U jeku pravnog rata između Grada Splita i “Pointa” oko koncesije za održavanje nogostupa i ostalih izvankolničkih površina, paralelno se odvila još jedna bitka koja je svoj epilog na kraju dobila na Visokom upravnom sudu.

Naime, tvrtka “Point” tužila je Državnu komisiju za kontrolu postupka javne nabave (DKOM) zbog toga što u cijelosti nije poništila natječaj za nogostupe koji je raspisao Grad Split, nego je samo djelomično poništila njegove dvije točke, o čemu smo već pisali.

Natječaj ili sporazum?

Građevinska tvrtka u svojoj tužbi osporava zakonitost rješenja DKOM-a smatrajući da je državna institucija utvrdila kako Grad može pokrenuti novi natječaj te sklopiti novi ugovor iako za isti posao već postoji okvirni sporazum s osiguranim sredstvima i potrebom za njegovim izvršenjem.

No, Državna komisija je u odgovoru na tužbu ustvrdila kako iz tužbe proizlazi da “Point” ne razlikuje okvirni sporazum od ugovora o javnoj nabavi. Visoki upravni sud odbio je tužbeni zahtjev “Pointa” za poništenjem rješenja Državne komisije i poništenjem javnog natječaja, kao i zahtjev za naknadu troškova ovog upravnog spora.

Dakle, ovom presudom je utvrđeno kako je Grad imao pravo raspisati novo nadmetanje, ali to, nažalost, ne znači da je status toga natječaja promijenjen, što znači da je on i dalje blokiran od strane bivšeg koncesionara za “trotoare”, koji se žalio na natječajnu dokumentaciju te da se i dalje čeka rješenje Državne komisije u vezi s tim.

Očito je da problema s javnim nadmetanjem nema samo Grad Split, nego i njegova tvrtka “Split parking”, koja je raspisala natječaje za izradu projektne dokumentacije te za sanaciju garaža.

Ovdje, naime, imamo slučaj “unakrsnih žalbi”, koliko god to čudno zvučalo. No, pokušat ćemo objasniti.

’Unakrsne žalbe’ u ‘Split parkingu’

Izradu projektne dokumentacije za garažu u Odeskoj na natječaju je dobila zagrebačka tvrtka “Kap4”, koja je ponudila cijenu od 262.375 kuna s PDV-om, što je poprilično niže od procijenjene vrijednosti nabave koja je iznosila 450.000 kuna.

Na odluku o odabiru žalila se tvrtka “VV projekt” iz Splita, koja je pak dobila posao izrade dokumentacije za garažu u Dobrilinoj za 367.125 kuna, a na njezin se odabir žalila upravo – tvrtka “Kap4”.

Ista stvar se dogodila i kod natječaja za sanaciju garaža Pujanke 1 i u Šimićevoj ulici. Najpovoljniji ponuditelj za sanaciju garaže u Šimićevoj bila je zajednica ponuditelja u kojoj su tvrtke iz Slavonskog Broda “Poduzeće za ceste” i “Madex”, s cijenom od 9.083.761,03 kune s uključenim PDV-om.

Na tu odluku o odabiru žalio se slovenski “Map-trade” koji je dobio posao sanacije garaže Pujanke 1 ponudivši cijenu od 4.314.308,59 kuna s PDV-om.

Sve navedene žalbe izjavljene su Državnoj komisiji za kontrolu postupka javne nabave te se čeka njihov pravorijek.

U jeku pravnog rata između Grada Splita i “Pointa” oko koncesije za održavanje nogostupa i ostalih izvankolničkih površina, paralelno se odvila još jedna bitka koja je svoj epilog na kraju dobila na Visokom upravnom sudu.

Naime, tvrtka “Point” tužila je Državnu komisiju za kontrolu postupka javne nabave (DKOM) zbog toga što u cijelosti nije poništila natječaj za nogostupe koji je raspisao Grad Split, nego je samo djelomično poništila njegove dvije točke, o čemu smo već pisali.

