stdClass Object ( [id] => 268117 [title] => Stanari Lazarice: Tek je polovina stanova useljena [alias] => stanari-lazarice-tek-je-polovina-stanova-useljena [catid] => 253 [published] => 1 [introtext] => [fulltext] => Ovršitelj Općinskog suda u srijedu je u posjed stana na četvrtom katu zgrade Lazarica na Firulama uveo Marka Mesića, vlasnika građevinskog obrta “Armirač” iz Kaštel Gomilice.

Mesić nam je ispričao kako mu je tijekom izgradnje objekta uz raskrižje Poljičke ceste i Spinčićeve ulice investitorska tvrtka “Atrium Spalatum” polovinu vrijednosti radova plaćala u novcu, dok mu je za preostalih 288.000 eura dala veliki stan. Prema njegovim riječima, unatoč dogovoru godinama nije mogao ući u stambeni prostor, te je pokrenuo sudski postupak i protiv “Atrium Spalatuma” prije osam mjeseci dobio pravomoćnu presudu.

Na temelju tog rješenja, Sud ga je uveo u posjed stana, a zbog čega je ovršitelj zatražio asistenciju policajaca i naložio ovlaštenom bravaru da promijeni bravu na ulaznim vratima.

Problem nije riješen

– Stan sam trebao dobiti koncem 2003. godine. Onda smo se šest godina sudili. Sada kad sam ušao u posjed problem je tek djelomično riješen, jer investitor u stanu treba obaviti radove vrijedne deset tisuća eura, te mi isplatiti milijun kuna penala – rekao nam je Mesić i dodao da stan s velikom terasom zauzima površinu od oko 280 četvornih metara i da sada vrijedi između 500.000 i 600.000 eura.

Tomislav Baus, direktor “Atrium Spalatuma”, istaknuo je da nitko nije radio probleme zbog uvođenja građevinara u posjed.

– Naša tvrtka nije mogla postupiti po presudi jer smo se na nju žalili. Naime, presuda glasi na fizičku osobu, a za nas je radio obrt “Armirač”. Nadalje, on ima pravo na manje kvadrata nego što je površina stana u koji je ušao. Ako se na višoj sudskoj razini presudi u našu korist, možemo reći da ga nismo mi uveli u posjed – dodao je Baus.

Stanari Lazarice kazali su nam da je u zgradi tek polovina stanova useljena, a neizvjesna je i sudbina investitorske tvrtke koja je svoje financijske probleme namjeravala riješiti predstečajnom nagodbom. Trenutačno se čeka da Ministarstvo financija odluči o žalbi na odbacivanje prijedloga za pokretanje postupka spašavanja kompanije.

Također, nakon što je Trgovački sud već dvaput na prijedlog trgovačke tvrtke “Victa” odbio otvoriti stečaj nad investitorom Lazarice, čeka se zakazivanje ročišta po trećem “Victinu” prijedlogu za pokretanje stečaja Bausove tvrtke.

Mesić nam je ispričao kako mu je tijekom izgradnje objekta uz raskrižje Poljičke ceste i Spinčićeve ulice investitorska tvrtka “Atrium Spalatum” polovinu vrijednosti radova plaćala u novcu, dok mu je za preostalih 288.000 eura dala veliki stan. Prema njegovim riječima, unatoč dogovoru godinama nije mogao ući u stambeni prostor, te je pokrenuo sudski postupak i protiv “Atrium Spalatuma” prije osam mjeseci dobio pravomoćnu presudu.

Na temelju tog rješenja, Sud ga je uveo u posjed stana, a zbog čega je ovršitelj zatražio asistenciju policajaca i naložio ovlaštenom bravaru da promijeni bravu na ulaznim vratima.

Problem nije riješen

– Stan sam trebao dobiti koncem 2003. godine. Onda smo se šest godina sudili. Sada kad sam ušao u posjed problem je tek djelomično riješen, jer investitor u stanu treba obaviti radove vrijedne deset tisuća eura, te mi isplatiti milijun kuna penala – rekao nam je Mesić i dodao da stan s velikom terasom zauzima površinu od oko 280 četvornih metara i da sada vrijedi između 500.000 i 600.000 eura.

Tomislav Baus, direktor “Atrium Spalatuma”, istaknuo je da nitko nije radio probleme zbog uvođenja građevinara u posjed.

– Naša tvrtka nije mogla postupiti po presudi jer smo se na nju žalili. Naime, presuda glasi na fizičku osobu, a za nas je radio obrt “Armirač”. Nadalje, on ima pravo na manje kvadrata nego što je površina stana u koji je ušao. Ako se na višoj sudskoj razini presudi u našu korist, možemo reći da ga nismo mi uveli u posjed – dodao je Baus.

Stanari Lazarice kazali su nam da je u zgradi tek polovina stanova useljena, a neizvjesna je i sudbina investitorske tvrtke koja je svoje financijske probleme namjeravala riješiti predstečajnom nagodbom. Trenutačno se čeka da Ministarstvo financija odluči o žalbi na odbacivanje prijedloga za pokretanje postupka spašavanja kompanije.

Također, nakon što je Trgovački sud već dvaput na prijedlog trgovačke tvrtke “Victa” odbio otvoriti stečaj nad investitorom Lazarice, čeka se zakazivanje ročišta po trećem “Victinu” prijedlogu za pokretanje stečaja Bausove tvrtke.
