Otkup dugova u pravilu se povezuje s tajnovitim osobama koje građane presreću i s njima pokušavaju dogovoriti naplatu potraživanja, ali sada se na tržištu pojavljuju neki drugačiji igrači i nude svoju pomoć, piše Novac.hr. U dnevnim novinama pojavio se oglas pod naslovom "Novost na ovim prostorima: isplata korisnika kredita", a potencijalnim klijentima obraća se riječima:

"Podigli ste kredit u švicarskim francima u banci u razdoblju od 2004. do 2008. godine? Niste pokrenuli sudski spor? Imamo ponudu za Vas! Otkupljujemo Vaše potraživanje prema banci uz preuzimanje rizika i troškova sudskog postupka, kao i rizika naplate od banke, a Vas isplaćujemo ODMAH".

Dostava dokumentacije

Objavila ga je tvrtka Consensus plus iz Labina, koja je registrirana ove godine, a prije svega se bavi "otkupom potraživanja potrošača prema bankama". One koji nisu konvertirali kredit i dosad nisu tužili banku, direktorica tvrtke Soave Škropeta-Vukić poziva da im dostave dokumentaciju mailom ili nazovu i dogovore sve pojedinosti, a u slučaju potrebe, tvrtka nudi i pomoć u pribavljanju dokumentacije. Nakon što osiguraju sve potrebno, sastavljaju izračun i potrošaču dostavljaju ponudu. Kada je riječ o iznosu isplate, tvrtka ističe da on ovisi o izračunu.

Prema riječima dužnika koji je u pregovorima s osobljem Consensus plusa, ponuđen mu je otkup od 30 posto vrijednosti potraživanja prema banci, ali dodaje kako u nekim slučajevima iznosi i više. Smatra da to nije dovoljno jer su u pitanju samo nekonvertirani krediti za koje postoje dobri izgledi u sudskom procesu.

Računajući i zatezne kamate, dodaje, konačan iznos koji se može dobiti od banke znatno premašuje utvrđeno potraživanje. Od oko 125.000 kredita u švicarskim francima, nekonvertirano ih je ostalo oko 70.000. Neki od dužnika sami su davno pokrenuli tužbe protiv banaka, pa dobili i presude. Premda posljednja odluka Ustavnog suda, kojom su odbijene tužbe banaka, ne donosi nikakva nova prava za potrošače, nego samo potvrđuje ništetnost valutne klauzule, vrlo je vjerojatno da će ona potaknuti pokretanje novih tužbi.

Za razliku od dužnika koji su imali stambene kredite, uglavnom su ih konvertirali i sada čekaju mišljenje Suda Europske unije o tome imaju li i dalje pravo na obeštećenje, kod nekonvertiranih kredita situacija je prilično jasnija. Banke je moguće tužiti na temelju ništetnih odredbi o promjeni kamatne stope i tečaja.

Prema riječima direktora Hrvatske udruge banaka Zdenka Adrovića, u slučaju nekonvertiranih kredita uglavnom je riječ o manjim iznosima koji su se koristili za kupnju automobila, a kako je dobar dio tih kredita otplaćen i prije nego što su rate počele snažno rasti, procjenjuje da bi obeštećenje bilo malo. K tome, imajući u vidu trajanje sudskih procesa, smatra da se podizanje tužbi potrošačima ne bi niti isplatilo.

Utemeljenost u zakonu

No, s pojavom "profesionalaca" biznis oko tužbi, čini se, poprima nove dimenzije. Pritom se postavlja i pitanje koliko je nova praksa utemeljena na zakonu. Odvjetnik koji se već dulje vrijeme bavi ovom problematikom, pozivajući se na nacionalne i europske propise, postavlja pitanje može li se potrošačko pravo otkupljivati te ističe da se neka od njih "ne mogu prodavati niti prebijati". Smatra da bi tek trebalo vidjeti sadržaj ugovora između onih koji otkupljuju i prodaju dug te u kojoj mjeri mogu biti uporište za sudske tužbe.

