"Čistoća" će morati na poziciju tehničkog direktora te gradske tvrtke vratiti Antu Aleksića koji je pod istragom USKOK-a zbog zlouporabe svog položaja.

Nakon uhićenja u ljeto 2019. bio je na dugom bolovanju i koristio je godišnji odmor, pa ga danima nije bilo na poslu. Zbog toga je smijenjen s direktorske funkcije na nižu poziciju u "Čistoći".

Sada, kako piše Telegram, Općinski sud u Splitu u nepravomoćnoj presudi kaže da ovaj otkaz Aleksiću s izmijenjenim ugovorom o radu nije bio zakonit. Zato će se osumnjičeni direktor, ako presuda postane pravomoćna, moći vratiti na raniju, visoku funkciju u gradskoj firmi.

Inače, Aleksić je kratko prije uhićenja bio i v.d. glavnog direktora "Čistoće", a kada je buknula afera pod istragom je završilo ukupno 35 ljudi.

Riječ je o slučaju koji je raskrinkan u srpnju 2019. kada je USKOK pokrenuo postupak protiv Aleksića zbog sumnje da je 19. veljače do 27. travnja te godine u više navrata nalagao zaposlenicima da vozilima splitske komunalne firme preuzimaju građevinski otpad i odvoze ga na odlagalište Karepovac.

U rješenju o provođenju istrage bilo je navedeno da je upravo Aleksić odobravao dovoz i odlaganje zabranjenog otpada, kao i prihvat dozvoljenog otpada bez njegovog evidentiranja i vaganja. Prema pisanju lokalnih medija to je godinama bila javna tajna, a posebno je bilo uočljivo u proljetnim danima kada su se intenzivirali građevinski radovi.

USKOK je tada objavio da je Aleksić zapravo pogodovao ljudima kojima je omogućavao da ilegalno predaju građevinski otpad za odlaganje na Karepovcu. Dvojica njegovih zaposlenika preuzimala su taj otpad i odvozila ga na odlagalište pri čemu se izbjegavalo zbrinjavanje i plaćanje takve vrste otpada po ovlaštenom koncesionaru. Čistoća Split ostala je, tvrdi USKOK, bez gotovo 460 tisuća kuna naknada.

Još 1,2 milijuna kuna Čistoća je, sumnja se, izgubila jer su zaposlenici koji su tamo radili dopuštali raznim ljudima da odlože tamo otpad bez vaganja. Naime, težina je potrebna kako bi se obračunala naknada. Zaposlenici "Čistoće" primali su kao nagradu 150 do 200 kuna mita, navodi dalje USKOK.

Nakon uhićenja Aleksić je neko vrijeme proveo u istražnom zatvoru. Na slobodu je, zajedno s ostalim osumnjičenima iz Čistoće pušten krajem kolovoza 2019. godine. U lipnju 2020. uprava mu uručuje otkaz s izmijenjenim ugovorom o radu. To znači da je morao otići s funkcije tehničkog direktora, no nije završio na cesti već je u Čistoći ostao kao poslovođa održavanja. Novi postao nije želio prihvatiti već je tužio gradsku tvrtku, piše Telegram.

U tužbi je naveo da mu nije bilo omogućeno da se izjasni o promjeni radnog mjesta, niti je dobio pravo na otpremninu. Zbog toga je smatrao da ga se zapravo nezakonito šikaniralo.

Iz uprave Čistoće Split na sudu su objašnjavali kako zbog boravka u istražnom zatvoru, te na godišnjem odmoru i bolovanju, Aleksić nije mogao obavljati zahtjevne poslove tehničkog direktora. Osim toga, svoju je funkciju bio zlorabio, pa nije bilo moguće da se više na nju vrati, objašnjavali su tijekom procesa. Zbog toga su mu ponudili novo radno mjesto i novi ugovor, a najvažnije im je bilo, isticali su na sudu, očuvati radne procese u Čistoći.

Općinski sud u Splitu u prosincu 2021. odbio je Aleksićev tužbu. Uslijedila je njegova žalba koju je Županijski sud u Zagrebu prihvatio i slučaj vratio na ponovno suđenje. Sada je pak donesena odluka u Aleksićevu korist. Sud je objasnio kako predstavnici Čistoće nisu dokazali da su imali problema s odvijanjem radnih procesa nakon njegovog uhićenja i izostanka s posla zbog bolovanja.

Na njegovo mjesto privremeno su stavili drugog radnika, no to, smatra sud, nije razlog da se Aleksića otpusti s pozicije tehničkog direktora. Sudu nije jasno zašto Aleksić, s obzirom na svoje iskustvo i stručnu spremu, nije prebačen na mjesto rukovoditelja komercijalnog sektora budući da je i ta pozicija u Čistoći bila upražnjena.

"S obzirom da je na funkciju tehničkog direktora Čistoća  postavila osobu od vlastitog povjerenja, umjesto Aleksića protiv kojeg se vodio postupak, prema ocjeni ovog suda ta je odluka bila nedopuštena i zato ju je trebalo ukinuti", navedeno je u nepravomoćnoj presudi na koju Čistoća Split ima pravo uložiti žalbu, navodi Telegram.

