Informacija u medijima o pokretanju ovrhe nad imovinom Hrvatske poštanske banke (HPB) zbog spora s Juštom Puharićem nema nikakav utjecaj na HPB-ovo poslovanje, a sredstva za spor u cijelosti su rezervirana, priopćio je u srijedu HPB, uz napomenu da Banka još nije iscrpila sve pravne mogućnosti koje su joj na raspolaganju.
"Glede medijskih objava o pokretanju ovrhe nad imovinom Banke nastavno na donesenu presudu protiv HPB-a (....), Banka ističe da to nema nikakav utjecaj na poslovanje Banke te nema materijalno značajan utjecaj na vrijednost njene imovine, kapitaliziranost i financijski položaj u cjelini. Također, imovina fondova u potpunosti je zaštićena u odnosu na ovaj i sve potencijalne ostale sudske postupke HPB Investa i Banke", kaže se u HPB-ovom priopćenju.
Dodaje se kako HPB posluje stabilno i ostvaruje ciljane rezultate u svim segmentima poslovanja te je formirao rezerve za spor s Puharićem u cjelokupnoj vrijednosti od 12,67 milijuna kuna, zajedno s pripadajućom zakonskom zateznom kamatom te troškovima parničnog postupka.
To je rezerviranje iskazano u financijskim izvještajima za prvo polugodište 2021. godine, a iznos tužbenog zahtjeva s pripadajućim zakonskim zateznim kamatama i troškovima manji je od jedan posto prosječnog dnevnog stanja raspoloživih novčanih sredstava kojima HPB raspolaže, ističu iz te banke.
"Banka još uvijek nije iscrpila sve pravne mogućnosti koje su joj na raspolaganju da zaštiti svoju imovinu od izvršenja presude, za što vjeruje da postoji mogućnost uspjeha. Kada svi pravni koraci budu iscrpljeni ili uspjeh u osporavanju presude više ne bude vjerojatan, Banka će postupiti u skladu sa svojim obvezama u danom trenutku", zaključuje se u priopćenju.
Jutarnji list u srijedu je objavio kako je bivši klijent HPB-a Jušte Puharić dobio pravomoćnu presudu prema kojoj mu ta banka mora isplatiti iznos od oko 12,7 milijuna kuna, sa zakonskim zateznim kamatama, ali kako ona to odbija učiniti, pokrenuo je ovrhu.
Naime, piše Jutarnji, Općinski građanski sud u Zagrebu 1. rujna donio prijedlog u kojem navodi da je rok za dobrovoljno namirenje tražbine protekao te da je ovrhovitelj prisiljen na prisilno ostvarenje tražbine "ovrhom na poslovnom udjelu ovršenika u društvu HPB Invest u iznosu od pet milijuna kuna koje HPB u njemu ima".
Osim toga, Općinski sud donio je još jedno rješenje o ovrsi "kojim se određuje ovrha na nekretnini u vlasništvu banke na adresi Jurišićeva br. 4, na kojoj se nalazi registrirano sjedište banke", te mora platiti dodatne troškove ovršnih postupaka.
Priča je počela 2009. godine, kada je Puharić, tada aktivni sudionik na tržištu kapitala koji se danas bavi različitim djelatnostima, zatražio naknadu štete zbog toga što banka nije na vrijeme izvršila nalog za prodaju dionica.
Zakasnjelo izvršenje naloga za prodaju dionica koje su se nalazile na skrbničkom računu u banci kao sredstvo osiguranja za povrat kredita, kako je klijent uspio dokazati, imalo je za rezultat znatno niže prodajne cijene od onih koje bi se postigle pravodobnom prodajom, donosi Jutarnji list.
U korist Puharića presudu je najprije donio Općinski sud u Zagrebu, a potom je Županijski sud u Varaždinu 1. srpnja ove godine donio drugostupanjsku presudu.
Banka ima pravo uložiti reviziju na presudu, ali to ne odgađa izvršenje, navodi Jutarnji list.

