Čudo se ipak dogodilo! Kako neslužbeno doznajemo, Visoki trgovački sud RH potvrdio je presudu zagrebačkog Trgovačkog suda od prije dvije godine kojim je bio prihvaćen zahtjev Grada Splita za poništenjem pravorijeka Arbitražnog vijeća Hrvatske gospodarske komore iz 2016. godine kojom je Grad Splitu, a vezano za izgradnju Spaladium Arene, bila nametnuta obveza od 53 milijuna eura prema UniCredit Zagrebačkoj banci i ERSTE banci.

Na tu su se presudu, naravno, žalile Erste group bank Austria, Unicredit bank Austria i Sportski grad TPN d.o.o. u stečaju, no sad su njihove žalbe odbijene i odluka je postala pravomoćna. A što to znači za Grad Split?

Dakle, navedena pravomoćna presuda znači kako nije raskinut Ugovor o JPP (Javno-privatno partnerstvo) za realizaciju izgradnje četiri objekta sportsko-poslovnog centra u Lori sklopljen 2007. godine i kako obveze Sportskog grada TPN d.o.o. u stečaju prema stranim bankama nisu prenesene na Grad Split.

To je, naime, bio pravorijek tročlanog arbitražnog suda u sastavu profesor splitskog Pravnog fakulteta Dragan Bolanča, prof.dr.sc. Davor Babić, izvanredni profesor na Pravnom fakultetu Sveučilišta u Zagrebu te mr.sc. Igor Periša, sudac Vrhovnog suda, a njime je bilo utvrđeno kako je raskinut Ugovor o JPP-u za realizaciju sportsko-poslovnog kompleksa Lora, koji je sklopljen 4. rujna 2007. između tvrtke Sportski grad TPN u stečaju i Grada Splita.

Prema tom je pravorijeku Grad Split trebao bankama platiti oko 70 milijuna eura zato što su prava i obveze zajmoprimca, tvrtke Sportski grad TPN koja je u travnju 2008. godine sklopila ugovor o kreditiranju s dvije austrijske banke, preneseni su na Grad Split.

Veliki uteg oko vrata Grada koji je prijetio blokadom gradskog računa, a time i makar privremenim prestankom financiranja korisnika gradskog proračuna od vrtića, sportskih i kulturnih ustanova, održavanja i izgradnje infrastrukture do vatrogasaca, sada je napokon skinut.

Za to je, bez lažne skromnosti, svakako najzaslužniji mladi splitski odvjetnik Kruno Peronja i njegov tim koji je zastupao gradske interese u ovom predmetu i koji je iznimno uspješnim vođenjem spora za poništaj arbitražnog pravorijeka koji je trajao više od četiri godine sad i pravomoćno otklonio mogućnost da više od 650 milijuna kuna privatnih dugova bude preneseno kao obveza na Grad Split. Njegov uspjeh, a time i uspjeh Grada, svakako je još veći ako se zna da je inače vjerojatnost uspjeha u sporovima za poništaj arbitražnog pravorijeka manja od jedan posto.

Da je ovo zaista veliki uspjeh proizlazi i iz riječi prof. dr. sc. Hrvoja Sikirića, predsjednika Stalnog arbitražnog sudišta pri HGK koji je prije dvije godine Večernjem listu u intervjuu kazao da su "od početka 2013. do studenog 2018. godine provedena 172 arbitražna postupka pred SAS HGK, ukupne vrijednosti 270 milijuna eura" te da prema njihovim podacima do tada još niti jedan arbitražni pravorijek nije bio pravomoćno poništen.

- Sretan sam, šta da kažem. Prije četiri i pol godine arbitražno sudište pri HGK je donijelo pravorijek koji je Grad Split stavio u vrlo tešku poziciju. Pravna bitka koju smo vodili bila je vrlo teška i neizvjesna, ali smo ovom odlukom vratili ponos Gradu i svim njegovim građanima. Moj tim i ja smo od početka tvrdili da je arbitražna odluka neosnovana i da imamo valjane pravne razloge za njeno poništenje - skroman, ali ponosan, bio je odvjetnik Peronja.