"Čistoća" će morati na poziciju tehničkog direktora te gradske tvrtke vratiti Antu Aleksića koji je pod istragom USKOK-a zbog zlouporabe svog položaja.

Nakon uhićenja u ljeto 2019. bio je na dugom bolovanju i koristio je godišnji odmor, pa ga danima nije bilo na poslu. Zbog toga je smijenjen s direktorske funkcije na nižu poziciju u "Čistoći".

Sada, kako piše Telegram, Općinski sud u Splitu u nepravomoćnoj presudi kaže da ovaj otkaz Aleksiću s izmijenjenim ugovorom o radu nije bio zakonit. Zato će se osumnjičeni direktor, ako presuda postane pravomoćna, moći vratiti na raniju, visoku funkciju u gradskoj firmi.

Inače, Aleksić je kratko prije uhićenja bio i v.d. glavnog direktora "Čistoće", a kada je buknula afera pod istragom je završilo ukupno 35 ljudi.

Riječ je o slučaju koji je raskrinkan u srpnju 2019. kada je USKOK pokrenuo postupak protiv Aleksića zbog sumnje da je 19. veljače do 27. travnja te godine u više navrata nalagao zaposlenicima da vozilima splitske komunalne firme preuzimaju građevinski otpad i odvoze ga na odlagalište Karepovac.

U rješenju o provođenju istrage bilo je navedeno da je upravo Aleksić odobravao dovoz i odlaganje zabranjenog otpada, kao i prihvat dozvoljenog otpada bez njegovog evidentiranja i vaganja. Prema pisanju lokalnih medija to je godinama bila javna tajna, a posebno je bilo uočljivo u proljetnim danima kada su se intenzivirali građevinski radovi.

USKOK je tada objavio da je Aleksić zapravo pogodovao ljudima kojima je omogućavao da ilegalno predaju građevinski otpad za odlaganje na Karepovcu. Dvojica njegovih zaposlenika preuzimala su taj otpad i odvozila ga na odlagalište pri čemu se izbjegavalo zbrinjavanje i plaćanje takve vrste otpada po ovlaštenom koncesionaru. Čistoća Split ostala je, tvrdi USKOK, bez gotovo 460 tisuća kuna naknada.

Još 1,2 milijuna kuna Čistoća je, sumnja se, izgubila jer su zaposlenici koji su tamo radili dopuštali raznim ljudima da odlože tamo otpad bez vaganja. Naime, težina je potrebna kako bi se obračunala naknada. Zaposlenici "Čistoće" primali su kao nagradu 150 do 200 kuna mita, navodi dalje USKOK.

Nakon uhićenja Aleksić je neko vrijeme proveo u istražnom zatvoru. Na slobodu je, zajedno s ostalim osumnjičenima iz Čistoće pušten krajem kolovoza 2019. godine. U lipnju 2020. uprava mu uručuje otkaz s izmijenjenim ugovorom o radu. To znači da je morao otići s funkcije tehničkog direktora, no nije završio na cesti već je u Čistoći ostao kao poslovođa održavanja. Novi postao nije želio prihvatiti već je tužio gradsku tvrtku, piše Telegram.

U tužbi je naveo da mu nije bilo omogućeno da se izjasni o promjeni radnog mjesta, niti je dobio pravo na otpremninu. Zbog toga je smatrao da ga se zapravo nezakonito šikaniralo.

Iz uprave Čistoće Split na sudu su objašnjavali kako zbog boravka u istražnom zatvoru, te na godišnjem odmoru i bolovanju, Aleksić nije mogao obavljati zahtjevne poslove tehničkog direktora. Osim toga, svoju je funkciju bio zlorabio, pa nije bilo moguće da se više na nju vrati, objašnjavali su tijekom procesa. Zbog toga su mu ponudili novo radno mjesto i novi ugovor, a najvažnije im je bilo, isticali su na sudu, očuvati radne procese u Čistoći.

Općinski sud u Splitu u prosincu 2021. odbio je Aleksićev tužbu. Uslijedila je njegova žalba koju je Županijski sud u Zagrebu prihvatio i slučaj vratio na ponovno suđenje. Sada je pak donesena odluka u Aleksićevu korist. Sud je objasnio kako predstavnici Čistoće nisu dokazali da su imali problema s odvijanjem radnih procesa nakon njegovog uhićenja i izostanka s posla zbog bolovanja.

Na njegovo mjesto privremeno su stavili drugog radnika, no to, smatra sud, nije razlog da se Aleksića otpusti s pozicije tehničkog direktora. Sudu nije jasno zašto Aleksić, s obzirom na svoje iskustvo i stručnu spremu, nije prebačen na mjesto rukovoditelja komercijalnog sektora budući da je i ta pozicija u Čistoći bila upražnjena.

"S obzirom da je na funkciju tehničkog direktora Čistoća  postavila osobu od vlastitog povjerenja, umjesto Aleksića protiv kojeg se vodio postupak, prema ocjeni ovog suda ta je odluka bila nedopuštena i zato ju je trebalo ukinuti", navedeno je u nepravomoćnoj presudi na koju Čistoća Split ima pravo uložiti žalbu, navodi Telegram.
