Devet gradskih autobusa tvrtke "Promet", koje je splitski prijevoznik nabavio početkom 90-ih od slovenskog "A-Cosmosa", gotovo su četvrt stoljeća predmet spora.

Budući da nakon isteka leasinga nisu otkupljeni, nastao je spor koji je dijelom riješen sa slovenskom tvrtkom, no dio postupka još nije završen. On se odnosi na spomenutih devet autobusa koje je od slovenskog zastupnika 1998. godine otkupio odvjetnik Željko Lubina, inače odvjetnik na strani tužitelja u tom slučaju. Presudom je naloženo da mu javni prijevoznik isporuči konkretno tih naznačenih devet autobusa iz 1989. godine u tehnički ispravnom stanju. Takav zahtjev je nemoguće ispuniti jer su autobusi odavno otpisani i nisu prikladni za isporuku, kao ni za tehnički pregled.

Zato je u korist splitskog odvjetnika sud naložio da Lubini svaki dan "Promet" plati 250 kuna penala za svaki autobus.

Jednostavnom računicom dolazimo do iznosa od 2250 kuna dnevno, 67 i pol tisuća kuna mjesečno i 810 tisuća kuna godišnje, a do sada je tvrtka javnog gradskog prijevoznika Lubini isplatila nešto više od tri milijuna i 400 tisuća kuna. Osim toga, odvjetnik je u svibnju 2017. godine podnio zahtjev za povećanje penala, odnosno za njihovo udvostručenje, ali mu je prvostupanjski i drugostupanjski sud odbio takav zahtjev.

Tužba protiv Delića

No, 1. kolovoza ove godine "Promet" je prestao isplaćivati penale Željku Lubini, što znači da samo na "račun" takve odluke u rujnu blagajna ovog gradskog poduzeća ima 67 i pol tisuća kuna više na računu. Kako neslužbeno doznajemo, nakon takve odluke Miroslava Delića, direktora tvrtke, Lubina je najavio pokretanje postupka protiv Delića. Međutim, u telefonskom razgovoru direktor "Prometa" nam je kazao da odvjetnik može koristiti sve pravne alate koje želi, ali Delić ističe da donosi odluke koje su isključivo u interesu tvrtke i najavljuje da se penali do daljnjeg više neće isplaćivati na njegov račun.

- Uz nabavu autobusa, kao i restrukturiranje tvrtke, nakon dolaska na mjesto direktora, ovaj spor je jedan od problema koji sam odlučio riješiti - rekao je čelni čovjek "Prometa", a tijekom prošle godine pripremali su dokumentaciju temeljem koje su u prosincu 2019. podnijeli prijedlog pred splitskim Općinskim sudom radi ukidanja sudskih penala za devet autobusa.

- Sutkinja navedenog suda je taj prijedlog odbacila kao nedopušten, jer prema njezinu mišljenju taj naš prijedlog sadržajno predstavlja žalbu na citirano rješenje o određivanju sudskih penala te nije moguć - pojasnio je direktor Miroslav Delić, koji se žalio na takvu odluku te je Županijski sud u Splitu uvažio njihove argumente i predmet vratio na ponovno postupanje.

Izuzeće sutkinje

- Nakon zaprimljene odluke splitskog Županijskog suda "Promet" je zatražio i izuzeće navedene sutkinje. Naknadno smo dobili saznanja da je Željko Lubina kao odvjetnik zastupao interese sutkinje pa postoji sumnja da nije pristrana u ovom postupku.

Dostavili smo taj zahtjev sudu i zatražili odgodu ovrhe do pravomoćnog okončanja spora u ponovljenom postupku, koji će se nastaviti čim predsjednica Općinskog suda odluči o zahtjevu za izuzeće - odgovorio je Miroslav Delić, ali je već početkom kolovoza prestao plaćati penale za devet autobusa starih više od 30 godina.

"Promet" je u travnju ove godine pred Općinskim sudom u Makarskoj, Stalnoj službi u Imotskom koja je donijela Rješenje o ovrsi, podnio i prijedlog radi ukidanja sudskih penala, ali još uvijek nisu donijeli odluku.