U odgovorima na česta pitanja koje navode u oglasu, iz Consensus plusa pojašnjavaju da sve troškove podmiruje "trgovačko društvo", da sklapanjem ugovora potrošač ne snosi nikakav rizik jer "mi preuzimamo sav rizik na nas, a na Vama je samo pružiti nam potrebne informacije". Ujedno ih podsjećaju da njihovo potraživanje nije u zastari "s obzirom na trenutnu sudsku praksu". Iako izračun sačinjavaju sami, ako ga klijent već ima, rade samo provjeru postojećeg". Ako je dokumentacija pravovaljana i potpuna, isplata slijedi pri potpisivanju ugovora.

Na meti agencije prvo oni koji nisu konvertirali kredit

Nešto više o poslu kojim se bavi, kao i o motivu za pokretanje tvrtke Consensus plus, nije bilo moguće saznati jer je nakon poziva vlasnik mobitela tek poslao poruku: "Nazvat ću vas". No nije nazvao. Na Poslovnoj Hrvatskoj stoji da je jedini zaposlenik tvrtke osnovane 2021. godine članica Uprave Škropeta-Vukić, koja je od 2008 do 2018. godine bila i jedina članica Uprave tvrtke Vila Adriatic, a potom i njezina likvidatorica. No, jedan klijent tvrtke navodi da operativni posao vodi vježbenik u jednom odvjetničkom uredu, tako da dobivaju podatke o potrošačima koji nisu konvertirali kredit, potom ih nazivaju i upoznaju s ponudom.

Otkup dugova u pravilu se povezuje s tajnovitim osobama koje građane presreću i s njima pokušavaju dogovoriti naplatu potraživanja, ali sada se na tržištu pojavljuju neki drugačiji igrači i nude svoju pomoć, piše Novac.hr. U dnevnim novinama pojavio se oglas pod naslovom "Novost na ovim prostorima: isplata korisnika kredita", a potencijalnim klijentima obraća se riječima:

"Podigli ste kredit u švicarskim francima u banci u razdoblju od 2004. do 2008. godine? Niste pokrenuli sudski spor? Imamo ponudu za Vas! Otkupljujemo Vaše potraživanje prema banci uz preuzimanje rizika i troškova sudskog postupka, kao i rizika naplate od banke, a Vas isplaćujemo ODMAH".

Dostava dokumentacije

Objavila ga je tvrtka Consensus plus iz Labina, koja je registrirana ove godine, a prije svega se bavi "otkupom potraživanja potrošača prema bankama". One koji nisu konvertirali kredit i dosad nisu tužili banku, direktorica tvrtke Soave Škropeta-Vukić poziva da im dostave dokumentaciju mailom ili nazovu i dogovore sve pojedinosti, a u slučaju potrebe, tvrtka nudi i pomoć u pribavljanju dokumentacije. Nakon što osiguraju sve potrebno, sastavljaju izračun i potrošaču dostavljaju ponudu. Kada je riječ o iznosu isplate, tvrtka ističe da on ovisi o izračunu.

Prema riječima dužnika koji je u pregovorima s osobljem Consensus plusa, ponuđen mu je otkup od 30 posto vrijednosti potraživanja prema banci, ali dodaje kako u nekim slučajevima iznosi i više. Smatra da to nije dovoljno jer su u pitanju samo nekonvertirani krediti za koje postoje dobri izgledi u sudskom procesu.

Računajući i zatezne kamate, dodaje, konačan iznos koji se može dobiti od banke znatno premašuje utvrđeno potraživanje. Od oko 125.000 kredita u švicarskim francima, nekonvertirano ih je ostalo oko 70.000. Neki od dužnika sami su davno pokrenuli tužbe protiv banaka, pa dobili i presude. Premda posljednja odluka Ustavnog suda, kojom su odbijene tužbe banaka, ne donosi nikakva nova prava za potrošače, nego samo potvrđuje ništetnost valutne klauzule, vrlo je vjerojatno da će ona potaknuti pokretanje novih tužbi.

