Kako doznajemo, nedavno je pravomoćnim rješenjem okončan dugogodišnji spor između "Prometa" i odvjetnika Željka Lubine oko plaćanja penala za devet autobusa koji su nabavljeni za Europsko atletsko prvenstvo 1990. godine.

Podsjetimo, nakon tužbe odvjetnika Željka Lubine te dugogodišnjeg postupka došlo je do pravomoćne Presude Trgovačkog suda u Splitu 31. listopada 2014. godine prema kojoj je naloženo "Prometu" predati Lubini devet autobusa marke MAN, i to točno određenih brojeva šasije u tehnički ispravnom i registriranom stanju za prijevoz putnika.

Problem izvršenja navedene presude je bio u tome što predmetni autobusi već i davno prije donošenja presude nisu bili u voznom stanju niti je na tržištu bilo adekvatnih dijelova za njihov popravak.

Budući da splitski javni prijevoznik nije bio u mogućnosti udovoljiti navedenom traženju suda, Lubina je podnio prijedlog za ovrhu nadležnom sudu radi naplate sudskih penala.

Općinski sud u Splitu je potom donio rješenje o ovrsi na način da je odredio da je "Promet" Željku Lubini dužan plaćati 250 kuna dnevno za svaki autobus i za svaki dan neizvršenja, odnosno zakašnjenja, što je dnevno značilo ukupno 2250 kuna.

Jedan u nizu postupaka

- Mogu potvrditi da smo dobili pravomoćno rješenje o ukidanju plaćanja sudskih penala. Što se tiče konkretnog predmeta, on je bio samo jedan u nizu mnogobrojnih sudskih postupaka koji su se vodili protiv "Prometa" i svi oni su bili dodatni teret na poslovanje tvrtke koja je ionako loše poslovala i imala druge mnogobrojne neriješene probleme.

Kad sam se, nakon preuzimanja tvrtke, zajedno s našim zastupnikom, odvjetnikom Krunom Peronjom, upoznao i s navedenim predmetom, zaključili smo da imamo osnove za ukidanje navedenih penala.

Stoga smo krenuli u pribavljanje potrebne dokumentacije kao što su određena vještačenja stručnjaka, odnosno određena dokumentacija od proizvođača navedenih autobusa kako bismo dokazali da se navedena presuda ne može izvršiti. 

Ako je izvršenje nemoguće, smatrali smo da ne mogu postojati niti penali, čija je svrha da nekog prisili da je što prije izvrši - kazao nam je Miroslav Delić, direktor "Prometa".

Nakon pribavljanja svih potrebnih papira, gradska komunalna tvrtka je u prosincu 2019. godine podnijela prijedlog za ukidanje sudskih penala, ali je Općinski sud u ožujku 2020. godine taj prijedlog odbacio kao nedopušten, na što se "Promet" žalio te je Županijski sud tu žalbu prihvatio i naložio da se predmetni postupak može pokrenuti.

Kako doznajemo, u navedenom postupku, osim pregleda sve dostavljene dokumentacije izvršene su i određene radnje u Prometovoj garaži, gdje su se navedeni autobusi nalazili uz prisutnost predstavnika Suda te vještaka.

Nakon provedenog postupka Općinski sud u Splitu je 25. veljače 2021. godine donio rješenje kojim se obustavlja navedena ovrha, odnosno plaćanje „penala“.

Na navedeno prvostupanjsko rješenje žalio se Lubina, ali je Županijski sud u Splitu u predmetu u svibnju ove godine donio Rješenje kojim se u cijelosti potvrđuje odluka Općinskog suda u Splitu.

'Prometu' nazad i 5 milijuna kuna

- Nakon što smo prikupili svu dokumentaciju za koju smo smatrali da potvrđuje naše navode i nakon što smo pokrenuli sudski postupak, prošle godine sam donio odluku da više ne plaćamo navedene penale na temelju kojih je prethodnih godina već bilo isplaćeno cca tri milijuna kuna.

Sve to pokazuje koliko je važna ovakva sudska odluka jer su se penali mogli plaćati unedogled, godinama, pa i desetljećima - pojašnjava prvi čovjek "Prometa".

Valja istaknuti da je u vezi navedenog spora odvjetnik Lubina bio podnio i zahtjev da se blokiraju sredstva na računima javnog prijevoznika te je Rješenjem ovršnog odjela Općinskog suda u Splitu od 10. travnja 2017. godine određena ovrha u korist odvjetničkog društva "Lubina i Čutura" za iznos od 5.145.048,75 kuna nad sredstvima "Prometa".

Budući da je "Promet" smatrao da je navedena ovrha nedopuštena, protiv navedenog rješenja podnesen je prijedlog za proglašenje ovrhe nedopuštenom, kao i prijedlog za odgodu ovrhe, što je sud i prihvatio te je tvrtka upućena u sudsku parnicu za deblokadu navedenih sredstava.

Nakon dugotrajnog postupka prvostupanjski Općinski sud u Splitu je u svibnju 2020. godine donio presudu kojom se proglašava nedopuštenom citirana ovrha na koju se Lubina žalio, no žalbu je drugostupanjski Županijski sud u Osijeku odbio te je u travnju 2021. godine potvrdio prvostupanjsku presudu.

- Ovakva odluka znači da bi navedena blokirana sredstva, koja su se nalazila na izdvojenom računu Fine, trebala vratiti "Prometu" kroz ovršni postupak.

Razumljivo je da osjećam zadovoljstvo nakon ovakvih sudskih odluka bez obzira na dugotrajnost ovakvih postupaka i različite situacije kroz koje se prolazi u ovakvim postupcima, ali smo bili svjesni u što se upuštamo i da je to jedini način da se zaštite interesi tvrtke - zaključio je Delić.

