DORH je odbacio prijavu protiv spliskog gradonačelnika Ivice Puljka, u kojoj ga se optužilo da je "prekršio dva pravilnika Grada Splita i zlouporabio položaj i ovlasti, izdavši dozvolu za prekoračenje buke manifestaciji koju izvodi privatni poduzetnik, ustupivši korištenje trga manifestaciji ‘‘Nocturno‘ na Peristilu". Time je, kako je naveo anonimni podnositelj, gradonačelnik oštetio Grad za najam javne gradske površine "u milijunskim iznosima".

Anonimni građanin podnio prijavu protiv Puljkove odluke o ‘manifestaciji‘ na Peristilu. Spominje se i zatvorska kazna

"Ured za suzbijanje korupcije i organiziranog kriminala je nakon provedenog kriminalističkog istraživanja ... utvrdio da nema osnovane sumnje u počinjenje bilo kojeg kaznenog djela za koje se progon poduzima po službenoj dužnosti", stoji na početku rješenja.

Provedenim izvidima je utvrđeno da Carski trg d.o.o., koji upravlja kavanom Luxor, na temelju ugovora o zakupu javne površine plaća zakupninu čija je visina u skladu s pravilnikom. Stoga, zaključuje DORH, "nisu potvrđeni navodi iz podneska da bi gradonačelnik Ivica Puljak manifestaciji "Nokturno" u organizaciji društva Carski trg d.o.o. dozvolio korištenje trga Peristil bez plaćanja naknade i na taj način oštetio Grad Split". 

Isto tako, provedenim izvidima je utvrđeno da je Puljak bio ovlašten donijeti Zaključak o prekoračenju dopuštene razine buke na otvorenom prostoru na lokaciji Peristil tijekom održavanja manifestacije "Nokturno na Peristilu" u svrhu održavanja kulturnog događaja i koncerata u periodu od 01. travnja do 31. listopada 2023., uvremenu od 19 do 23.30 sati u sezoni, odnosno do 22.30 u predsezoni, a sve sukladno Odluci o dozvoljenom prekoračenju najviše dopuštene razine buke na području Grada Splita. 

U obrazloženju se također navodi da kavana Luxor dugi niz godina organizira manifestaciju "Nokturno na Peristilu", uz podršku turističke zajednice Grada Splita.

Također, što se tiče Pravilnika o korištenju Peristila donesenog 06. rujna 2002. godine, Državno odvjetništvo kaže kako je "izvidima utvrđeno da se isti ne primjenjuje, iako formalno nije stavljen van snage" jer su "u međuvremenu doneseni prethodno navedeni podzakonski akti, koji detaljno sukladno pozitivnim pravnim propisima reguliraju davanje javnih površina u zakup, odobrenje prekoračenja dopuštene razine buke itd."

DORH je odbacio prijavu protiv spliskog gradonačelnika Ivice Puljka, u kojoj ga se optužilo da je "prekršio dva pravilnika Grada Splita i zlouporabio položaj i ovlasti, izdavši dozvolu za prekoračenje buke manifestaciji koju izvodi privatni poduzetnik, ustupivši korištenje trga manifestaciji ‘‘Nocturno‘ na Peristilu". Time je, kako je naveo anonimni podnositelj, gradonačelnik oštetio Grad za najam javne gradske površine "u milijunskim iznosima".

Anonimni građanin podnio prijavu protiv Puljkove odluke o ‘manifestaciji‘ na Peristilu. Spominje se i zatvorska kazna

"Ured za suzbijanje korupcije i organiziranog kriminala je nakon provedenog kriminalističkog istraživanja ... utvrdio da nema osnovane sumnje u počinjenje bilo kojeg kaznenog djela za koje se progon poduzima po službenoj dužnosti", stoji na početku rješenja.

Provedenim izvidima je utvrđeno da Carski trg d.o.o., koji upravlja kavanom Luxor, na temelju ugovora o zakupu javne površine plaća zakupninu čija je visina u skladu s pravilnikom. Stoga, zaključuje DORH, "nisu potvrđeni navodi iz podneska da bi gradonačelnik Ivica Puljak manifestaciji "Nokturno" u organizaciji društva Carski trg d.o.o. dozvolio korištenje trga Peristil bez plaćanja naknade i na taj način oštetio Grad Split". 

Isto tako, provedenim izvidima je utvrđeno da je Puljak bio ovlašten donijeti Zaključak o prekoračenju dopuštene razine buke na otvorenom prostoru na lokaciji Peristil tijekom održavanja manifestacije "Nokturno na Peristilu" u svrhu održavanja kulturnog događaja i koncerata u periodu od 01. travnja do 31. listopada 2023., uvremenu od 19 do 23.30 sati u sezoni, odnosno do 22.30 u predsezoni, a sve sukladno Odluci o dozvoljenom prekoračenju najviše dopuštene razine buke na području Grada Splita. 

U obrazloženju se također navodi da kavana Luxor dugi niz godina organizira manifestaciju "Nokturno na Peristilu", uz podršku turističke zajednice Grada Splita.

Također, što se tiče Pravilnika o korištenju Peristila donesenog 06. rujna 2002. godine, Državno odvjetništvo kaže kako je "izvidima utvrđeno da se isti ne primjenjuje, iako formalno nije stavljen van snage" jer su "u međuvremenu doneseni prethodno navedeni podzakonski akti, koji detaljno sukladno pozitivnim pravnim propisima reguliraju davanje javnih površina u zakup, odobrenje prekoračenja dopuštene razine buke itd."

Puljak ipak nije pogodovao Luxoru s dozvolom za prekoračenje buke? DORH je odbacio anonimnu prijavu, a evo i zašto

DORH je odbacio prijavu protiv spliskog gradonačelnika Ivice Puljka, u kojoj ga se optužilo da je "prekršio dva pravilnika Grada Splita i zlouporabio položaj i ovlasti, izdavši dozvolu za prekoračenje buke manifestaciji koju izvodi privatni poduzetnik, ustupivši korištenje trga manifestaciji ‘‘Nocturno‘ na Peristilu". Time je, kako je naveo anonimni podnositelj, gradonačelnik oštetio Grad za najam javne gradske površine "u milijunskim iznosima".

Anonimni građanin podnio prijavu protiv Puljkove odluke o ‘manifestaciji‘ na Peristilu. Spominje se i zatvorska kazna

"Ured za suzbijanje korupcije i organiziranog kriminala je nakon provedenog kriminalističkog istraživanja ... utvrdio da nema osnovane sumnje u počinjenje bilo kojeg kaznenog djela za koje se progon poduzima po službenoj dužnosti", stoji na početku rješenja.
