Odvjetnik Željko Lubina potvrdio nam je da je podnio reviziju na dio pravomoćne presude kojom se odbija zahtjev da mu "Promet" isplati 26,3 milijuna kuna glavnice i zatezne kamate kao naknadu što od 1998. godine bespravno koristi njegovih devet autobusa. Trgovački sud je treba zaprimiti dokument i proslijediti ga Vrhovnom sudu.
Takav odvjetnikov potez bio je očekivan, jer je upravo Vrhovni sud još 2007. potvrdio da su slovenska tvrtka "A-Cosmos" i on vlasnici dijela voznog parka gradskog prijevoznika. No, Trgovački sud potom je presudio da Lubina u novom postupku nije dokazao koliki mu iznos "Promet" mora isplatiti, te da je upravo na njemu kao tužitelju bio teret dokazivanja.
Odvjetnik je, inače, još početkom veljače od Općinskog suda zatražio da utvrdi kolike mu "penale" mora platiti gradski prijevoznik za svaki dan kašnjenja s predajom vozila, a predmet je proslijeđen sudskoj službu u Imotskom.
I "Promet" je posegnuo za istim sredstvom, pa nam je direktor Željko Krnić potvrdio da je tvrtka pokrenula reviziju dijela presude po kojem Lubini treba vratiti devet autobusa u ispravnom stanju. Odvjetnik je uzvratio da na to nisu imali pravo, jer predmet spora nije ni blizu 500.000 kuna.
– U tijeku su pregovori sa Željkom Lubinom oko predaje autobusa i naloženo je vještačenje kako bi se utvrdilo koliko su vozila vrijedila 1998. godine – kazao je direktor Krnić.
Pretpostavlja se da "Promet“ za te stare autobuse, isporučene još 1990. godine, ne može nabaviti rezervne dijelove da bi ih popravio i vlasniku predao u ispravnom stanju. Tako će Lubinu morati novčano obeštetiti u iznosu koji će utvrditi vještak.
Direktor Krnić naglasio je da se revizija ne odnosi na dio presude koji je vezan uz ljubljansku tvrtku koja je isporučila sporne autobuse. Naime, splitska tvrtka treba isplatiti "A-Cosmosu" 41 milijun kuna. "Prometov" čelnik kazao nam je da će Slovencima uskoro biti isplaćena i druga rata otplate duga (nešto manje od milijun kuna, op.a.), ali nije želio reći hoće li se taj novac "skinuti" s računa tvrtke ili gradske uprave.
Naime, "Promet" je s "A-Cosmosom" nedavno potpisao sporazum po kojem neće podnositi reviziju na dio presude koji se odnosi na tu slovensku tvrtku, a s ciljem da se dogovori obročna otplata duga do 2018. godine kako poslovanje autoprijevoznika ne bi bilo blokirano, te da ne bude izgubljeno 750 radnih mjesta. Da će novac biti osiguran, a u ovoj godini treba podmiriti još 13 milijuna kuna, trebala bi jamčiti Banovina, no samo ako to odobri Gradsko vijeće.

Odvjetnik Željko Lubina potvrdio nam je da je podnio reviziju na dio pravomoćne presude kojom se odbija zahtjev da mu "Promet" isplati 26,3 milijuna kuna glavnice i zatezne kamate kao naknadu što od 1998. godine bespravno koristi njegovih devet autobusa. Trgovački sud je treba zaprimiti dokument i proslijediti ga Vrhovnom sudu.
Takav odvjetnikov potez bio je očekivan, jer je upravo Vrhovni sud još 2007. potvrdio da su slovenska tvrtka "A-Cosmos" i on vlasnici dijela voznog parka gradskog prijevoznika. No, Trgovački sud potom je presudio da Lubina u novom postupku nije dokazao koliki mu iznos "Promet" mora isplatiti, te da je upravo na njemu kao tužitelju bio teret dokazivanja.
Odvjetnik je, inače, još početkom veljače od Općinskog suda zatražio da utvrdi kolike mu "penale" mora platiti gradski prijevoznik za svaki dan kašnjenja s predajom vozila, a predmet je proslijeđen sudskoj službu u Imotskom.
I "Promet" je posegnuo za istim sredstvom, pa nam je direktor Željko Krnić potvrdio da je tvrtka pokrenula reviziju dijela presude po kojem Lubini treba vratiti devet autobusa u ispravnom stanju. Odvjetnik je uzvratio da na to nisu imali pravo, jer predmet spora nije ni blizu 500.000 kuna.
– U tijeku su pregovori sa Željkom Lubinom oko predaje autobusa i naloženo je vještačenje kako bi se utvrdilo koliko su vozila vrijedila 1998. godine – kazao je direktor Krnić.
Pretpostavlja se da "Promet“ za te stare autobuse, isporučene još 1990. godine, ne može nabaviti rezervne dijelove da bi ih popravio i vlasniku predao u ispravnom stanju. Tako će Lubinu morati novčano obeštetiti u iznosu koji će utvrditi vještak.
Direktor Krnić naglasio je da se revizija ne odnosi na dio presude koji je vezan uz ljubljansku tvrtku koja je isporučila sporne autobuse. Naime, splitska tvrtka treba isplatiti "A-Cosmosu" 41 milijun kuna. "Prometov" čelnik kazao nam je da će Slovencima uskoro biti isplaćena i druga rata otplate duga (nešto manje od milijun kuna, op.a.), ali nije želio reći hoće li se taj novac "skinuti" s računa tvrtke ili gradske uprave.
Naime, "Promet" je s "A-Cosmosom" nedavno potpisao sporazum po kojem neće podnositi reviziju na dio presude koji se odnosi na tu slovensku tvrtku, a s ciljem da se dogovori obročna otplata duga do 2018. godine kako poslovanje autoprijevoznika ne bi bilo blokirano, te da ne bude izgubljeno 750 radnih mjesta. Da će novac biti osiguran, a u ovoj godini treba podmiriti još 13 milijuna kuna, trebala bi jamčiti Banovina, no samo ako to odobri Gradsko vijeće.
