Lazaricu napokon doveo do dobivanja dugo čekane uporabne dozvole. Jer samo nekoliko obitelji koje su stanove u potpunosti ranije platili, u njih su se i uselili u kratkom razdoblju između dobivanja uporabne dozvole i blokade investitora od strane “Victe” – ističe naš sugovornik (podaci poznati redakciji) koji se nada rješenju problema kroz postupak predstečajne nagodbe “Atrium Spalatuma”.

Ovrha za vratom

No, oko 40 kupaca platilo je investitoru veći dio kupoprodajnog iznosa za svoje stanove, a ostatak novca još nisu podmirili, jer strahuju što će biti sa stambenim prostorima budući da je “Victa” zatražila ovrhu nad njima.

– Do sada sam platio sto tisuća eura, što je 80 posto cijene stana, a onda je “Victa” na njega stavila zabilježbu spora koji vodi s investitorom zgrade – dodaje stanar.

Fina još nije odlučila hoće li “Atrium Spalatum” u predstečajnu nagodbu koja bi tvrtku spasila od stečaja u koji ga na Trgovačkom sudu pokušava odgurati “Victa”. No, Fina je zato privremenom mjerom zatražila da se zastane s provedbom ovrha, te da se odblokira račun graditelja Lazarice da bi on mogao podmirivati tekuće obveze.

Račun “Atrium Spalatuma” blokirala je “Victa” još u listopadu 2012. nakon čega, kako su se Fini potužili iz investitorskih krugova, više nisu mogli prodavati stanove i poslovne prostore vrijedne 23,4 milijuna eura. Nesuđeni predsjednički kandidat Ivan Rude, povjerenik predstečajne nagodbe, nije htio reći ništa više od toga kako smatra da bi predstečajna nagodba bila daleko povoljnije rješenje od stečaja.

Kobne pozajmice

Dok Fina ne odluči hoće li pokrenuti predstečajni postupak, sudac Mladenko Žužul s Trgovačkog suda odgodio je ročište na kojem se na prijedlog “Victe” treba utvrditi jesu li ispunjeni uvjeti za otvaranje stečaja nad investitorom Lazarice. Novo sudsko ročište sazvao je za siječanj.

“Victa” kao razlučni vjerovnik prošle godine nije uspjela dokazati vjerojatnim da 1,5 milijuna eura neće uspjeti u potpunosti naplatiti prodajom nekretnina “Atrium Spalatuma” na koje je upisala založno pravo, a među kojima je i veliki poslovni prostor u prizemlju zgrade smještene nasuprot ulazu u bolnicu na Firulama. Predstavnici trgovačke kuće tako nisu uspjeli “uvjeriti” sud da treba otvoriti stečaj.

Zbog toga se “Victa” sada javlja kao “obični” vjerovnik i traži stečaj “Atrium Spalatuma” zbog drugog duga - 306.000 kuna temeljem ugovora o kratkoročnoj pozajmici, a o čemu ima i nepravomoćnu presudu Trgovačkog suda.

Prije godinu dana je Meri Šitić, tadašnja privremena stečajna upraviteljica, kazala da bi stečajni postupak bio nemilosrdan i težak, jer se radi o sudbinama 58 obitelji koje su u Lazarici kupili stanove. Sada ponovno postoji opasnost da se otvori stečaj nad “Atrium Spalatumom”.

Ako se to dogodi, lako je moguće da svoja prava neće moći ostvariti oni kupci stanova i poslovnih prostora koji nisu upisani kao vlasnici, niti su ušli u posjed nekretnine koju su platili, a takvo što se moglo čuti tijekom ranijih postupaka utvrđivanja postoje li uvjeti za otvaranje stečaja nad ulagačem u Lazaricu.

Ovrha za vratom

No, oko 40 kupaca platilo je investitoru veći dio kupoprodajnog iznosa za svoje stanove, a ostatak novca još nisu podmirili, jer strahuju što će biti sa stambenim prostorima budući da je “Victa” zatražila ovrhu nad njima.

– Do sada sam platio sto tisuća eura, što je 80 posto cijene stana, a onda je “Victa” na njega stavila zabilježbu spora koji vodi s investitorom zgrade – dodaje stanar.

Fina još nije odlučila hoće li “Atrium Spalatum” u predstečajnu nagodbu koja bi tvrtku spasila od stečaja u koji ga na Trgovačkom sudu pokušava odgurati “Victa”. No, Fina je zato privremenom mjerom zatražila da se zastane s provedbom ovrha, te da se odblokira račun graditelja Lazarice da bi on mogao podmirivati tekuće obveze.

Račun “Atrium Spalatuma” blokirala je “Victa” još u listopadu 2012. nakon čega, kako su se Fini potužili iz investitorskih krugova, više nisu mogli prodavati stanove i poslovne prostore vrijedne 23,4 milijuna eura. Nesuđeni predsjednički kandidat Ivan Rude, povjerenik predstečajne nagodbe, nije htio reći ništa više od toga kako smatra da bi predstečajna nagodba bila daleko povoljnije rješenje od stečaja.

Kobne pozajmice

Dok Fina ne odluči hoće li pokrenuti predstečajni postupak, sudac Mladenko Žužul s Trgovačkog suda odgodio je ročište na kojem se na prijedlog “Victe” treba utvrditi jesu li ispunjeni uvjeti za otvaranje stečaja nad investitorom Lazarice. Novo sudsko ročište sazvao je za siječanj.

“Victa” kao razlučni vjerovnik prošle godine nije uspjela dokazati vjerojatnim da 1,5 milijuna eura neće uspjeti u potpunosti naplatiti prodajom nekretnina “Atrium Spalatuma” na koje je upisala založno pravo, a među kojima je i veliki poslovni prostor u prizemlju zgrade smještene nasuprot ulazu u bolnicu na Firulama. Predstavnici trgovačke kuće tako nisu uspjeli “uvjeriti” sud da treba otvoriti stečaj.

Zbog toga se “Victa” sada javlja kao “obični” vjerovnik i traži stečaj “Atrium Spalatuma” zbog drugog duga - 306.000 kuna temeljem ugovora o kratkoročnoj pozajmici, a o čemu ima i nepravomoćnu presudu Trgovačkog suda.

Prije godinu dana je Meri Šitić, tadašnja privremena stečajna upraviteljica, kazala da bi stečajni postupak bio nemilosrdan i težak, jer se radi o sudbinama 58 obitelji koje su u Lazarici kupili stanove. Sada ponovno postoji opasnost da se otvori stečaj nad “Atrium Spalatumom”.

Ako se to dogodi, lako je moguće da svoja prava neće moći ostvariti oni kupci stanova i poslovnih prostora koji nisu upisani kao vlasnici, niti su ušli u posjed nekretnine koju su platili, a takvo što se moglo čuti tijekom ranijih postupaka utvrđivanja postoje li uvjeti za otvaranje stečaja nad ulagačem u Lazaricu.
