- Trgovački sud u Splitu zbog tuđeg duga prodaje moj stan! Zašto ga želi prodati prije nego što se okonča sudska parnica kojom želim spasiti svoju imovinu? Ako sada dođe do prodaje, onda više nema povratka, i bit će mi nanesena ogromna šteta.

Kaže nam to naš šokirani sugrađanin. Trenutno pod nogama, naime, gori trojici stanovnika našeg grada koji su svoje domove platili tvrtki "Atrium Spalatum", a tvrtka "Atrium Spalatum" u stečaju ih odbija upisati kao vlasnike stanova, već ih ponovo prodaje odlukom Trgovačkog suda.

To nisu izolirani slučajevi, već nas odvjetnici upozoravaju da su u Splitu čak 152 obitelji kojima prijeti da ostanu bez svog stana zbog dugova građevinskih investitora, jer ne radi se samo o zgradi Lazarica na Firulama.

- Mnogi su od investitora kupovali stanove dok zgrada nije bila gotova. Onda im neki kažu da što su kupili stan kad je na njemu bila hipoteka banke koja prati gradnju.

No, to nije točno, jer tada na stanu nije bila hipoteka. Ona je bila upisana na zemljištu jer je investitor dobio kredit od banke. Budući da investitor nije platio cijeli kredit, hipoteka se po zakonu, nakon etažiranja zgrade, protegne po svim stanovima i poslovnim prostorima – kaže nam odvjetnik dobro upoznat sa situacijom, te napominje:

- Onda tvrtka za otkup potraživanja, koja je od banke preuzela hipoteku, traži prodaju i onih stanova koji su već jednom prodani.

Svoje stanove su, kažu kupci, "Atrium Spalatumu" platili u potpunosti i to su jedni već dokazali, drugi radi toga vode sudske postupke.

Prije mjesec dana su se ponadali dobrom ishodu jer je sudac Ivo Bakalić s Trgovačkog suda  po službenoj dužnosti utvrdio ništetnost ugovora iz 2004. godine o izdavanju devizne garancije između banke i "Atrium Spalatuma", kojim je upisana jedna od hipoteka na zgradi Lazarica. 

No, onda je u ponedjeljak uslijedio šok. Isti sud donosi rješenje o prodaji stanova i poslovnih prostora u Lazarici. Umjesto toga nadali su se da će Trgovački sud izdati privremenu mjeru zabrane prodaje tih nekretnina dok se parnice ne završe, jer je donošenje takve privremene mjere naložio Visoki trgovački sud!

U međuvremenu su trajali pregovori s tvrtkom koja je otkupila potraživanja banke prema "Atrium Spalatumu" u stečaju.

Našim sugrađanima koji su već jednom platili te stanove ponuđeno je ih ponovo plate 1530 eura po kvadratu. To su prihvatili, inače će izgubiti sve. Tvrtka je tražila dokaz da taj novac svi oni već imaju na računima. Budući da do sada nisu mogli sakupiti svih traženih 100.000 eura ili 200.000 eura, dogovor nije finaliziran potpisivanjem ugovora.

Zašto je sud 29. kolovoza naložio prodaju tih stanova u Lazarici, upitali smo njegovu predsjednicu Franku Buzov.

- Potencijalni kupci samo su djelomično platili kupoprodajnu cijenu za stanove prije otvaranja stečajnog postupka nad dužnikom "Atrium Spalatum". Zbog toga nisu ostvarili pravo vlasništva, pa su stanovi u zemljišnim knjigama upisani kao vlasništvo stečajnog dužnika. Za uplaćenu cijenu stanova priznata im je tražbina u stečajnom postupku.

Sud je više od šest mjeseci od izvršene nove procjene stanova potencijalnim kupcima ostavio rok za dogovore sa založnim vjerovnikom "Adriatic Assets" oko otplate preostale cijene za stanove te davanje brisovnog očitovanja novim vlasnicima, ali očito bez uspjeha.

Ako se taj dogovor postigne između potencijalnih kupaca i razlučnog vjerovnika, te dogovore modaliteti plaćanja preostale cijene za stanove, sud može do dovršetka dražbovanja na prijedlog razlučnog vjerovnika, koji je i predložio ovu prodaju u podnesku od 25. kolovoza 2022., obustaviti daljnje provođenje prodaje stanova – kazala nam je predsjednica suda, te nastavila:

- Zaključak o prodaji stanova je donesen zato što u međuvremenu nisu donesene privremene mjere o zabrani prodaje tih stanova u pokrenutim postupcima pred sudom. Ako privremene mjere o zabrani nastavka prodaje navedenih stanova odlukom suda budu donesene, stečajni sud će obustaviti poduzimanje daljnjih radnji u vezi prodaje stanova.