Devet gradskih autobusa tvrtke "Promet", koje je splitski prijevoznik nabavio početkom 90-ih od slovenskog "A-Cosmosa", gotovo su četvrt stoljeća predmet spora.

Budući da nakon isteka leasinga nisu otkupljeni, nastao je spor koji je dijelom riješen sa slovenskom tvrtkom, no dio postupka još nije završen. On se odnosi na spomenutih devet autobusa koje je od slovenskog zastupnika 1998. godine otkupio odvjetnik Željko Lubina, inače odvjetnik na strani tužitelja u tom slučaju. Presudom je naloženo da mu javni prijevoznik isporuči konkretno tih naznačenih devet autobusa iz 1989. godine u tehnički ispravnom stanju. Takav zahtjev je nemoguće ispuniti jer su autobusi odavno otpisani i nisu prikladni za isporuku, kao ni za tehnički pregled.

Zato je u korist splitskog odvjetnika sud naložio da Lubini svaki dan "Promet" plati 250 kuna penala za svaki autobus.

Jednostavnom računicom dolazimo do iznosa od 2250 kuna dnevno, 67 i pol tisuća kuna mjesečno i 810 tisuća kuna godišnje, a do sada je tvrtka javnog gradskog prijevoznika Lubini isplatila nešto više od tri milijuna i 400 tisuća kuna. Osim toga, odvjetnik je u svibnju 2017. godine podnio zahtjev za povećanje penala, odnosno za njihovo udvostručenje, ali mu je prvostupanjski i drugostupanjski sud odbio takav zahtjev.

Tužba protiv Delića

No, 1. kolovoza ove godine "Promet" je prestao isplaćivati penale Željku Lubini, što znači da samo na "račun" takve odluke u rujnu blagajna ovog gradskog poduzeća ima 67 i pol tisuća kuna više na računu. Kako neslužbeno doznajemo, nakon takve odluke Miroslava Delića, direktora tvrtke, Lubina je najavio pokretanje postupka protiv Delića. Međutim, u telefonskom razgovoru direktor "Prometa" nam je kazao da odvjetnik može koristiti sve pravne alate koje želi, ali Delić ističe da donosi odluke koje su isključivo u interesu tvrtke i najavljuje da se penali do daljnjeg više neće isplaćivati na njegov račun.

- Uz nabavu autobusa, kao i restrukturiranje tvrtke, nakon dolaska na mjesto direktora, ovaj spor je jedan od problema koji sam odlučio riješiti - rekao je čelni čovjek "Prometa", a tijekom prošle godine pripremali su dokumentaciju temeljem koje su u prosincu 2019. podnijeli prijedlog pred splitskim Općinskim sudom radi ukidanja sudskih penala za devet autobusa.

- Sutkinja navedenog suda je taj prijedlog odbacila kao nedopušten, jer prema njezinu mišljenju taj naš prijedlog sadržajno predstavlja žalbu na citirano rješenje o određivanju sudskih penala te nije moguć - pojasnio je direktor Miroslav Delić, koji se žalio na takvu odluku te je Županijski sud u Splitu uvažio njihove argumente i predmet vratio na ponovno postupanje.

Izuzeće sutkinje

- Nakon zaprimljene odluke splitskog Županijskog suda "Promet" je zatražio i izuzeće navedene sutkinje. Naknadno smo dobili saznanja da je Željko Lubina kao odvjetnik zastupao interese sutkinje pa postoji sumnja da nije pristrana u ovom postupku.

Dostavili smo taj zahtjev sudu i zatražili odgodu ovrhe do pravomoćnog okončanja spora u ponovljenom postupku, koji će se nastaviti čim predsjednica Općinskog suda odluči o zahtjevu za izuzeće - odgovorio je Miroslav Delić, ali je već početkom kolovoza prestao plaćati penale za devet autobusa starih više od 30 godina.

"Promet" je u travnju ove godine pred Općinskim sudom u Makarskoj, Stalnoj službi u Imotskom koja je donijela Rješenje o ovrsi, podnio i prijedlog radi ukidanja sudskih penala, ali još uvijek nisu donijeli odluku.
