Može li Željko Alfirević, vlasnik splitskog "No Stressa" nakon odluke Visokog upravnog suda o ukinuću odluke o komunalnom redu iz 2022. godine, sutra na Pjacu vratiti svoj štekat i nastavit raditi kao i do donošenja odluke, upitali smo Vinka Ljubičića, odvjetnika iz Splita.
- Po mome mišljenju on sutra može ponovno postaviti štekat na mjestu na kojemu je on i bio do donošenja sporne odluke o komunalnom redu. No, naravno to je moje mišljenje i gospodin Alfirević se to mora dogovoriti sa svojim odvjetnikom. To bi možda i trebalo napraviti jer je ova odluka koja je ukinuta na Visokom upravnom sudu, od strane Grada donesena "ad hoc", odnosno "na svoju ruku", uz očito ignoriranje bilo kakve javne rasprave i uz želju da se samo ispuni forma. Ta je odluka donesena paušalno, neodgovorno i donositelj odluke je dokazao da je na taj način ograničen u donošenju odluka, rekao je odvjetnik Ljubičić.
Može li Željko Alfirević, odnosno svi oni koji smatraju da su financijski "zakinuti" odlukom o komunalnom redu iz 2022. godine, od Grada tražiti financijsku zadovoljštinu?

- Ako je nešto napravljeno temeljem nezakonito donjetog podzakonskog akta, a što je konkretna odluka Grada, onda svi oštećeni imaju pravo za naknadu štete. Sve to je u uzročno posljedičnoj vezi između radnje i štete koja je počinjena određenim osobama, kazuje Ljubičić.
Zanimalo nas je traju li ti sudski postupci dugo, odnosno o kolikim se obeštećenjima radi.
- Takvi postupci ne traju dugo, jer ustvari samo treba doznati stvarnu štetu koja je pričinjena određenoj osobi. Tako, recimo ako osoba na štekatu nije radila od 1. svibnja do 30. rujna 2023. godine, samo treba utvrditi za godinu dana prije kolika je bila zarada u istom vremenskom periodu, zaključio je odvjetnik Vinko Ljubičić.

Može li Željko Alfirević, vlasnik splitskog "No Stressa" nakon odluke Visokog upravnog suda o ukinuću odluke o komunalnom redu iz 2022. godine, sutra na Pjacu vratiti svoj štekat i nastavit raditi kao i do donošenja odluke, upitali smo Vinka Ljubičića, odvjetnika iz Splita.
- Po mome mišljenju on sutra može ponovno postaviti štekat na mjestu na kojemu je on i bio do donošenja sporne odluke o komunalnom redu. No, naravno to je moje mišljenje i gospodin Alfirević se to mora dogovoriti sa svojim odvjetnikom. To bi možda i trebalo napraviti jer je ova odluka koja je ukinuta na Visokom upravnom sudu, od strane Grada donesena "ad hoc", odnosno "na svoju ruku", uz očito ignoriranje bilo kakve javne rasprave i uz želju da se samo ispuni forma. Ta je odluka donesena paušalno, neodgovorno i donositelj odluke je dokazao da je na taj način ograničen u donošenju odluka, rekao je odvjetnik Ljubičić.
Može li Željko Alfirević, odnosno svi oni koji smatraju da su financijski "zakinuti" odlukom o komunalnom redu iz 2022. godine, od Grada tražiti financijsku zadovoljštinu?

- Ako je nešto napravljeno temeljem nezakonito donjetog podzakonskog akta, a što je konkretna odluka Grada, onda svi oštećeni imaju pravo za naknadu štete. Sve to je u uzročno posljedičnoj vezi između radnje i štete koja je počinjena određenim osobama, kazuje Ljubičić.
Zanimalo nas je traju li ti sudski postupci dugo, odnosno o kolikim se obeštećenjima radi.
- Takvi postupci ne traju dugo, jer ustvari samo treba doznati stvarnu štetu koja je pričinjena određenoj osobi. Tako, recimo ako osoba na štekatu nije radila od 1. svibnja do 30. rujna 2023. godine, samo treba utvrditi za godinu dana prije kolika je bila zarada u istom vremenskom periodu, zaključio je odvjetnik Vinko Ljubičić.