Za razliku od dužnika koji su imali stambene kredite, uglavnom su ih konvertirali i sada čekaju mišljenje Suda Europske unije o tome imaju li i dalje pravo na obeštećenje, kod nekonvertiranih kredita situacija je prilično jasnija. Banke je moguće tužiti na temelju ništetnih odredbi o promjeni kamatne stope i tečaja.

Prema riječima direktora Hrvatske udruge banaka Zdenka Adrovića, u slučaju nekonvertiranih kredita uglavnom je riječ o manjim iznosima koji su se koristili za kupnju automobila, a kako je dobar dio tih kredita otplaćen i prije nego što su rate počele snažno rasti, procjenjuje da bi obeštećenje bilo malo. K tome, imajući u vidu trajanje sudskih procesa, smatra da se podizanje tužbi potrošačima ne bi niti isplatilo.

Utemeljenost u zakonu

No, s pojavom "profesionalaca" biznis oko tužbi, čini se, poprima nove dimenzije. Pritom se postavlja i pitanje koliko je nova praksa utemeljena na zakonu. Odvjetnik koji se već dulje vrijeme bavi ovom problematikom, pozivajući se na nacionalne i europske propise, postavlja pitanje može li se potrošačko pravo otkupljivati te ističe da se neka od njih "ne mogu prodavati niti prebijati". Smatra da bi tek trebalo vidjeti sadržaj ugovora između onih koji otkupljuju i prodaju dug te u kojoj mjeri mogu biti uporište za sudske tužbe.

U odgovorima na česta pitanja koje navode u oglasu, iz Consensus plusa pojašnjavaju da sve troškove podmiruje "trgovačko društvo", da sklapanjem ugovora potrošač ne snosi nikakav rizik jer "mi preuzimamo sav rizik na nas, a na Vama je samo pružiti nam potrebne informacije". Ujedno ih podsjećaju da njihovo potraživanje nije u zastari "s obzirom na trenutnu sudsku praksu". Iako izračun sačinjavaju sami, ako ga klijent već ima, rade samo provjeru postojećeg". Ako je dokumentacija pravovaljana i potpuna, isplata slijedi pri potpisivanju ugovora.

Na meti agencije prvo oni koji nisu konvertirali kredit

Nešto više o poslu kojim se bavi, kao i o motivu za pokretanje tvrtke Consensus plus, nije bilo moguće saznati jer je nakon poziva vlasnik mobitela tek poslao poruku: "Nazvat ću vas". No nije nazvao. Na Poslovnoj Hrvatskoj stoji da je jedini zaposlenik tvrtke osnovane 2021. godine članica Uprave Škropeta-Vukić, koja je od 2008 do 2018. godine bila i jedina članica Uprave tvrtke Vila Adriatic, a potom i njezina likvidatorica. No, jedan klijent tvrtke navodi da operativni posao vodi vježbenik u jednom odvjetničkom uredu, tako da dobivaju podatke o potrošačima koji nisu konvertirali kredit, potom ih nazivaju i upoznaju s ponudom.

Biznis oko tužbi za kredite u ‘švicarcima‘: agencija nudi otkup nenaplaćene odštete onima koji još nisu pokrenuli spor protiv banke

Otkup dugova u pravilu se povezuje s tajnovitim osobama koje građane presreću i s njima pokušavaju dogovoriti naplatu potraživanja, ali sada se na tržištu pojavljuju neki drugačiji igrači i nude svoju pomoć, piše Novac.hr. U dnevnim novinama pojavio se oglas pod naslovom "Novost na ovim prostorima: isplata korisnika kredita", a potencijalnim klijentima obraća se riječima:

"Podigli ste kredit u švicarskim francima u banci u razdoblju od 2004. do 2008. godine? Niste pokrenuli sudski spor? Imamo ponudu za Vas! Otkupljujemo Vaše potraživanje prema banci uz preuzimanje rizika i troškova sudskog postupka, kao i rizika naplate od banke, a Vas isplaćujemo ODMAH".
