Kad mjesecima izostanu plaće u privatnog poslodavca, kad su mu tvrtke na rubu propasti, u predstečajnom postupku ili sud već odlučuje o njihovu stečaju, a vlasnik nema stvarne kune da isplati radnike, iako istovremeno govori o barem 700 milijuna kuna dobiti kroz svoje škverske godine, pa se svatko pita jesu li stvarne ili tek računovodstvene, što s njima radi i gdje ih to krije, kad zaposlenicima umjesto osobnog dohotka nudi pozajmice s dva posto kamata - onda nije čudo da uskače država.
Ukratko: državna Agencija za osiguranje radničkih tražbina (AORT) isplatila je dosad gotovo sedam milijuna kuna (6.966.587) za 963 radnika iz "Brodosplitova" sustava, pozobanog grozda u vlasništvu Tomislava Debeljaka. Zaključno s četvrtkom. A bit će toga još...
- Prve zahtjeve za isplatu minimalnih plaća radnicima zaprimili smo 28. travnja 2022. godine. Taj zahtjev odnosio se na isplatu minimalca za veljaču radnicima poduzeća "Efficient Powerful Successful", a tijekom svibnja i lipnja uslijedili su zahtjevi i za druga poduzeća grupacije "DIV/Brodosplit". Zahtjevi se odnose na plaće za veljaču i ožujak. Idućih dana nastavit će se s isplatama sukladno novim zahtjevima.
Kazao nam je to mr. Ivan Madunić, ravnatelj AORT-a. Minimalac iznosi 3750 kuna, neto.
Naprimjer, u srijedu je išla isplata za firmu "Efficient Powerful Successful" iz Knina, u iznosu od 596.127,99 kuna, za njihovih 112 radnika. Zaključno s petkom, trebala bi ići isplata za tvrtke "Boja trup", "Skelarski radovi" i "Brodosplit trgovina", u iznosu od 838.027 kuna.
- Pristižu zahtjevi i drugih firmi iz grupacije, za veljaču i travanj. Teško je točno reći kada će biti isplata po tim zahtjevima jer svaki treba provjeriti, uskladiti s Financijskom agencijom i napisati rješenja, no dat ćemo sve od sebe da isplata bude u što kraćem roku, ističe Madunić.

Prema njegovu tumačenju, pravo na isplatu naknada, sukladno Zakonu o osiguranju radničkih tražbina, imaju radnici kojima poslodavac do konca mjeseca nije isplatio plaću za prethodni mjesec. Procedura je takva da poslodavac mora u Fini blokirati svoj poslovni račun u korist plaće radnicima i ako nema novca na računu, poslodavac podnosi zahtjev AORT-u za isplatu minimalca radnicima.
Na taj način radnici mogu dobiti tri minimalca i naknade za bolovanje koje je bilo na teret tvrtke. Pravo na isplatu imaju i radnici poslodavca koji je u prestečajnom postupku.
- No, danom otvaranja stečajnog postupka gubi se pravo na isplatu naknada s osnove blokade računa poslodavca, ali se stječe pravo za isplatu naknada radnicima poslodavca u stečaju - upućuje ravnatelj Agencije.
To je važno, budući da je Debeljakov krovni "Brodosplit" (d.d.) u predstečajnom postupku, dok su gotovo sva društva kćeri (d.o.o.), njih tridesetak, na rubu stečaja koji je predložila Fina, a upravo te tvrtke kćeri zapošljavaju najveći broj ljudi. Za razliku od majčinskog "Brodosplita" s tek 132 zaposlena.
Procedura je takva da Trgovački sud otvori stečajni postupak i zakaže skupštinu vjerovnika na kojoj se utvrđuju tražbine. Svaki radnik u roku koji odredi sud treba stečajnom upravitelju prijaviti sve što mu poslodavac duguje. Sud će utvrditi pravo svakog radnika na određena potraživanja i poslati mu rješenje kući.
Nakon objave sudskog rješenja o utvrđenim tražbinama na oglasnoj ploči i protekom osam dana, svaki radnik ima 30 dana za podnošenje zahtjeva AORT-u za isplatu naknada u stečaju. Može ih se poslati preko interneta, poštom ili preko Zavoda za zapošljavanje. Upute se nalaze na Agencijinim stranicama, a znaju ih i stečajni upravitelji.