Natječaj ili sporazum?

Građevinska tvrtka u svojoj tužbi osporava zakonitost rješenja DKOM-a smatrajući da je državna institucija utvrdila kako Grad može pokrenuti novi natječaj te sklopiti novi ugovor iako za isti posao već postoji okvirni sporazum s osiguranim sredstvima i potrebom za njegovim izvršenjem.

No, Državna komisija je u odgovoru na tužbu ustvrdila kako iz tužbe proizlazi da “Point” ne razlikuje okvirni sporazum od ugovora o javnoj nabavi. Visoki upravni sud odbio je tužbeni zahtjev “Pointa” za poništenjem rješenja Državne komisije i poništenjem javnog natječaja, kao i zahtjev za naknadu troškova ovog upravnog spora.

Dakle, ovom presudom je utvrđeno kako je Grad imao pravo raspisati novo nadmetanje, ali to, nažalost, ne znači da je status toga natječaja promijenjen, što znači da je on i dalje blokiran od strane bivšeg koncesionara za “trotoare”, koji se žalio na natječajnu dokumentaciju te da se i dalje čeka rješenje Državne komisije u vezi s tim.

Očito je da problema s javnim nadmetanjem nema samo Grad Split, nego i njegova tvrtka “Split parking”, koja je raspisala natječaje za izradu projektne dokumentacije te za sanaciju garaža.

Ovdje, naime, imamo slučaj “unakrsnih žalbi”, koliko god to čudno zvučalo. No, pokušat ćemo objasniti.

’Unakrsne žalbe’ u ‘Split parkingu’

Izradu projektne dokumentacije za garažu u Odeskoj na natječaju je dobila zagrebačka tvrtka “Kap4”, koja je ponudila cijenu od 262.375 kuna s PDV-om, što je poprilično niže od procijenjene vrijednosti nabave koja je iznosila 450.000 kuna.

Na odluku o odabiru žalila se tvrtka “VV projekt” iz Splita, koja je pak dobila posao izrade dokumentacije za garažu u Dobrilinoj za 367.125 kuna, a na njezin se odabir žalila upravo – tvrtka “Kap4”.

Ista stvar se dogodila i kod natječaja za sanaciju garaža Pujanke 1 i u Šimićevoj ulici. Najpovoljniji ponuditelj za sanaciju garaže u Šimićevoj bila je zajednica ponuditelja u kojoj su tvrtke iz Slavonskog Broda “Poduzeće za ceste” i “Madex”, s cijenom od 9.083.761,03 kune s uključenim PDV-om.

Na tu odluku o odabiru žalio se slovenski “Map-trade” koji je dobio posao sanacije garaže Pujanke 1 ponudivši cijenu od 4.314.308,59 kuna s PDV-om.

Sve navedene žalbe izjavljene su Državnoj komisiji za kontrolu postupka javne nabave te se čeka njihov pravorijek.

‘Point’ izgubio upravni spor, ali je natječaj za ‘trotoare’ još - blokiran

U jeku pravnog rata između Grada Splita i “Pointa” oko koncesije za održavanje nogostupa i ostalih izvankolničkih površina, paralelno se odvila još jedna bitka koja je svoj epilog na kraju dobila na Visokom upravnom sudu.

Naime, tvrtka “Point” tužila je Državnu komisiju za kontrolu postupka javne nabave (DKOM) zbog toga što u cijelosti nije poništila natječaj za nogostupe koji je raspisao Grad Split, nego je samo djelomično poništila njegove dvije točke, o čemu smo već pisali.

Natječaj ili sporazum?

Građevinska tvrtka u svojoj tužbi osporava zakonitost rješenja DKOM-a smatrajući da je državna institucija utvrdila kako Grad može pokrenuti novi natječaj te sklopiti novi ugovor iako za isti posao već postoji okvirni sporazum s osiguranim sredstvima i potrebom za njegov...
