikacije iz veljače ove godine.

Utvrđeno je da je HT prekršio regulatornu obvezu iz članka 63. Zakona o telekomunikacijama jer je nudio, ugovarao i pružao javnu govornu uslugu u nepokretnoj mreži velikim korisnicima po cijenama nižim od onih odobrenih od strane HAKOM-a i uz primjenu diskriminirajućih i netransparentnih popusta, čime je onemogućio pravednu tržišnu utakmicu definiranu Zakonom o telekomunikacijama.

HAKOM je stoga zabranio HT-u svako daljnje nuđenje, ugovaranje i pružanje usluga po cijenama nižim od odobrenih, kao i odobravanje bilo kakvih popusta na cijene niže od odobrenih.

HT, pak, u jednom od svojih podnesaka koji se citira u obrazloženju rješenja, navodi da maloprodajne usluge u nepokretnoj javnoj telefonskoj mreži nudi prema cijenama iz cjenika objavljenog na svojoj službenoj internetskoj stranici, sukladno zakonu.

Navodi i da radi ostvarivanja zahtjeva za troškovno orijentiranim cijenama, na cijene iz cjenika za uslugu u nepokretnoj javnoj telefonskoj mreži velikim poslovnim korisnicima odobrava količinske popuste koji nisu zabranjeni.

HT smatra da se odobravanjem tih popusta ne mijenja pojedinačna cijena po jedinici usluge, nego se samo korisnicima koji dosegnu određene količine prometa odobrava popust.