Radnici imaju pravo na: tri minimalne plaće, naknade za neiskorišteni godišnji odmor (u visini tri minimalca), naknade za bolovanje koje je bilo na teret poslodavca (u visini minimalne plaće), naknade za otpremninu (polovica utvrđenog prava na otpremninu) i naknade za dosuđenu naknadu štete od ozljede na radu (u visini do 1/3 pravomoćno dosuđene naknade štete).
AORT se financira iz državnog proračuna, a novac je osigurala Vlada. Isplate radnicima u vrijeme blokade računa tvrtke Agencija kasnije potražuju od poslodavca ili prijavljuje u tražbine stečajnih vjerovnika, zajedno s isplatama u stečaju. Tražbina svakog radnika umanjit će se za minimalce ili naknade koje mu je u međuvremenu isplatila Agencija.
- Kod stečaja, uvjet da radnik dobije naknadu od AORT-a je da je bio u radnom odnosu najmanje šest mjeseci prije otvaranja stečajnog postupka - naglašava Madunić.

Hoće li biti pet minimalaca?
- U tijeku su izmjene i dopune Zakona o osiguranju radničkih tražbina s namjerom povećanja prava radnika poslodavca u stečaju. Vlada predlaže da se isplata s tri minimalne plaće poveća na pet i da se uvjet statusa radnog odnosa kod poslodavca produži sa šest na deset mjeseci. Naime, bilo je slučajeva da radnici daju otkaz čim nastanu problemi u kompaniji, a do otvaranja stečaja prođe više od šest mjeseci, čime bi oni izgubili pravo na isplatu naknada. Zato je prijedlog da to razdoblje bude deset mjeseci - kaže ravnatelj Madunić.
Podsjetimo, svi škverski radnici - a nitko ne zna koliko ih je ukupno (Debeljak je u papirima za predstečaj naveo 1118 za "Brodosplitovu" grupu, a inače govori i o 2000 zaposlenih - nisu dobili plaće za veljaču, ožujak i travanj. Teško da će drugačije biti i sa svibnjem.

Kad mjesecima izostanu plaće u privatnog poslodavca, kad su mu tvrtke na rubu propasti, u predstečajnom postupku ili sud već odlučuje o njihovu stečaju, a vlasnik nema stvarne kune da isplati radnike, iako istovremeno govori o barem 700 milijuna kuna dobiti kroz svoje škverske godine, pa se svatko pita jesu li stvarne ili tek računovodstvene, što s njima radi i gdje ih to krije, kad zaposlenicima umjesto osobnog dohotka nudi pozajmice s dva posto kamata - onda nije čudo da uskače država.
Ukratko: državna Agencija za osiguranje radničkih tražbina (AORT) isplatila je dosad gotovo sedam milijuna kuna (6.966.587) za 963 radnika iz "Brodosplitova" sustava, pozobanog grozda u vlasništvu Tomislava Debeljaka. Zaključno s četvrtkom. A bit će toga još...
- Prve zahtjeve za isplatu minimalnih plaća radnicima zaprimili smo 28. travnja 2022. godine. Taj zahtjev odnosio se na isplatu minimalca za veljaču radnicima poduzeća "Efficient Powerful Successful", a tijekom svibnja i lipnja uslijedili su zahtjevi i za druga poduzeća grupacije "DIV/Brodosplit". Zahtjevi se odnose na plaće za veljaču i ožujak. Idućih dana nastavit će se s isplatama sukladno novim zahtjevima.
Kazao nam je to mr. Ivan Madunić, ravnatelj AORT-a. Minimalac iznosi 3750 kuna, neto.
Naprimjer, u srijedu je išla isplata za firmu "Efficient Powerful Successful" iz Knina, u iznosu od 596.127,99 kuna, za njihovih 112 radnika. Zaključno s petkom, trebala bi ići isplata za tvrtke "Boja trup", "Skelarski radovi" i "Brodosplit trgovina", u iznosu od 838.027 kuna.
- Pristižu zahtjevi i drugih firmi iz grupacije, za veljaču i travanj. Teško je točno reći kada će biti isplata po tim zahtjevima jer svaki treba provjeriti, uskladiti s Financijskom agencijom i napisati rješenja, no dat ćemo sve od sebe da isplata bude u što kraćem roku, ističe Madunić.

