U zgradu Lazarica utkane su sudbine brojnih naših sugrađana i tvrtki koji su uložili svoje ušteđevine ili dizali kredite kako bi kupili stanove i poslovne prostore.
One koji su u cijelosti platili svoje nekretnine, investitor Tomislav Baus uveo je u posjede. Neke je upisao kao vlasnike, ali sa zgrade nikada nije skinuo hipoteku Hypo Alpe Adria banke, koja je pratila izgradnju objekta.
Kada je Bausov "Atrium Spalatum" kliznuo u stečaj, Trgovački sud u Splitu je za stečajnu upraviteljicu imenovao Meri Šitić. Ona inzistira, kako nam je kazao jedan odvjetnik, na prodaji stanova i poslovnih prostora u ovrhama koje su pokrenuli H-Abduco, odnosno Adriatic Assets koji su preuzeli bančine hipoteke. Po njima ispada da su svi ti ljudi i tvrtke potpuno nevažni.

Tako je krenula višegodišnja bitka za Lazaricu, a ovih dana nazire se mogući preokret.
Naime, sudac Ivo Bakalić na splitskom Trgovačkom sudu proglasio je sporazum iz 2004., kojim je banka na Lazaricu upisala hipoteku od 5 milijuna eura, ništetnim u dijelu koji se odnosi na prostore trgovačkog lanca "Victa". Razlog tomu je što je banka znala da je "Atrium Spalatum" prodao prostore "Victi", koja ih je u potpunosti platila.
Ono što je iz te presude bitno za sve ostale kupce jest da sudac Bakalić po službenoj dužnosti utvrdio ništetnost ugovora iz 2004. godine o izdavanju devizne garancije između banke i "Atrium Spalatuma".
Također, u drugom predmetu viši sud naložio je Trgovačkom sudu izdavanje privremene mjere zabrane prodaje nekretnina dok ne završi sudski spor koji je njihov vlasnik pokrenuo radi utvrđivanja ništetnosti upisa hipoteke na Lazaricu s obzirom na to da su "Atrium Spalatum" i banka kredit ugovorili u stranoj valuti umjesto u kunama.

Pavao Đonlić, povratnik iz Njemačke, koji je u Lazarici kupio stan i poslovni prostor, ispričao nam je:
- Samo tražim ono što je moje, što sam platio i za što imam dokaze. Ne tražim ništa tuđe i nemojte me krasti jer to su moje pare i pare moje djece. Živio sam vani 40 godina i uložio novac u Hrvatsku koju volim više od svega na ovom svitu. Kupio sam stan i poslovni prostor u Lazarici, a kada me je Baus nazvao da te nekretnine uknjižim na sebe, nisam mogao odmah doći u Hrvatsku jer sam radio.
Rekao sam mu da pričeka do ljeta. Kad sam došao, njega je već bacilo u stečaj. Budući da sam sve platio, imao sam rješenje kojim me se uvodi u stan u čije sam uređenje potom uložio još 50.000 eura da mi djeca mogu doći na godišnji odmor – govori Đonlić, čiji stan i poslovni prostor stečajna upraviteljica i tvrtka za otkup potraživanja žele prodati iako je on platio cjelokupni kupoprodajni iznos.

Jako volim žene, ali ta stečajna upraviteljica.... Ona je pokušavala na sve načine da i moj brat ostane bez svog stana u Lazarici - nastavlja Đonlić i otkriva da su vjerovnici skupili potpise za njezinu smjenu.
- Stečajna upraviteljica uporno želi da se ide u prodaju iako su ljudi platili veliki novac, uselili se u stanove. Tražimo njezinu smjenu, a kada se u tome uspije, ići će revizija njezina poslovanja da se utvrdi je li bilo nezakonitosti – rekao nam jedan od odvjetnika.
Zvali smo stečajnu upraviteljicu kako bi odgovorila na optužbe, no tek se jednom nakratko javila na mobitel te potom prekinula vezu.