Čudo se ipak dogodilo! Kako neslužbeno doznajemo, Visoki trgovački sud RH potvrdio je presudu zagrebačkog Trgovačkog suda od prije dvije godine kojim je bio prihvaćen zahtjev Grada Splita za poništenjem pravorijeka Arbitražnog vijeća Hrvatske gospodarske komore iz 2016. godine kojom je Grad Splitu, a vezano za izgradnju Spaladium Arene, bila nametnuta obveza od 53 milijuna eura prema UniCredit Zagrebačkoj banci i ERSTE banci.

Na tu su se presudu, naravno, žalile Erste group bank Austria, Unicredit bank Austria i Sportski grad TPN d.o.o. u stečaju, no sad su njihove žalbe odbijene i odluka je postala pravomoćna. A što to znači za Grad Split?

Dakle, navedena pravomoćna presuda znači kako nije raskinut Ugovor o JPP (Javno-privatno partnerstvo) za realizaciju izgradnje četiri objekta sportsko-poslovnog centra u Lori sklopljen 2007. godine i kako obveze Sportskog grada TPN d.o.o. u stečaju prema stranim bankama nisu prenesene na Grad Split.

To je, naime, bio pravorijek tročlanog arbitražnog suda u sastavu profesor splitskog Pravnog fakulteta Dragan Bolanča, prof.dr.sc. Davor Babić, izvanredni profesor na Pravnom fakultetu Sveučilišta u Zagrebu te mr.sc. Igor Periša, sudac Vrhovnog suda, a njime je bilo utvrđeno kako je raskinut Ugovor o JPP-u za realizaciju sportsko-poslovnog kompleksa Lora, koji je sklopljen 4. rujna 2007. između tvrtke Sportski grad TPN u stečaju i Grada Splita.

Prema tom je pravorijeku Grad Split trebao bankama platiti oko 70 milijuna eura zato što su prava i obveze zajmoprimca, tvrtke Sportski grad TPN koja je u travnju 2008. godine sklopila ugovor o kreditiranju s dvije austrijske banke, preneseni su na Grad Split.

Veliki uteg oko vrata Grada koji je prijetio blokadom gradskog računa, a time i makar privremenim prestankom financiranja korisnika gradskog proračuna od vrtića, sportskih i kulturnih ustanova, održavanja i izgradnje infrastrukture do vatrogasaca, sada je napokon skinut.

Za to je, bez lažne skromnosti, svakako najzaslužniji mladi splitski odvjetnik Kruno Peronja i njegov tim koji je zastupao gradske interese u ovom predmetu i koji je iznimno uspješnim vođenjem spora za poništaj arbitražnog pravorijeka koji je trajao više od četiri godine sad i pravomoćno otklonio mogućnost da više od 650 milijuna kuna privatnih dugova bude preneseno kao obveza na Grad Split. Njegov uspjeh, a time i uspjeh Grada, svakako je još veći ako se zna da je inače vjerojatnost uspjeha u sporovima za poništaj arbitražnog pravorijeka manja od jedan posto.

Da je ovo zaista veliki uspjeh proizlazi i iz riječi prof. dr. sc. Hrvoja Sikirića, predsjednika Stalnog arbitražnog sudišta pri HGK koji je prije dvije godine Večernjem listu u intervjuu kazao da su "od početka 2013. do studenog 2018. godine provedena 172 arbitražna postupka pred SAS HGK, ukupne vrijednosti 270 milijuna eura" te da prema njihovim podacima do tada još niti jedan arbitražni pravorijek nije bio pravomoćno poništen.

- Sretan sam, šta da kažem. Prije četiri i pol godine arbitražno sudište pri HGK je donijelo pravorijek koji je Grad Split stavio u vrlo tešku poziciju. Pravna bitka koju smo vodili bila je vrlo teška i neizvjesna, ali smo ovom odlukom vratili ponos Gradu i svim njegovim građanima. Moj tim i ja smo od početka tvrdili da je arbitražna odluka neosnovana i da imamo valjane pravne razloge za njeno poništenje - skroman, ali ponosan, bio je odvjetnik Peronja.