Informacija u medijima o pokretanju ovrhe nad imovinom Hrvatske poštanske banke (HPB) zbog spora s Juštom Puharićem nema nikakav utjecaj na HPB-ovo poslovanje, a sredstva za spor u cijelosti su rezervirana, priopćio je u srijedu HPB, uz napomenu da Banka još nije iscrpila sve pravne mogućnosti koje su joj na raspolaganju.
"Glede medijskih objava o pokretanju ovrhe nad imovinom Banke nastavno na donesenu presudu protiv HPB-a (....), Banka ističe da to nema nikakav utjecaj na poslovanje Banke te nema materijalno značajan utjecaj na vrijednost njene imovine, kapitaliziranost i financijski položaj u cjelini. Također, imovina fondova u potpunosti je zaštićena u odnosu na ovaj i sve potencijalne ostale sudske postupke HPB Investa i Banke", kaže se u HPB-ovom priopćenju.
Dodaje se kako HPB posluje stabilno i ostvaruje ciljane rezultate u svim segmentima poslovanja te je formirao rezerve za spor s Puharićem u cjelokupnoj vrijednosti od 12,67 milijuna kuna, zajedno s pripadajućom zakonskom zateznom kamatom te troškovima parničnog postupka.
To je rezerviranje iskazano u financijskim izvještajima za prvo polugodište 2021. godine, a iznos tužbenog zahtjeva s pripadajućim zakonskim zateznim kamatama i troškovima manji je od jedan posto prosječnog dnevnog stanja raspoloživih novčanih sredstava kojima HPB raspolaže, ističu iz te banke.
"Banka još uvijek nije iscrpila sve pravne mogućnosti koje su joj na raspolaganju da zaštiti svoju imovinu od izvršenja presude, za što vjeruje da postoji mogućnost uspjeha. Kada svi pravni koraci budu iscrpljeni ili uspjeh u osporavanju presude više ne bude vjerojatan, Banka će postupiti u skladu sa svojim obvezama u danom trenutku", zaključuje se u priopćenju.
Jutarnji list u srijedu je objavio kako je bivši klijent HPB-a Jušte Puharić dobio pravomoćnu presudu prema kojoj mu ta banka mora isplatiti iznos od oko 12,7 milijuna kuna, sa zakonskim zateznim kamatama, ali kako ona to odbija učiniti, pokrenuo je ovrhu.
Naime, piše Jutarnji, Općinski građanski sud u Zagrebu 1. rujna donio prijedlog u kojem navodi da je rok za dobrovoljno namirenje tražbine protekao te da je ovrhovitelj prisiljen na prisilno ostvarenje tražbine "ovrhom na poslovnom udjelu ovršenika u društvu HPB Invest u iznosu od pet milijuna kuna koje HPB u njemu ima".
Osim toga, Općinski sud donio je još jedno rješenje o ovrsi "kojim se određuje ovrha na nekretnini u vlasništvu banke na adresi Jurišićeva br. 4, na kojoj se nalazi registrirano sjedište banke", te mora platiti dodatne troškove ovršnih postupaka.
Priča je počela 2009. godine, kada je Puharić, tada aktivni sudionik na tržištu kapitala koji se danas bavi različitim djelatnostima, zatražio naknadu štete zbog toga što banka nije na vrijeme izvršila nalog za prodaju dionica.
Zakasnjelo izvršenje naloga za prodaju dionica koje su se nalazile na skrbničkom računu u banci kao sredstvo osiguranja za povrat kredita, kako je klijent uspio dokazati, imalo je za rezultat znatno niže prodajne cijene od onih koje bi se postigle pravodobnom prodajom, donosi Jutarnji list.
U korist Puharića presudu je najprije donio Općinski sud u Zagrebu, a potom je Županijski sud u Varaždinu 1. srpnja ove godine donio drugostupanjsku presudu.
Banka ima pravo uložiti reviziju na presudu, ali to ne odgađa izvršenje, navodi Jutarnji list.