U zgradu Lazarica utkane su sudbine brojnih naših sugrađana i tvrtki koji su uložili svoje ušteđevine ili dizali kredite kako bi kupili stanove i poslovne prostore.
One koji su u cijelosti platili svoje nekretnine, investitor Tomislav Baus uveo je u posjede. Neke je upisao kao vlasnike, ali sa zgrade nikada nije skinuo hipoteku Hypo Alpe Adria banke, koja je pratila izgradnju objekta.
Kada je Bausov "Atrium Spalatum" kliznuo u stečaj, Trgovački sud u Splitu je za stečajnu upraviteljicu imenovao Meri Šitić. Ona inzistira, kako nam je kazao jedan odvjetnik, na prodaji stanova i poslovnih prostora u ovrhama koje su pokrenuli H-Abduco, odnosno Adriatic Assets koji su preuzeli bančine hipoteke. Po njima ispada da su svi ti ljudi i tvrtke potpuno nevažni.

Tako je krenula višegodišnja bitka za Lazaricu, a ovih dana nazire se mogući preokret.
Naime, sudac Ivo Bakalić na splitskom Trgovačkom sudu proglasio je sporazum iz 2004., kojim je banka na Lazaricu upisala hipoteku od 5 milijuna eura, ništetnim u dijelu koji se odnosi na prostore trgovačkog lanca "Victa". Razlog tomu je što je banka znala da je "Atrium Spalatum" prodao prostore "Victi", koja ih je u potpunosti platila.
Ono što je iz te presude bitno za sve ostale kupce jest da sudac Bakalić po službenoj dužnosti utvrdio ništetnost ugovora iz 2004. godine o izdavanju devizne garancije između banke i "Atrium Spalatuma".
Također, u drugom predmetu viši sud naložio je Trgovačkom sudu izdavanje privremene mjere zabrane prodaje nekretnina dok ne završi sudski spor koji je njihov vlasnik pokrenuo radi utvrđivanja ništetnosti upisa hipoteke na Lazaricu s obzirom na to da su "Atrium Spalatum" i banka kredit ugovorili u stranoj valuti umjesto u kunama.

Pavao Đonlić, povratnik iz Njemačke, koji je u Lazarici kupio stan i poslovni prostor, ispričao nam je:
- Samo tražim ono što je moje, što sam platio i za što imam dokaze. Ne tražim ništa tuđe i nemojte me krasti jer to su moje pare i pare moje djece. Živio sam vani 40 godina i uložio novac u Hrvatsku koju volim više od svega na ovom svitu. Kupio sam stan i poslovni prostor u Lazarici, a kada me je Baus nazvao da te nekretnine uknjižim na sebe, nisam mogao odmah doći u Hrvatsku jer sam radio.
Rekao sam mu da pričeka do ljeta. Kad sam došao, njega je već bacilo u stečaj. Budući da sam sve platio, imao sam rješenje kojim me se uvodi u stan u čije sam uređenje potom uložio još 50.000 eura da mi djeca mogu doći na godišnji odmor – govori Đonlić, čiji stan i poslovni prostor stečajna upraviteljica i tvrtka za otkup potraživanja žele prodati iako je on platio cjelokupni kupoprodajni iznos.

Jako volim žene, ali ta stečajna upraviteljica.... Ona je pokušavala na sve načine da i moj brat ostane bez svog stana u Lazarici - nastavlja Đonlić i otkriva da su vjerovnici skupili potpise za njezinu smjenu.
- Stečajna upraviteljica uporno želi da se ide u prodaju iako su ljudi platili veliki novac, uselili se u stanove. Tražimo njezinu smjenu, a kada se u tome uspije, ići će revizija njezina poslovanja da se utvrdi je li bilo nezakonitosti – rekao nam jedan od odvjetnika.
Zvali smo stečajnu upraviteljicu kako bi odgovorila na optužbe, no tek se jednom nakratko javila na mobitel te potom prekinula vezu.