Kako doznajemo, nedavno je pravomoćnim rješenjem okončan dugogodišnji spor između "Prometa" i odvjetnika Željka Lubine oko plaćanja penala za devet autobusa koji su nabavljeni za Europsko atletsko prvenstvo 1990. godine.

Podsjetimo, nakon tužbe odvjetnika Željka Lubine te dugogodišnjeg postupka došlo je do pravomoćne Presude Trgovačkog suda u Splitu 31. listopada 2014. godine prema kojoj je naloženo "Prometu" predati Lubini devet autobusa marke MAN, i to točno određenih brojeva šasije u tehnički ispravnom i registriranom stanju za prijevoz putnika.

Problem izvršenja navedene presude je bio u tome što predmetni autobusi već i davno prije donošenja presude nisu bili u voznom stanju niti je na tržištu bilo adekvatnih dijelova za njihov popravak.

Budući da splitski javni prijevoznik nije bio u mogućnosti udovoljiti navedenom traženju suda, Lubina je podnio prijedlog za ovrhu nadležnom sudu radi naplate sudskih penala.

Općinski sud u Splitu je potom donio rješenje o ovrsi na način da je odredio da je "Promet" Željku Lubini dužan plaćati 250 kuna dnevno za svaki autobus i za svaki dan neizvršenja, odnosno zakašnjenja, što je dnevno značilo ukupno 2250 kuna.

Jedan u nizu postupaka

- Mogu potvrditi da smo dobili pravomoćno rješenje o ukidanju plaćanja sudskih penala. Što se tiče konkretnog predmeta, on je bio samo jedan u nizu mnogobrojnih sudskih postupaka koji su se vodili protiv "Prometa" i svi oni su bili dodatni teret na poslovanje tvrtke koja je ionako loše poslovala i imala druge mnogobrojne neriješene probleme.

Kad sam se, nakon preuzimanja tvrtke, zajedno s našim zastupnikom, odvjetnikom Krunom Peronjom, upoznao i s navedenim predmetom, zaključili smo da imamo osnove za ukidanje navedenih penala.

Stoga smo krenuli u pribavljanje potrebne dokumentacije kao što su određena vještačenja stručnjaka, odnosno određena dokumentacija od proizvođača navedenih autobusa kako bismo dokazali da se navedena presuda ne može izvršiti. 

Ako je izvršenje nemoguće, smatrali smo da ne mogu postojati niti penali, čija je svrha da nekog prisili da je što prije izvrši - kazao nam je Miroslav Delić, direktor "Prometa".

Nakon pribavljanja svih potrebnih papira, gradska komunalna tvrtka je u prosincu 2019. godine podnijela prijedlog za ukidanje sudskih penala, ali je Općinski sud u ožujku 2020. godine taj prijedlog odbacio kao nedopušten, na što se "Promet" žalio te je Županijski sud tu žalbu prihvatio i naložio da se predmetni postupak može pokrenuti.

Kako doznajemo, u navedenom postupku, osim pregleda sve dostavljene dokumentacije izvršene su i određene radnje u Prometovoj garaži, gdje su se navedeni autobusi nalazili uz prisutnost predstavnika Suda te vještaka.

Nakon provedenog postupka Općinski sud u Splitu je 25. veljače 2021. godine donio rješenje kojim se obustavlja navedena ovrha, odnosno plaćanje „penala“.

Na navedeno prvostupanjsko rješenje žalio se Lubina, ali je Županijski sud u Splitu u predmetu u svibnju ove godine donio Rješenje kojim se u cijelosti potvrđuje odluka Općinskog suda u Splitu.

'Prometu' nazad i 5 milijuna kuna

- Nakon što smo prikupili svu dokumentaciju za koju smo smatrali da potvrđuje naše navode i nakon što smo pokrenuli sudski postupak, prošle godine sam donio odluku da više ne plaćamo navedene penale na temelju kojih je prethodnih godina već bilo isplaćeno cca tri milijuna kuna.

Sve to pokazuje koliko je važna ovakva sudska odluka jer su se penali mogli plaćati unedogled, godinama, pa i desetljećima - pojašnjava prvi čovjek "Prometa".

Valja istaknuti da je u vezi navedenog spora odvjetnik Lubina bio podnio i zahtjev da se blokiraju sredstva na računima javnog prijevoznika te je Rješenjem ovršnog odjela Općinskog suda u Splitu od 10. travnja 2017. godine određena ovrha u korist odvjetničkog društva "Lubina i Čutura" za iznos od 5.145.048,75 kuna nad sredstvima "Prometa".

Budući da je "Promet" smatrao da je navedena ovrha nedopuštena, protiv navedenog rješenja podnesen je prijedlog za proglašenje ovrhe nedopuštenom, kao i prijedlog za odgodu ovrhe, što je sud i prihvatio te je tvrtka upućena u sudsku parnicu za deblokadu navedenih sredstava.

Nakon dugotrajnog postupka prvostupanjski Općinski sud u Splitu je u svibnju 2020. godine donio presudu kojom se proglašava nedopuštenom citirana ovrha na koju se Lubina žalio, no žalbu je drugostupanjski Županijski sud u Osijeku odbio te je u travnju 2021. godine potvrdio prvostupanjsku presudu.

- Ovakva odluka znači da bi navedena blokirana sredstva, koja su se nalazila na izdvojenom računu Fine, trebala vratiti "Prometu" kroz ovršni postupak.

Razumljivo je da osjećam zadovoljstvo nakon ovakvih sudskih odluka bez obzira na dugotrajnost ovakvih postupaka i različite situacije kroz koje se prolazi u ovakvim postupcima, ali smo bili svjesni u što se upuštamo i da je to jedini način da se zaštite interesi tvrtke - zaključio je Delić.