- Trgovački sud u Splitu zbog tuđeg duga prodaje moj stan! Zašto ga želi prodati prije nego što se okonča sudska parnica kojom želim spasiti svoju imovinu? Ako sada dođe do prodaje, onda više nema povratka, i bit će mi nanesena ogromna šteta.

Kaže nam to naš šokirani sugrađanin. Trenutno pod nogama, naime, gori trojici stanovnika našeg grada koji su svoje domove platili tvrtki "Atrium Spalatum", a tvrtka "Atrium Spalatum" u stečaju ih odbija upisati kao vlasnike stanova, već ih ponovo prodaje odlukom Trgovačkog suda.

To nisu izolirani slučajevi, već nas odvjetnici upozoravaju da su u Splitu čak 152 obitelji kojima prijeti da ostanu bez svog stana zbog dugova građevinskih investitora, jer ne radi se samo o zgradi Lazarica na Firulama.

- Mnogi su od investitora kupovali stanove dok zgrada nije bila gotova. Onda im neki kažu da što su kupili stan kad je na njemu bila hipoteka banke koja prati gradnju.

No, to nije točno, jer tada na stanu nije bila hipoteka. Ona je bila upisana na zemljištu jer je investitor dobio kredit od banke. Budući da investitor nije platio cijeli kredit, hipoteka se po zakonu, nakon etažiranja zgrade, protegne po svim stanovima i poslovnim prostorima – kaže nam odvjetnik dobro upoznat sa situacijom, te napominje:

- Onda tvrtka za otkup potraživanja, koja je od banke preuzela hipoteku, traži prodaju i onih stanova koji su već jednom prodani.

Svoje stanove su, kažu kupci, "Atrium Spalatumu" platili u potpunosti i to su jedni već dokazali, drugi radi toga vode sudske postupke.

Prije mjesec dana su se ponadali dobrom ishodu jer je sudac Ivo Bakalić s Trgovačkog suda  po službenoj dužnosti utvrdio ništetnost ugovora iz 2004. godine o izdavanju devizne garancije između banke i "Atrium Spalatuma", kojim je upisana jedna od hipoteka na zgradi Lazarica. 

No, onda je u ponedjeljak uslijedio šok. Isti sud donosi rješenje o prodaji stanova i poslovnih prostora u Lazarici. Umjesto toga nadali su se da će Trgovački sud izdati privremenu mjeru zabrane prodaje tih nekretnina dok se parnice ne završe, jer je donošenje takve privremene mjere naložio Visoki trgovački sud!

U međuvremenu su trajali pregovori s tvrtkom koja je otkupila potraživanja banke prema "Atrium Spalatumu" u stečaju.

Našim sugrađanima koji su već jednom platili te stanove ponuđeno je ih ponovo plate 1530 eura po kvadratu. To su prihvatili, inače će izgubiti sve. Tvrtka je tražila dokaz da taj novac svi oni već imaju na računima. Budući da do sada nisu mogli sakupiti svih traženih 100.000 eura ili 200.000 eura, dogovor nije finaliziran potpisivanjem ugovora.

Zašto je sud 29. kolovoza naložio prodaju tih stanova u Lazarici, upitali smo njegovu predsjednicu Franku Buzov.

- Potencijalni kupci samo su djelomično platili kupoprodajnu cijenu za stanove prije otvaranja stečajnog postupka nad dužnikom "Atrium Spalatum". Zbog toga nisu ostvarili pravo vlasništva, pa su stanovi u zemljišnim knjigama upisani kao vlasništvo stečajnog dužnika. Za uplaćenu cijenu stanova priznata im je tražbina u stečajnom postupku.

Sud je više od šest mjeseci od izvršene nove procjene stanova potencijalnim kupcima ostavio rok za dogovore sa založnim vjerovnikom "Adriatic Assets" oko otplate preostale cijene za stanove te davanje brisovnog očitovanja novim vlasnicima, ali očito bez uspjeha.

Ako se taj dogovor postigne između potencijalnih kupaca i razlučnog vjerovnika, te dogovore modaliteti plaćanja preostale cijene za stanove, sud može do dovršetka dražbovanja na prijedlog razlučnog vjerovnika, koji je i predložio ovu prodaju u podnesku od 25. kolovoza 2022., obustaviti daljnje provođenje prodaje stanova – kazala nam je predsjednica suda, te nastavila:

- Zaključak o prodaji stanova je donesen zato što u međuvremenu nisu donesene privremene mjere o zabrani prodaje tih stanova u pokrenutim postupcima pred sudom. Ako privremene mjere o zabrani nastavka prodaje navedenih stanova odlukom suda budu donesene, stečajni sud će obustaviti poduzimanje daljnjih radnji u vezi prodaje stanova.