Prema njegovu tumačenju, pravo na isplatu naknada, sukladno Zakonu o osiguranju radničkih tražbina, imaju radnici kojima poslodavac do konca mjeseca nije isplatio plaću za prethodni mjesec. Procedura je takva da poslodavac mora u Fini blokirati svoj poslovni račun u korist plaće radnicima i ako nema novca na računu, poslodavac podnosi zahtjev AORT-u za isplatu minimalca radnicima.
Na taj način radnici mogu dobiti tri minimalca i naknade za bolovanje koje je bilo na teret tvrtke. Pravo na isplatu imaju i radnici poslodavca koji je u prestečajnom postupku.
- No, danom otvaranja stečajnog postupka gubi se pravo na isplatu naknada s osnove blokade računa poslodavca, ali se stječe pravo za isplatu naknada radnicima poslodavca u stečaju - upućuje ravnatelj Agencije.
To je važno, budući da je Debeljakov krovni "Brodosplit" (d.d.) u predstečajnom postupku, dok su gotovo sva društva kćeri (d.o.o.), njih tridesetak, na rubu stečaja koji je predložila Fina, a upravo te tvrtke kćeri zapošljavaju najveći broj ljudi. Za razliku od majčinskog "Brodosplita" s tek 132 zaposlena.
Procedura je takva da Trgovački sud otvori stečajni postupak i zakaže skupštinu vjerovnika na kojoj se utvrđuju tražbine. Svaki radnik u roku koji odredi sud treba stečajnom upravitelju prijaviti sve što mu poslodavac duguje. Sud će utvrditi pravo svakog radnika na određena potraživanja i poslati mu rješenje kući.
Nakon objave sudskog rješenja o utvrđenim tražbinama na oglasnoj ploči i protekom osam dana, svaki radnik ima 30 dana za podnošenje zahtjeva AORT-u za isplatu naknada u stečaju. Može ih se poslati preko interneta, poštom ili preko Zavoda za zapošljavanje. Upute se nalaze na Agencijinim stranicama, a znaju ih i stečajni upravitelji.

Radnici imaju pravo na: tri minimalne plaće, naknade za neiskorišteni godišnji odmor (u visini tri minimalca), naknade za bolovanje koje je bilo na teret poslodavca (u visini minimalne plaće), naknade za otpremninu (polovica utvrđenog prava na otpremninu) i naknade za dosuđenu naknadu štete od ozljede na radu (u visini do 1/3 pravomoćno dosuđene naknade štete).
AORT se financira iz državnog proračuna, a novac je osigurala Vlada. Isplate radnicima u vrijeme blokade računa tvrtke Agencija kasnije potražuju od poslodavca ili prijavljuje u tražbine stečajnih vjerovnika, zajedno s isplatama u stečaju. Tražbina svakog radnika umanjit će se za minimalce ili naknade koje mu je u međuvremenu isplatila Agencija.
- Kod stečaja, uvjet da radnik dobije naknadu od AORT-a je da je bio u radnom odnosu najmanje šest mjeseci prije otvaranja stečajnog postupka - naglašava Madunić.

Hoće li biti pet minimalaca?
- U tijeku su izmjene i dopune Zakona o osiguranju radničkih tražbina s namjerom povećanja prava radnika poslodavca u stečaju. Vlada predlaže da se isplata s tri minimalne plaće poveća na pet i da se uvjet statusa radnog odnosa kod poslodavca produži sa šest na deset mjeseci. Naime, bilo je slučajeva da radnici daju otkaz čim nastanu problemi u kompaniji, a do otvaranja stečaja prođe više od šest mjeseci, čime bi oni izgubili pravo na isplatu naknada. Zato je prijedlog da to razdoblje bude deset mjeseci - kaže ravnatelj Madunić.
Podsjetimo, svi škverski radnici - a nitko ne zna koliko ih je ukupno (Debeljak je u papirima za predstečaj naveo 1118 za "Brodosplitovu" grupu, a inače govori i o 2000 zaposlenih - nisu dobili plaće za veljaču, ožujak i travanj. Teško da će drugačije biti i sa svibnjem.
